DECISION

ON THE AMENDMENT, SUPPLEMENT OF SEVERAL ARTICLES OF THE REGULATION ON REQUIRED RESERVE APPLICABLE TO CREDIT INSTITUTIONS ISSUED IN CONJUNCTION WITH THE DECISION NO. 581/2003/QD-NHNN DATED 9 JUNE 2003 OF THE GOVERNOR OF THE STATE BANK

THE GOVERNOR OF THE STATE BANK

- Pursuant to the Law on the State Bank of Vietnam in 1997; the Law on the amendment, supplement of several Articles of the Law on the State Bank of Vietnam in 2003;
- Pursuant to the Law on the Credit Institutions in 1997; the Law on the amendment, supplement of several Articles of the Law on the Credit Institutions in 2004;
- Pursuant to the Law on the issuance of legal documents in 1996; the Law on the amendment, supplement of several articles of the Law on the issuance of legal documents in 2002;
- Pursuant to the Decree No. 52/2003/ND-CP dated 19 May 2003 of the Government providing for the function, assignment, authority and organizational structure of the State Bank of Vietnam;
- Upon the proposal of the Director of the Monetary Policy Department,

DECIDES:

Article 1. To amend, supplement several articles of the Regulation on required reserve applicable to credit institutions issued in conjunction with the Decision No. 581/2003/QD-NHNN dated 9 June 2003 of the Governor of the State Bank as follows:

1. Paragraph 4, Article 19 shall be amended, supplemented as follows:

"4. Within the first 10 working days of each month, the Banking Operation Department shall be responsible to consolidate report on the required reserve performance of credit institutions under their management and of credit institutions delivered to by the State Banks branches in provinces, cities under the central Governments management for making report to the Governor of the State Bank, at the same time send to the State Bank Inspectorate, the Money Policy Department in accordance with attached Form 3.

3. Within the first 7 working days of each month, the State Banks branches in provinces, cities where credit institutions locate their Head office shall be responsible to consolidate the required reserve performance of credit institutions under their management and send to the State Bank of Vietnam (the Banking Operation Department) in accordance with attached Form 3.

3. The Form 3 attached to the Regulation shall be replaced by the Form attached to this Decision.

4. To repeal Article 21.

Article 2. This Decision shall be effective from 1 September 2005.

Article 3. The Director of the Administrative Department, Chief Inspector of the State Bank, the Director of the Banking Operation Department, the Director of the Monetary Policy Department, Head of units of the State Bank, the General Managers of the State Banks branches in provinces, cities under the central Governments management shall be responsible for the implementation of this Decree.

- The Banking Operation Department shall consolidate and report the State Banks Governor, at the same time send to the State Bank Inspectorate, the Monetary Policy Department within the first 10 working days of each month.
