CIRCULAR

AMENDMENTS TO CIRCULAR NO. 04/2015/TT-BCA DATED JANUARY 5, 2015 OF MINISTRY OF PUBLIC SECURITY ON FORMS RELATED TO ENTRY, EXIT AND STAY OF FOREIGNERS IN VIETNAM

Pursuant to Law on Entry, Exit, Transit and Stay of Foreigners in Vietnam dated June 16, 2014 and Law on amendments to Law on Entry, Exit, Transit and Stay of Foreigners in Vietnam dated November 25, 2019;

Pursuant to Decree No. 01/2018/ND-CP dated August 6, 2018 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the request of Director General of Immigration Department,

Minister of Public Security promulgates Circular on amendments to Circular No. 04/2015/TT-BCA dated January 5, 2015 of Ministry of Public Security on forms related to entry, exit and stay of foreigners in Vietnam.

Article 1. Amendments to Circular No. 04/2015/TT-BCA dated January 5, 2015 of Ministry of Public Security on forms related to entry, exit and stay of foreigners in Vietnam

1. Amendments to Clause 1 Article 1 as follows:

“1. This Circular prescribes and provide guidelines for using and managing document forms related to entry, exit and stay of foreigners in Vietnam as specified under Law on Entry, Exit, Transit and Stay of Foreigners in Vietnam and Law on amendments to Law on Entry, Exit, Transit and Stay of Foreigners in Vietnam”.

2. Addition of Clauses in Article 2 as follows:

a) Insert Clause 1a after Clause 1 as follows:

 “1a. Information in application for electronic visas (NA1a).”.

b) Insert Clauses 19 and 20 after Clause 18 as follows:

“19. Application for issuance of electronic accounts (NA19).

20. Application for cancellation of electronic accounts (NA20)”.

3. Insert Clauses 3a, 3b and 3c after Clause 3 Article 3 as follows:

 “3a. Official Dispatch responding to application for issuance of electronic accounts (NB8).

3b. Official Dispatch rejecting application for issuance of electronic accounts (NB9).

3b. Official Dispatch informing cancellation of electronic accounts (NB10).”.

4. Insert Clauses 2a and 2b after Clause 2 and Clauses 14 and 15 after Clause 13 Article 4 as follows:

 “2a. Electronic visas (NC2a).

2b. Visas according to list of personnel waiting for approval of immigration agencies (NC2b).

14. Samples of nullifying stamps (NC17).

15. Samples of expiry stamps (NC18).”.

5. Amendments to Point a Clause 1 Article 5 as follows:

“a) Immigration Department is contractually responsible to Science and Technology Institute - Ministry of Public Security for conducting research, designing and producing blank prints to promptly fulfill requirements of competent agencies capable of issuing visas, temporary resident cards, permanent residence cards and visa-free entry documents.”.

6. Replace “ngày 29/01/2012” (January 29, 2012) with “ngày 29/01/2002” (January 29, 2002), “Thông tư số 02/2012/TT-BCA” (Circular No. 02/2012/TT-BCA) with “Thông tư số 02/2013/TT-BCA” (Circular No. 02/2013/TT-BCA), and “Thông tư số 25/2013/TT-BCA” (Circular No. 25/2013/TT-BCA) with “Thông tư số 25/2014/TT-BCA” (Circular No. 25/2014/TT-BCA) under Clause 1 Article 6.

Article 2. Entry into force and responsibility for implementation

1. This Circular comes into force from July 1, 2020.

2. Immigration Department is responsible for taking charge and cooperating with police authorities, local governments and other entities in organizing implementation, guiding and examining implementation of this Circular. Heads of entities affiliated to ministries, directors of police authorities of provinces and central-affiliated cities are responsible for implementation of this Circular. Difficulties that arise during the implementation of this Circular should be reported to the Ministry (via Immigration Department) for timely guidance./.
