DECISION

APPROVING SUPPORT PROGRAM FOR PERSONS WITH DISABILITIES IN 2021 - 2030

PRIME MINISTER

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Law on Persons with Disabilities dated June 17, 2010;

Pursuant to Resolution No. 84/2014/QH13 dated November 28, 2014 of the National Assembly on United Nation’s Convention on Rights of Persons with Disabilities;

Pursuant to Official Dispatch No. 39-CT/TW dated November 1, 2019 of Secretariat of the 12th Central Communist Party on increasing leadership of the Communist Party in affairs related to persons with disabilities;

At request of Minister of Labor – War Invalids and Social Affairs.

Article 1. Approve Support Program for persons with disabilities in 2021 – 2030 as follows:

I. OBJECTIVES

1. General objectives

Promote implementation of UN’s Convention on Rights of Persons with Disabilities and Law on Persons with Disabilities to improve life quality of persons with disabilities; enable persons with disabilities to participate in social activities equally; develop an unrestricted environment in order to protect legal rights of persons with disabilities and assist persons with disabilities in utilizing their potentials.

2. Specific objectives:

a) During 2021 - 2025

- Every year, approximately 80% of persons with disabilities gain access to medical services in any shape or form; 70% of infants up to 6 years of age are subject to screening for early detection of congenital disabilities, growth dysfunction, and early intervention for all forms of disabilities; approximately 50,000 children and persons with disabilities receive orthopedic surgeries, intensive care, and appropriate assisting instrument.

- 80% of children with disabilities in preschool age and formal education age gain access to education.

- 200,000 persons with disabilities who require and are eligible shall receive vocational training; create jobs and finance equipment and infrastructure for 6 specialized education institutions to provide vocational training for persons with disabilities in 6 regions nationwide and vocational training facilities for persons with disabilities; 90% of persons with disabilities who require and are eligible can take loans with preferential interest rate as per the law.

- 30% of persons with disabilities who require to participate in traffic can operate vehicles satisfactory to technical regulations or access similar auxiliary services; 100% of persons with disabilities participating in traffic shall receive ticket discount and a discount of 40% for interprovincial roads.

- 1/4 of total number of persons with disabilities gain access and use information technology and communication services.

- 50% of provinces and cities having sports club accessible for persons with disabilities and attracting 10% of persons with disabilities for sports activities; 10% of persons with disabilities receive support in participating in cultural, artistic activities and art performances; 90% of public libraries of provinces organize reading spaces and guarantees utility of specialized libraries.

- 80% of persons with disabilities facing financial hardships gain access to free legal services according to regulations and law on legal assistance if needed.

- 60% of officials working in assisting persons with disabilities receive training and improvement of management, care, and assistance capacities; 30% of families having persons with disabilities receive training for intensive care methods and solutions for persons with disabilities;  20% of persons with disabilities receiving training for soft skills.

- 80% of women with disabilities receive support in many forms.

- 70% of provinces and cities house organizations for persons with disabilities.

b) During 2026 - 2030

- Every year, approximately 90% of persons with disabilities gain access to medical services in any shape or form; 80% of infants up to 6 years of age are subject to screening for early detection of congenital disabilities, growth dysfunction, and early intervention for all forms of disabilities; approximately 70,000 children and persons with disabilities receive orthopedic surgeries, intensive care, and appropriate assisting instrument.

- 300,000 persons with disabilities who require and are eligible shall receive vocational training; create jobs and finance equipment and infrastructure for 6 specialized education institutions to provide vocational training for persons with disabilities in 6 regions nationwide and vocational training facilities for persons with disabilities; 100% of persons with disabilities who require and are eligible can take loans with preferential interest rate as per the law.

- 100% of new structures and 50% of old structures that are working offices of regulatory authorities; railway stations, coach stations, ferry stations; medical examination and treatment establishments; education institutions, vocation education institutions, cultural structures, sports structures; new apartment buildings are accessible for persons with disabilities.

