DECISION

PROMULGATING THE LIST OF SCRAPS PERMITTED TO BE IMPORTED FOR USE AS RAW MATERIALS FOR PRODUCTION

THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT

Pursuant to the November 29, 2005 Law on Environmental Protection;
Pursuant to the Government's Decree No. 91/2002/ND-CP of November 11, 2002, defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to the Government's Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding international goods sale and purchase and goods sale and purchase agency, processing and transit with foreign countries;
Pursuant to the Government's Decree No. 80/2006/ND-CP of August 9, 2006, detailing and guiding the implementation of a number of articles of the Law on Environmental Protection;
At the proposal of the directors of the Environmental Protection Department and the Legal Department,

DECIDES:

Article 1.- To promulgate together with this Decision the List of scraps permitted to be imported for use as raw materials for production.

Article 2.- The importation of scraps shall comply with the provisions of Articles 42 and 43 of the Law on Environmental Protection and relevant legal provisions.

Article 3.- This Decision shall take effect 15 days after its publication in "CONG BAO" and replace the Natural Resources and Environment Minister's Decision No. 03/2004/QD-BTNMT of April 2, 2004, promulgating the Regulation on environmental protection applicable to scraps imported for use as raw materials for production.

Iron or steel waste and scrap

a. Iron or steel bar sections, pipe sections, nodes, tips, shavings, strings and pieces discharged from the production process; b. Used steel rails, steel sleepers, steel plates, steel rods, steel shapes, steel pipes, cast bars, and steel wires or nets; c. Iron, pig iron or steel recovered from construction works, means of transport, machines, equipment and other  products which are cut, disassembled or dismantled in countries or territories of exportation; d. Hulls and shells of  used seagoing ships (including barges) from which oil,  grease, rubber, asbestos and other non-mental components  have been removed in countries or territories of exportation; 

e. Scraps in bulk or pressed into blocks or cakes.

b. Salvaged materials, including:

- Copper, copper alloy, nickel, nickel alloy, aluminum, aluminum alloy, zinc and zinc alloy recovered from construction works, means of transport, machines, equipment and other products which have been cut or disassembled in countries or territories of exportation;

- Copper or aluminum cores of electric wires and cables, which have been stripped off their insulating coats of plastic, rubber or other insulating materials;

- Electromagnetic wires (copper wires coated with insulated enamel paints, cotton fibers or paper).

c. Scraps in bulk or pressed into blocks or cakes.

Plastic waste, parings and scrap

a. Plastic in block, clot, rod, pipe, plate, fiber and piece, which are discharged from the production process, unused;

b. Plastic packings of mineral water or purified water, used (plastic packings of other beverages shall comply with Section c below);

c. PE (Polyethylene), PET (Poly Ethylene Terephtalate), PS (Poly Styrene), PC (Poly Carbonate) or PP (Popy Propylene) scraps of PE, PET, PS, PC or PP products(each piece of scrap having dimensions not exceeding 5 cm) which have been treated up to environmental protection requirements.
