Quyết định số 329/QĐ-NHNN được ban hành ngày 11 tháng 02 năm 2010 bởi Ngân hàng Nhà nước Việt Nam về việc đính chính văn bản quy phạm pháp luật nhằm sửa đổi, hiệu chỉnh các sai sót kỹ thuật trong văn bản đã ban hành trước đó.
Phạm vi và đối tượng áp dụng
Quyết định này áp dụng đối với các đơn vị thuộc Ngân hàng Nhà nước Việt Nam, các tổ chức tín dụng, chi nhánh ngân hàng nước ngoài hoạt động tại Việt Nam, cùng các cơ quan, tổ chức và cá nhân có liên quan chịu sự điều chỉnh của văn bản quy phạm pháp luật được đính chính.
Nội dung cốt lõi của Quyết định số 329/QĐ-NHNN
- Đính chính sai sót kỹ thuật trình bày: Thực hiện việc sửa đổi, hiệu chỉnh các lỗi về mặt kỹ thuật soạn thảo, lỗi chính tả, từ ngữ hoặc số liệu chưa chính xác trong văn bản quy phạm pháp luật gốc do Ngân hàng Nhà nước Việt Nam ban hành, đảm bảo nội dung văn bản được hiểu và áp dụng một cách thống nhất.
- Bảo đảm tính chính xác của quy phạm pháp luật: Việc đính chính giúp làm rõ nghĩa các quy định, tránh các cách hiểu khác nhau hoặc áp dụng sai lệch trong thực tiễn hoạt động ngân hàng, tiền tệ và thanh toán.
- Trách nhiệm tổ chức thực hiện: Các đơn vị chức năng thuộc Ngân hàng Nhà nước Việt Nam, Giám đốc Ngân hàng Nhà nước chi nhánh tỉnh, thành phố trực thuộc Trung ương, và người đứng đầu các tổ chức tín dụng có trách nhiệm cập nhật, phổ biến và triển khai thực hiện đúng theo nội dung đã được đính chính.
Hiệu lực thi hành
Quyết định số 329/QĐ-NHNN có hiệu lực thi hành kể từ ngày ký (ngày 11 tháng 02 năm 2010). Các nội dung đính chính tại quyết định này là một bộ phận hợp thành không thể tách rời của văn bản quy phạm pháp luật được đính chính.

DECISION
ON THE CORRECTION OF LEGAL DOCUMENT
- Pursuant to the Law on State Bank of Vietnam in 1997; the Law on amendment, supplement of several Articles of the Law on State Bank of Vietnam in 2003;
- Pursuant to the Decree No. 96/2008/ND-CP dated 26 August 2008 of the Government providing for functions, duties, authorities and organizational structure of the State Bank of Vietnam;
- Pursuant to the Decision No. 22/2007/QD-NHNN dated 28 May 2007 of the Governor of the State Bank on the issuance of the Regulation on archives;
- Pursuant to the Decision No. 497/QD-TTg dated 17 April 2009 of the Prime Minister on giving interest rate support to the procurement of machine, equipment, materials to serve agricultural production and materials for building dwelling house in rural areas;
- Pursuant to the Decision No. 2213/QD-TTg dated 31 December 2009 of the Prime Minister on the amendment of, supplement to several Articles of the Decision No. 497/QD-TTg dated 17 April 2009 of the Prime Minister on giving interest rate support to the procurement of machine, equipment, materials to serve agricultural production and materials for building dwelling house in rural areas;
- Pursuant to the Circular No. 02/TT-NHNN dated 22 January 2010 of the Governor of the Stater Bank providing in details for the implementation of giving interest rate support to organizations, individuals borrowing from banks in 2010 for procurement of machine, equipment, materials to serve agricultural production and materials for building dwelling houses in rural areas
Upon the proposal of the Director of Monetary Policy Department,
DECIDES:
Article 1. The State Bank of Vietnam would like to make correction of point a, paragraph 3, Article 2 of the Circular No. 02/2010/TT-NHNN dated 22 January 2010 of the Governor of the State Bank providing in details for the implementation of giving interest rate support to organizations, individuals borrowing from banks in 2010 for procurement of machine, equipment, materials to serve agricultural production and materials for building dwelling houses in rural areas as follows:
“a. For loans to procure machine, mechanical equipment, facilities to serve agricultural production, processing and personal computer: 24 months at the maximum; interest rate support shall be given from 01 January 2010 to 31 December 2012.”
Article 2. Organization of implementation
1. This Decision shall be effective from the date of signing.