- 50% of persons with disabilities who require to participate in traffic can operate vehicles satisfactory to technical regulations or access similar auxiliary services; 100% of persons with disabilities participating in traffic shall receive ticket discount and a discount of 60% for interprovincial roads.

- 1/3 of total number of persons with disabilities gain access and use information technology and communication services.

- 70% of provinces and cities having sports club accessible for persons with disabilities and attracting 15% of persons with disabilities for sports activities; 20% of persons with disabilities receive support in participating in cultural, artistic activities and art performances; 100% of public libraries of provinces organize reading spaces and guarantees utility of specialized libraries.

- 100% of persons with disabilities facing financial hardships gain access to free legal services according to regulations and law on legal assistance if needed.

- 70% of officials working in assisting persons with disabilities receive training and improvement of management, care, and assistance capacities; 40% of families having persons with disabilities receive training for intensive care methods and solutions for persons with disabilities;  30% of persons with disabilities receiving training for soft skills.

1. Medical support:

a) Finalize regulations and law on disability assessment, intensive care, and health insurance policies for persons with disabilities;

b) Provide early detection services for any impairments in preborn children and infants, publicize, consult, and provide reproductive healthcare services;

c) Develop service network of early detection, early intervention of disabilities, intensive care and orthopedic surgeries, and provide assisting instrument for persons with disabilities;

d) Implement community-based rehabilitation programs.

2. Education support:

a) Continue to finalize policies on education for persons with disabilities, guarantee universalization of lower secondary education for persons with disabilities, and promote implementation of incentives policies for teachers and employees educating children with disabilities; conduct research, develop standards and criteria for facilities providing intervention and education for children with disabilities;

b) Conduct research and develop programs, textbooks, and education materials for children with disabilities in preschool age and formal education age to meet demands of persons with disabilities;

c) Integrate inclusive education in teacher training programs in higher education institutions and colleges providing pedagogy major;

dd) Develop effective service system and education models for persons with disabilities from central to local governments suitable with demands of persons with disabilities and persons with disabilities receiving education; enable early detection, early intervention, semi-inclusive education, inclusive education, separate education, education for persons with disabilities in homes and community, remote education;

e) Review, update, and manage data regarding special education demands of persons with disabilities in management software for education support system for persons with disabilities.

3. Vocational education support, job creation and livelihood support:

a) Review and complete documents guiding organization for vocational training and job creation for persons with disabilities; list and assess vocational training facilities for persons with disabilities and their demand for vocational education;

b) Develop plans and organize vocational training for persons with disabilities flexible with time, location, and training progress depending on occupation, form of training via vocational training facilities, enterprises or organizations of persons with disabilities; manufacturing, business, and service facilities employing persons with disabilities or belonging to persons with disabilities;

c) Multiply livelihood support models for persons with disabilities; develop support models for persons with disabilities who start up; vocational training models together with job solutions for persons with disabilities; cooperative models including persons with disabilities in product value chains;

d) Prioritize young people with disabilities, women with disabilities, persons with disabilities and enterprises, business facilities employing workers that are persons with disabilities to receive concessional loans to create jobs and expand jobs.

4. Disease prevention and natural disaster remediation;

a) Develop documents and organize training to improve capacity of officials working to support persons with disabilities, working in affairs related to persons with disabilities and organizations of persons with disabilities in disease prevention and natural disaster remediation;

c) Apply technology, specialized equipment to enable persons with disabilities to receive early warnings regarding diseases and natural disasters.

5. Construction access support:

a) Promote measures for implementing National Technical Regulations on allowing persons with disabilities to access constructions in appraisal, assessment, inspection, and examination in construction;

b) Review, add, and revise systems of technical standards, regulations on constructions allowing persons with disabilities to access public structures and apartment buildings; develop standard guidelines to allow persons with disabilities to access current structures;

c) Research policies, promote solutions and manufacture products to allow access to structures; develop illustrations, guidelines and teaching materials regarding designs allowing access to structures in educating, training and raising community’s awareness.

