V/v thực hiện quy định pháp luật về kinh doanh xổ số của Công ty Xổ số kiến thiết

1. Theo quy định tại Luật đầu tư, Nghị định số 30/2007/NĐ-CP ngày 01/3/2007 của Chính phủ về kinh doanh xổ số và các văn bản sửa đổi, bổ sung (Nghị định số 30/2007/NĐ-CP), kinh doanh xổ số là ngành, nghề đầu tư kinh doanh có điều kiện, chịu sự kiểm soát chặt chẽ của cơ quan quản lý nhà nước có thẩm quyền nhằm đảm bảo hoạt động kinh doanh tuân thủ đúng quy định của pháp luật, đảm bảo an ninh, trật tự và an toàn xã hội.

Thời gian vừa qua mặc dù bị ảnh hưởng do dịch Covid-19, nhưng với sự chỉ đạo quyết liệt của Chính phủ, Thủ tướng Chính phủ, Ủy ban nhân dân (UBND) các tỉnh, thành phố trực thuộc trung ương và sự cố gắng, nỗ lực của từng Công ty TNHH Một thành viên xổ số kiến thiết (XSKT) nên hoạt động kinh doanh xổ số từng bước phục hồi, tạo công ăn, việc làm cho người lao động và có đóng góp lớn cho ngân sách nhà nước.

2. Trên cơ sở tổng hợp kết quả kiểm tra, giám sát hoạt động kinh doanh xổ số và triển khai thực hiện Chỉ thị số 16/CT-TTg ngày 27/5/2023 của Thủ tướng Chính phủ về tăng cường phòng ngừa, đấu tranh tội phạm vi phạm pháp luật liên quan đến hoạt động tổ chức đánh bạc và đánh bạc, Bộ Tài chính đề nghị UBND các tỉnh, thành phố quan tâm chỉ đạo các cơ quan chức năng tại địa phương triển khai thực hiện một số công việc sau:

2.1. Về phân phối vé xổ số

- Theo quy định của pháp luật về kinh doanh xổ số- Thời gian gần đây, một số tổ chức dã triển khai các trang web, ứng dụng phân phối/mua hộ vé xổ số (có thu phí của khách hàng) để cung cấp các sản phẩm xổ số nước ngoài tại Việt Nam và các sản phẩm xổ số truyền thống của Việt Nam qua các trang web, ứng dụng phân phối. Việc mua hộ vé xổ số có thu phí dịch vụ nêu trên đã vi phạm quy định của pháp luật xổ số về phương thức phân phối vé xổ số; tiềm ẩn rủi ro lợi dụng kinh doanh lô đề một cách hợp pháp, tiềm ẩn tổ chức đánh bạc, gây ảnh hưởng đến trật tự, xã hội, ảnh hưởng đến thị trường xổ số truyền thống. Bộ Tài chính đã có Công văn số 2737/BTC-TCNH ngày 24/3/2022 gửi UBND tỉnh, thành phố đề nghị chỉ đạo các đơn vị liên quan tăng cường kiểm tra, giám sát để phát hiện và xử lý các sai phạm theo đúng quy định của pháp luật.

2.2. Về tổ chức bộ máy tại doanh nghiệp

- Theo quy định của pháp luật về doanh nghiệp và pháp luật về kinh doanh xổ số, doanh nghiệp kinh doanh xổ số hoạt động theo mô hình công ty TNHH Một thành viên do Nhà nước sở hữu 100% vốn. Căn cứ quy mô của doanh nghiệp, cơ quan đại diện chủ sở hữu quyết định thành lập Ban kiểm soát/Kiểm soát viên đáp ứng tiêu chuẩn và điều kiện theo quy định của pháp luật.

- Qua quản lý, giám sát từ xa, một số công ty XSKT không có kiểm soát viên là vi phạm quy định của pháp luật. Do đó, đề nghị UBND các tỉnh, thành phố trực thuộc trung ương rà soát, kiện toàn lại cơ cấu tổ chức bộ máy, bổ nhiệm Kiểm soát viên tại Công ty XSKT đảm bảo tuân thủ quy định của pháp luật.

2.3. Về ban hành Điều lệ hoạt động của Công ty

- Theo quy định của pháp luật về doanh nghiệp và pháp luật về kinh doanh xổ số, cơ quan đại diện chủ sở hữu ban hành Điều lệ hoạt động của doanh nghiệp kinh doanh xổ số, bao gồm các bản sửa đổi, bổ sung, thay thế (nếu có).

- Qua kiểm tra tại doanh nghiệp, UBND các tỉnh, thành phố trực thuộc trung ương có ban hành Điều lệ tổ chức hoạt động đối với Công ty XSKT, tuy nhiên chưa cập nhật, bổ sung đầy đủ các nội dung sửa đổi, bổ sung trong quá trình hoạt động của doanh nghiệp. Do vậy, đề nghị UBND các tỉnh, thành phố trực thuộc trung ương chỉ đạo thực hiện rà soát, ban hành Điều lệ tổ chức hoạt động đối với Công ty XSKT phù hợp với quy định của pháp luật.

2.4. Về đại lý và bảo đảm nghĩa vụ thanh toán

- Pháp luật về kinh doanh xổ số quy định cụ thể về điều kiện để làm đại lý xổ số và các biện pháp áp dụng để bảo đảm thực hiện nghĩa vụ thanh toán của các đại lý xổ số. Hợp đồng đại lý ký kết giữa doanh nghiệp kinh doanh xổ số và đại lý xổ số phải đầy đủ các nội dung theo quy định của pháp luật.

- Qua công tác kiểm tra tại doanh nghiệp và quản lý, giám sát từ xa thông qua báo cáo tài chính kiểm toán, có trường hợp Hợp đồng đại lý ký kết không đầy đủ nội dung theo quy định; doanh nghiệp cho đại lý nợ quá thời hạn thanh toán tiền bán vé số theo quy định. Do vậy, đề nghị UBND tỉnh, thành phố yêu cầu Công ty xổ số thực hiện rà soát ký Hợp đồng với đại lý xổ số có đủ điều kiện làm đại lý xổ số, Hợp đồng đại lý phải bảo đảm đầy đủ nội dung theo quy định; nghiêm cấm Công ty xổ số cho đại lý nợ quá thời hạn thanh toán tiền bán vé xổ số và đại lý không bảo đảm tỷ lệ thanh toán tiền bán vé xổ số đối với Công ty xổ số theo quy định pháp luật.

3. Đề nghị UBND các tỉnh, thành phố trực thuộc trung ương chỉ đạo Sở Tài chính và các cơ quan chức năng có liên quan tăng cường công tác kiểm tra, giám sát hoạt động kinh doanh của Công ty XSKT nhằm kịp thời phát hiện và có biện pháp chấn chỉnh, xử lý các hành vi sai phạm trong hoạt động kinh doanh của Công ty (nếu có) và gửi kết quả kiểm tra, giám sát về Bộ Tài chính để theo dõi, quản lý.

Đề nghị UBND các tỉnh, thành phố quan tâm chỉ đạo thực hiện./.
