DECISION

PROMULGATING POLICY OF DISSEMINATING THE STATE STATISTICAL INFORMATION

Pursuant to the December 25, 2001 Law on organization of Government;

Pursuant to the Statistics law dated June 26, 2003 and the Government’s Decree No. 40/2004/ND-CP dated February 13, 2004, detailing and guiding implementation of a number of Articles of the Statistics law;  

Pursuant to the June 03, 2008 Law on promulgating the legal documents;

Pursuant to the Prime Minister’s Decision No. 312/QD-TTg dated March 02, 2010, approving the Scheme on the synchronous renewal of statistical indicator systems; 

Pursuant to the Prime Minister’s Decision No. 1803/QD-TTg dated October 18, 2011, approving the Strategy for Vietnam's statistical development in the 2011-2020 period and a vision toward 2030;

At the proposal of the Minister of Planning and Investment;

The Prime Minister promulgates policy of disseminating the state statistical information,

Article 1. Scope of regulation

This policy of disseminating the statistical information regulates activities of disseminating the state statistical information.

Article 2. Subjects of application

1. Statistics organizations, persons doing statistics under the system of State Statistics organizations and other agencies and organizations with functions and tasks of disseminating the State statistical information as prescribed by law;

2. Organizations and individuals using the state statistical information.

Article 3. Interpretation of terms

1. The State statistical information means product of statistical operation conducted by the State statistics organizations, including statistical data and documents analyzing that data.

2. The estimated statistical data mean the statistical data that have calculated before for all results of the economic-social phenomenon or process that are still continuing, and summed up from data of two periods:  (i) Data of the period already happened and updated according to the reality; and (ii) Data of the period going to happen by using specialized methods for estimates.

3. The preliminary statistical data means statistical data reflecting results of the economic-social phenomenon or process happened in a defined period and space; but not yet been confirmed; still have to appraise and complete additionally.

4. The official statistical data means statistical data reflecting sufficiently and exactly results of the economic-social phenomenon or process happened in a defined period and space; the treatment, summing up and appraisal have been finished, data has been affirmed.

5. Product of statistical information means result of statistical operation, including statistical data and documents analyzing that data expressed under documents printed on paper or in form of electronic information.

6. Schedule for disseminating the statistical information means the timetable fixed the dissemination of statistical information that is prepared and announced by the statistics organizations or agencies, organizations disseminating the statistical information, and used as basis for carrying out activities of disseminating the statistical information and helping organizations and individuals using the statistical information for advance information so as to proactively access, exploit and use information.

Article 4. Principles of disseminating the state statistical information

1. The State statistical information announced as prescribed by the Statistics law and other legal documents must be disseminated timely, sufficiently, objectively and transparently.  Strictly prohibiting disseminating the statistical information under list of State secrets and the statistical information in association with specific name or address of organizations or individuals when not yet been agreed for dissemination by those organizations or individuals.

2. The dissemination of State statistical information must be conducted as prescribed by law; have assignment, decentralization in system of State statistics organizations and the tight coordination between the State statistics organizations and relevant agencies and organizations.

3. Ensuring the access, exploitation and use of the disseminated State statistical information in an easy, convenient, equality and effective manner.

4. Being suitable with reality of country, standards and international common practices.

Article 5. Responsibilities for disseminating the state statistical information

1. The statistics organizations under the system of State Statistics organizations and other agencies and organizations with functions and tasks of disseminating the State statistical information are responsible for:

a) Implementing properly and fully the responsibilities for disseminating the state statistical information as prescribed by law. Being responsible for the objectivity and reliability of the statistical information disseminated.   Not disseminating or forcing other agencies or organizations to disseminate the State statistical information which have been falsified and the State statistical information which serve separate benefits of organizations or individuals causing harm to benefits of country, benefits of community or lawful benefits of other organizations or individuals;

b) Disseminating the State statistical information on time as prescribed; publicize and make transparence about information source, definition, collection scope, calculation method, completion level of the information (estimated, preliminary or official), amendments and supplementations (if arising) and other problems relating to the statistical information disseminated;

c) Proactively defining demand and quantity of the State statistical information for dissemination in conformity with groups of users aiming to increase the feasibility of the dissemination and efficiency of using the State statistical information;

d) Completing the system of State statistical information products according to the direction of diversity, synchronization and standardization; in conformity with types of statistical information and users;

dd) simultaneously using forms of information dissemination in order to publicize widely the State statistical information with the aim to facilitate for organizations and individuals to easily access to, exploit and use. 