6. Access support and traffic participation support:

a) Conduct research, develop, and issue general traffic access criteria for traffic system;

b) Conduct research, compile, and issue Manual on accessible traffic structures for traffic systems to guide local administrative divisions to apply in development of traffic system; 

c) Enhance guidance, inspection and supervision capacities regarding implementation of regulations on accessible traffic to enable persons with disabilities to access and use;

dd) Survey and assess access assurance of public transport systems and traffic demand of persons with disabilities serving development of accessible traffic strategies until 2030 and orientation to 2050.

7. Access support and information technology, communication support:

a) Develop and issue national technical standards, national technical regulations on assisting persons with disabilities in accessing information technology and communication;

b) Maintain, develop, and upgrade website/web portal assisting persons with disabilities;

c) Develop tools, produce documents to train persons with disabilities to access, and use information technology and communication; develop online education and training systems, solutions for persons with disabilities including formal education of all levels and vocational education;

d) Conduct research to develop technology assisting persons with disabilities in accessing information technology and communication; conduct research to develop technology assisting persons with disabilities to integrate with the community and improve life quality of persons with disabilities.

8. Legal support:

a) Increase legal support in communes, wards, townlets where many persons with disabilities facing financial hardships reside and seek legal support, in associations for persons with disabilities, social protection facilities, education institutions, business facilities and other facilities of persons with disabilities when necessary and suitable with conditions of local administrative divisions;

b) Organize training, improve knowledge, and enhance capacity for individuals providing legal support when providing legal support for persons with disabilities facing financial hardships;

9. Support for persons with disabilities in cultural, sports and tourism activities:

a) Guide provinces and cities in establishing and forming sports clubs for persons with disabilities;

b) Complete and develop 15 sports for persons with disabilities to train and compete;

c) Guide provinces and cities to direct local libraries to form friendly reading environment, diversify information services and products, and implement conditions to assist persons with disabilities;

d) Increase application of technology to enable persons with disabilities to acknowledge information on tourist attractions, restaurants, hotels, vehicles and level of access to these locations for persons with disabilities;

dd) Develop standards for persons with disabilities participating in domestic and overseas sports competitions; provide referee training, coach training, training for disability classification medical professional, and training for competition participants; artistic creation, music, poetry training; provide professional training for specialized guides regarding skills and methods of assisting persons with disabilities during tours.

10. Support for pregnant women:

a) Publicize, educate, and raise awareness of individuals of all levels, all ministries and the community regarding implementing social security policies for oppressed women; organize activities for sharing experience and connecting women with available services to support oppressed women in accessing social security;

b) Improve capacity of officials providing support for oppressed women;

11. Support for persons with disabilities to live independently and integrate with the community:

a) Mobilize resources to upgrade manufacturing facilities in order to provide equipment and aids for persons with disabilities;

b) Support persons with disabilities: wheelchairs, walking frames, hearing aids, prosthetic limbs, and necessary equipment;

c) Develop documents and organize training to detect, screen, advise on using, preserving aids for persons with disabilities for officials assisting persons with disabilities, families and persons with disabilities;

d) Develop and extend model “white staff” which is a smart guidance system for visual impaired individuals; independent living model and community integrated living model.

12. Enhancement of awareness, and capacity for caring, assisting persons with disabilities and supervising for assessment:

a) Organize publicizing regulations and law on persons with disabilities and policies, programs assisting persons with disabilities;

b) Develop education and training programs for care and support for persons with disabilities;

c) Train officials, employees and partners to assist persons with disabilities;

dd) Conduct research regarding experience in assisting persons with disabilities of other countries;

e) Improve statistical report capacity, integrate or organize investigation and survey specialized in persons with disabilities; develop software for registering and managing information on persons with disabilities;

g) Examine, assess implementation of programs, policies, regulations, and law on persons with disabilities.

