CIRCULAR

GUIDELINES FOR PROFESSIONAL TRAINING IN OCCUPATIONAL HEALTH

Pursuant to the Law on Occupational Safety and Health dated June 25, 2015;

Pursuant to the Government’s Decree No. 39/2016/ND-CP dated May 15, 2016 elaborating some Articles of the Law on Occupational Safety and Health;

Pursuant to the Government’s Decree No. 44/2016/ND-CP dated May 15, 2016 elaborating some Articles of the Law on Occupational Safety and Health on technical inspection of occupational safety, training in occupational safety and health and occupational environment monitoring; Government’s Decree No. 140/2018/ND-CP dated October 08, 2018 on amendments to Decrees related to business conditions and administrative procedures under the management of the Ministry of Labor, War Invalids and Social Affairs;

Pursuant to the Government’s Decree No. 75/2017/ND-CP dated June 20, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Health;

At the request of the Director General of the Health Environment Management Agency;

The Minister of Health hereby promulgates a Circular on guidelines for professional training in occupational health,

This Circular provides guidelines for training contents, curriculums, syllabuses and length and management of training programs for occupational health certification prescribed in clause 4 Article 73 of the Law on Occupational Safety and Health.

Article 2. Regulated entities

This Circular applies to:

1. Health workers at manufacturing and business establishments, including doctors, preventive medicine physicians, bachelors of nursing, physicians, intermediate-level nurses and midwives specified in clause 3 Article 37 of the Government’s Decree No. 39/2016/ND-CP dated May 15, 2016 elaborating some Articles of the Law on Occupational Safety and Health.

2. Educational institutions which exercise the functions or are assigned to perform the task of providing training in healthcare sector, medical training institutions (hereinafter referred to as “training institutions”).

3. Organizations and individuals involved in training for occupational health certification within the territory of Vietnam.

Article 3. Requirements for training contents, curriculums, syllabuses, length and mode

1. Training contents:

a) General overview of legislative documents on occupational hygiene and employee healthcare;

c) Occupational diseases and occupation-related diseases;

d) First aid and emergency at the workplace;

d) Prevention and control of diseases and non-communicable diseases at the workplace;

e) Food safety and nutrition at the workplace;

g) Communication and education about occupational hygiene, occupational disease prevention and control, healthcare and health promotion at the workplace;

h) Formulating a plan for and organizing occupational hygiene and occupational disease prevention and control at the workplace;

i) Management of occupational hygiene and employee health records.

Specific requirements for the training contents mentioned in this clause are provided in the Appendix 01 enclosed herewith.

2. Training curriculums and syllabus:

b) According to the promulgated training curriculum, the head of the training institution shall design, appraise and promulgate training syllabuses before providing training. Training syllabus must be continuously reviewed and updated in a scientifically sound manner, satisfying practical demands.

3. Length and mode of training:

a) Minimum length of initial training for occupation health certification is 40 hours, including examination time;

b) Refresher training in occupational health shall be provided every 5 years from the effective date of the certificate of training in occupation health and the refresher training length is at least 50% of the length of initial training, including examination time;

c) Mode of training: Full time.

Article 4. Management of training programs for occupational health certification

1. Every participant in the training course is required to meet the attendance rate prescribed in specified in clause 3 Article 3 of this Circular.

2. The training institution shall refer to the template for certificate of training in occupational health provided in the Appendix 02 to this Circular to issue the certificate to participants passing the examination in accordance with regulations of law on education and training regulations of the training institution.

3. The training institution shall prepare a logbook to record details about occupational health certification using the Appendix 02 to this Circular.

1. The Health Environment Management Agency has the responsibility to:

a) Provide guidelines for organizing and inspecting issuance of certificate of training in occupational health nationwide;

b) Publish information about training institutions on the web portal of the Ministry of Health or its website by relying on reports submitted by Departments of Health of central-affiliated cities and provinces (hereinafter referred to as “Departments of Health”) and training institutions affiliated to ministries and branches;

c) Provide training and refresher training to lecturers providing training in occupational health.

2. Every Department of Health has the responsibility to:

a) Provide training, disseminate, provide guidance on and inspect the implementation of this Circular within its province;

b) Publish information about training institutions under its management on its web portal and submit a report to the Ministry of Health (through the Health Environment Management Agency) within 03 working days from the receipt of information from those training institutions;

c) Submit an annual report on management of training programs for occupational health certification within its province to the Ministry of Health (through the Health Environment Management Agency) before February 01 of the following year using the Appendix 04 to this Circular.

3. Every training institution has the responsibility to:

b) Submit a report on information about training and issuance of certificate of training in occupational health to the Department of Health (for the institution under management of the local authority) or the Health Environment Management Agency (for the institution affiliated to a ministry) before providing initial training for publishing on the web portals of the Ministry of Health, Health Environment Management Agency and Department of Health using the Form No. 01 in the Appendix 05 to this Circular;

c) Formulate a training plan and publish on its web portal or website before organizing a training course and send it to the Department of Health (for the institution under management of the local authority) or the Health Environment Management Agency (for the institution affiliated to a ministry) and Department of Health of the province where the training course is organized to facilitate the management and inspection;

d) Manage documents concerning training and issuance of certificate of training in occupational health in accordance with regulations of law on training and archives;

dd) Formulate regulations on management, inspection and assessment applicable to training courses according to regulations of law on education;

e) Submit an annual consolidated report on results of training programs for occupational health certification to the Department of Health (for the institution under management of the local authority) or the Health Environment Management Agency (for the institution affiliated to a ministry) before January 15 of the following year using the Form No. 02 in the Appendix 05 to this Circular.

Article 6. Implementation and effect

1. This Circular comes into force from February 06, 2022.

2. The Director General of the Health Environment Management Agency, Chief of the Ministry Office, Directors and Directors General of Departments and General Departments affiliated to the Ministry of Health and organizations and individuals concerned are responsible for the implementation of this Circular.

Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Health (through the Health Environment Management Agency) for consideration and resolution./.