e) Annually formulating and publicizing the dissemination of state statistical information within their responsibility with all basis information as follows: Content of information and essential products of statistical information going to disseminate; time and form of dissemination; unit in charge of dissemination;

g) Beside of disseminate free of the announced state statistical information, it should carry out some activities of providing for intensive or specialized statistical information in serve of separate demand of users according to mechanism of repaying expenses for handling, summing up, analyzing, printing and other expenses arising additionally with the aim to meet the actual requirements of country and in conformity with international common practices;  

h) Training, guiding organizations and individuals using the state statistical information about content, method of calculating the statistical criteria and skills to search, exploit and use the state statistical information. 

2. The Ministry of Planning and Investment (The General Statistics Office) shall disseminate the following principal state statistical information:

a) Disseminate the statistical information prescribed in the system of national statistical criteria and system of statistical criteria of provincial, district and communal levels;

b) Disseminate the Consumption Price Index (CPI) on 24th day of every month; growth of Gross Domestic Products (GDP), quantity of unemployed persons and the unemployment rate; quantity of underemployed persons and the underemployment rate on a quarter basis according to the estimated data on the 26th day of the end month of quarter and the preliminary data on the 26th of the end month of next quarter; disseminate monthly report of the economy- social status on the 28th of report month. If the timelines for dissemination as mentioned above are coincided with days off as prescribed by State, time of dissemination will be change to the next working day;

c) Disseminate the national statistical yearbook in June of the next year;

d) Disseminate the implementation result of essential criteria of the annual plan on economic – social development according to the estimated data in September of the plan year; the preliminary data in March and the official data in September of the next year;

dd) Disseminate the implementation result of essential criteria of the 5-year plan on the economic – social development, the 10-year Strategic of the economic – social development according to the estimated data in September of the last year of plan or strategic; the preliminary data after 6 months and the official data after 9 months as ending plan, strategic;

e) Disseminate results of investigations, general statistical investigation in program on national statistical investigation and other investigations and general statistical investigations assigned for presiding over according to the plan on investigations, general investigation already approved by competent authorities; time limit for disseminating provisions in plan on investigations, general investigation must be publicized as soon as the plan is approved;

g) Disseminate other economic-social statistical information under its functions and tasks and in the prescribed time.

3. Other Ministries and sectors shall disseminate the principal state statistical information under their specialized sector as follows:

a) The statistical information prescribed in the system of statistical criteria of Ministries, sectors;

b) The periodical, specialized and irregular statistical information under their specialized sector;

c) Results of investigations, general investigation in program on national statistical investigation and other investigations and general statistical investigations that are presided over by them;

d) The implementation results of Strategic, plan on development of sectors, fields, and the national objective programs assigned for presiding over;

e) The specialized statistical yearbook and other state statistical information under specialized sectors within their functions and tasks.

4. People’s Committees of provinces and central-affiliated cities shall disseminate the state statistical information under their management as follows:

a) The statistical information reflects the monthly local economic-social status;

b) Results of investigations and general statistical investigations that are presided over by their localities;

c) The implementation results of Strategic, plan on economic-social development and the national objective programs in their localities;

d) The specialized, irregular statistical information and other economic-social statistical information in localities under their functions and tasks.

Article 6. Rights and duties of organizations and individuals using the state statistical information

1. Organizations and individuals using the state statistical information have rights:

a) To access, exploit and use free for state statistical information announced by competent agencies, organizations or individuals; concurrently have right to request the statistics organizations under the system of state statistics organizations for supplying the intensive, specialized statistical information in serve of separate demand according to the mechanism of repaying expenses of handling, summing up, analyzing, printing and other expenses arising additionally;

b) To request the State statistics organizations and agencies, organizations disseminating the State statistical information for publicizing the list of products and schedule of disseminating the state statistical information approved by competent authorities; performing transparence about information source, definition, collection scope, calculation method, completion level of the information, amendments and other problems relating to the statistical information disseminated;

2. Organizations and individuals using the state statistical information have duties:

a) To reflect demand about the state statistical information with the state statistics organizations and other organizations, individuals having function, task of disseminating the state statistical information; and proactively propose solutions and coordinate in organizing implementation;

b) To protect the truthfulness, objectivity and legality of the state statistical information.  When quoting and using, they must clearly state source of information. They are not permitted to use the State statistical information in cases causing harm to benefits of country, benefits of community or lawful benefits of other agencies, organizations or individuals;

c) Studying, updating the statistical knowledge and skills of searching and exploiting the state statistical information so as to hold the initiative in collecting information and improving the efficiency of using the state statistical information.