III. IMPLEMENTATION SOLUTIONS

1. Review, conduct research to amend Law on Persons with Disabilities, relevant Laws, and issue legislative documents assisting persons with disabilities in healthcare, education, vocational education, job creation, culture, sports, recreation, tourism, accessing public structures, traffic structures, legal support, information technology, and communication.  

2. Promote private sector involvement in assisting persons with disabilities, mobilize organizations, individuals, and community to support persons with disabilities.

3. Integrate criteria relating to persons with disabilities in databases of ministries.

4. Promote roles and responsibilities of People’s Committees of all levels and responsibilities of heads of agencies and organizations in assisting persons with disabilities.

5. Increase international cooperation to utilize technical support, experience and resources to assist persons with disabilities.

1. Expenditure on Program implementation includes:

b) State budget allocated from annual recurrent expenditure budget of ministries, central governments and local governments; national target programs, other programs and schemes for implementation of the Program according to decentralization of regulations and law on state budget;

b) Contributions and donations of domestic and overseas enterprises, organizations, and individuals.

2. Ministries and local governments shall prepare annual budget estimates to implement the Program, manage, and use expenditure as per the laws on state budget.

V. RESPONSIBILITIES

1. Ministry of Labor – War Invalids and Social Affairs shall act as presiding authority to implement the Program, is responsible for cooperating with relevant ministries in developing plans for implementing the Program; conduct research to assess implementation of policies, regulations and law on persons with disabilities; organize implementation of vocational education, job creation, expand livelihood models, develop start-up assistance model for persons with disabilities; vocational training linking with job solution model for persons with disabilities; support to enable persons with disabilities to live independently and improve awareness, capacity in caring persons with disabilities and supervising for assessment; consolidation of Program implementation and results in reports submitted to Prime Minister; organizing preliminary conclusion of the Program in 2025 and final conclusion at the end of 2030.

2. Ministry of Planning and Investment shall take charge and cooperate with relevant ministries in mobilizing official development assistance (ODA) for programs and projects assisting persons with disabilities.

3. Ministry of Finance shall allocate funding for implementation of Development program according to regulations and law on state budget.

4. Ministry of Health shall organize medical support and cooperate with Ministry of Labor – War Invalids and Social Affairs in implementing community-based rehabilitation and providing aids for persons with disabilities.

6. Ministry of Agriculture and Rural Development shall take charge and cooperate with Ministry of Labor - War Invalids and Social Affairs in implementing epidemic prevention and natural disaster remediation.

7. Ministry of Construction shall organize activities to assist persons with disabilities in accessing and using constructions.

8. Ministry of Transport shall organize activities to enable persons with disabilities to access and participate in traffic.

9. Ministry of Information and Communications shall organize activities to enable persons with disabilities to access and utilize information technology, and communication.

10. Ministry of Justice shall organize legal support activities.

11. Ministry of Culture, Sports and Tourism shall organize activities to assist persons with disabilities in cultural, sports and tourism activities.

12. Vietnam Bank for Social Policy shall organize activities to promote young people with disabilities to start-up, and enable women with disabilities, persons with disabilities and enterprises, manufacturing facilities employing workers with disabilities to take loans with preferential interest rate as per the law.

13. People’s Committees of provinces or central-affiliated cities shall organize implementation of the Program in their local administrative divisions; develop and organize implementation of annual programs for assisting the persons with disabilities; actively allocate budget, personnel, and integrate expenditure of relevant programs and schemes in local administrative divisions to guarantee completion of tasks and objectives of the Program.

14. Request Central Committee of the Vietnam Fatherland Front, Vietnam General Confederation of Labor, Central Vietnam Women's Union, Central Ho Chi Minh Communist Youth Union, Vietnam Chamber of Commerce and Industry, Vietnam Cooperative Alliance, Vietnam Red Cross Society, Vietnamese Associations for Persons with Disabilities, Association in Support of Vietnamese Handicapped and Orphans, Vietnamese Association for Victims of Agent Orange, Vietnam Relief Association for Children within their tasks and functions shall participate in implementing the Program.

Article 3. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities are responsible for implementation of this Decision./.