Article 7. Organization of implementation

1. The Ministry of Planning and Investment shall:

a) Be focal agencies in organizing implementation of the policy on disseminating the state statistical information and uniformly direct the professional operation for all activities of disseminating the state statistical information of the system of concentrated statistics organizations; statistical operation of Ministries, sections and localities.  Formulate and promulgate documents guiding plan on implementing policy; and regularly urge, supervise the implementation. Periodically sum up the implementation results and report to the Prime Minister;

b) Organize and manage operation of disseminating the state statistical information of the system of concentrated statistics organizations according to contents prescribed in Clause 1 and Clause 2, Article 5. Formulate and promulgate the Regulation and system of solutions to carry out operation of disseminating the state statistical information applied to system of concentrated statistics organizations. Annually assess the implementation results in order to learn from experiences timely, and use for summing up in the implementation results of other ministries and sectors and the implementation results of provinces and central-affiliated cities;

c) Assume the prime responsibility for, and coordinate with the Ministry of Finance and other Ministries and sectors in formulating, promulgating Regulation on supplying the intensive, specialized statistical information in serve of separate demand of organizations and individuals according to mechanism of repaying expenses for handling, summing up, analyzing, printing and other expenses arising additionally prescribed in point g, Clause 1, Article 5;

d) Proactively coordinate with functional units of the Supreme People’s Court and the Supreme People’s Procuracy in consolidating the duty of disseminating the Court's and Procuracy's statistical information as prescribed by the Statistics law and unify with this policy about disseminating statistical information.

e) To perform functions, tasks and authorities of national coordination agency in carrying out the general data dissemination system (GDDS) of the International Currency Fund; conduct the activities of disseminating, exchanging the economic-social statistical information between Vietnam and other countries, territory areas and international organizations under its functions and tasks.

2. Other Ministries and sectors shall:

a) Organize and manage operation of disseminating the state statistical information within scope of sectors, fields managed by them according to contents prescribed in Clause 1 and Clause 3, Article 5. Formulate and promulgate the Regulation and system of solutions to disseminating the state statistical information for unified application in sectors, fields. Annually assess the implementation results to learn from experiences timely and send to the Ministry of Planning and Investment (The General Statistics Office) for general summing;

b) Apart from responsibilities prescribed in point a mentioned above, the Ministry of Information and Communication and the Ministry of Finance still have the following responsibilities:

The Ministry of Information and Communication shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment (The General Statistics Office), statistics agencies of Ministries, sectors and localities and agencies of mass media at central and local level in formulating the regular programs on disseminating the state statistical information on mass media for unified and synchronous implementation.

The Ministry of Finance shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment, other Ministries and sectors, and People’s Committees of provinces and central-affiliated cities, in annually allocating funding from state budget for implementation of policy about disseminating the state statistical information; and coordinate with the Ministry of Planning and Investment (The General Statistics Office) and relevant agencies in formulating, promulgating Regulation on supplying the intensive, specialized statistical information serving for separate demand of organizations and individuals according to mechanism of repaying expenses for handling, summing up, analyzing, printing and other expenses arising additionally as prescribed in point g, Clause 1, Article 5.

3. People’s Committees of provinces and central-affiliated cities shall:

a) Organize and manage operation of disseminating the state statistical information of the provincial Departments, sectors, the district People’s Committee and other agencies and units under their management according to contents prescribed in Clause 1 and Clause 4, Article 5. Formulate and promulgate the Regulation and system of solutions to disseminate the state statistical information for unified application in agencies and units in localities under their management. Annually assess the implementation results to learn from experiences timely and send to the Ministry of Planning and Investment (The General Statistics Office) for general summing;

b) Direct agencies and units under their management in coordinating and facilitating for the statistics organizations under the system of concentrated statistics organizations and other central agencies in localities in carrying out activities of disseminating the state statistical information under Regulations promulgated by Ministries and sectors at central level.

Article 8. This Decision takes effect on August 01, 2013.

Article 9. The Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, chairpersons of People’s Committees of provinces and central-affiliated cities, heads of relevant agencies and units, and organizations and individuals using the state statistical information shall implement this Decision.
