RESOLUTION
FIRST SESSION OF XVTH NATIONAL ASSEMBLY
NATIONAL ASSEMBLY
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on National Assembly Organization No. 57/2014/QH13 in which several Articles are amended and supplemented by the Law No. 65/2020/QH14;
Pursuant to the results of the first meeting session taking place from 20th to 28th January, 2021;
Upon the request of the National Assembly’s Standing Committee and opinions of the National Assembly’s delegates,
HEREIN RESOLVES

1.1. Considering the following reports: the General Review Report on the election of delegates to the XVth National Assembly and People's Councils at all levels for the 2021-2026 period, including confirmation of the status of delegates to the XVth National Assembly; the Synthesis Report on opinions and petitions of voters and the People submitted to the first session of the XVth National Assembly; the Performance Evaluation Report on implementation of the plan on socio-economic development plan, state budget revenues and expenditures in the first six months, and actions or measures to be taken to implement the plan on socio-economic development and state budget revenues and expenditures in 2021’s last six months; the Compliance Report on thrift and anti-extravagance practices in 2020.
1.2. Issuing the following personnel decisions during the tenure of office of the XVth National Assembly: Decision on the membership of the National Assembly’s Standing Committee, the machinery and the number of the Cabinet members; Decisions to elect the President, the Chairman of the National Assembly, the Prime Minister, the Vice President of Vietnam, the Vice Chairperson of the National Assembly, the member of the Standing Committee of the National Assembly, the Chief Justice of the Supreme People's Court, the Chief Procurator of the Supreme People's Procuracy, the Secretary General of the National Assembly, the Chairman of the Council of Ethnic Minorities, the Chairpersons of the Committees of the National Assembly, the State Auditor General; Decisions to accept the proposals for appointment of the Deputy Prime Ministers, Ministers and other Cabinet members, Judges of the Supreme People's Court; Decision to approve the list of Vice Presidents and members of the National Defense and Security Council.
1.3. Ratifying Resolutions on the five-year plan for the 2021-2025 period on: socio-economic development, national finance and borrowing, public debt repayment, medium-term public investment; assenting to the final accounts of the 2019 state budget; two national target programs on new rural construction and sustainable poverty reduction in the 2021-2025 period; law and ordinance formulation program in 2022, adjustment of law and ordinance development program in 2021; supervisory program of the National Assembly in 2022; establishing the Thematic Supervision Team and passing the Resolution of the first session of the XVth National Assembly.
2. The National Assembly affirms that, in the complicated developments of COVID-19 and under the leadership of the Central Committee, the Politburo, the Secretariat, the General Secretary, the President of Vietnam, the National Assembly, the Chairman of the National Assembly, the Government, the Prime Minister, the Vietnam Fatherland Front, provincial Party committees, local authorities, the entirety of the military, the people and businesses have conquered and overcome all difficulties and challenges with great effort and by full consent and agreement in implementing a lot of COVID-19 control and management policies and measures in a drastic, consistent, creative and flexible manner, realizing the dual goals of both protecting the people's health and maintaining socio-economic development, fulfilling socio-economic development and state budget requirements set out by the Resolutions of the Party and the National Assembly.
The National Assembly is acknowledging and highly appreciating the drastic, timely and effective direction and management of the Government, the Prime Minister, the National Steering Committee for COVID-19 prevention and control, ministries, central authorities, provincial Party committees and local authorities; the active, responsible and creative participation of the Vietnam Fatherland Front, mass organizations, anti-COVID frontline forces, health, military, police staff, volunteers, etc. in the prevention and control of COVID-19.
The National Assembly appreciates the companionship, trust and support towards the guidelines and policies of the Party and State; the high sense of self-discipline, responsibility, active participation in the prevention and control of COVID-19, solidarity, sympathy, mutual affection and mutual support to overcome difficulties of all population and our compatriots in foreign countries.
Upon realizing the very complicated and unpredictable developments of COVID-19 that are not ceased with new strains, such as Delta or others, that are likely to continue to appear and spread globally; the rapidly increased number of infected and dead people; the limited supply of vaccines around the world; shortages in specific treatment drugs, as huge challenges for disease control tasks, posing serious threats to health and life of the people; greatly affecting the activities of agencies, organizations and businesses; having very negative impacts on the country's socio-economic development; as well as requiring timely, consistent and due response solutions, the National Assembly herein requests the Government, the Prime Minister, central and local authorities to:
- Actively grasp the actual situation, continue to take more robust, drastic and effective actions and measures to both control COVID-19 well and promote socio-economic development, striving to succeed in implementing the Resolution No. 124/2020/QH14 of the National Assembly on the socio-economic development plan in 2021.
- Actively manage the state budget revenues and expenditures in 2021 in line with the actual situation; duly implement the goals, targets and solutions specified in the program of thrift and anti-extravagance practices; cut down at least 50% of the remaining expenses for conferences and domestic and foreign business travels of Ministries, central and local authorities (except for the emergency expenses for important and urgent activities and other disease prevention and control tasks of the Ministry of Health, the Ministry of National Defense and the Ministry of Public Security; diplomatic expenses of the Ministry of Foreign Affairs) and save another 10% of the remaining recurrent expenditure in 2021; recover recurrent expenditures that are not really necessary or slowly disbursed as provisional budget transfers to the central budget and local budgets, focusing on the prevention and control of the COVID-19 epidemic. Impose stricter financial rules and regulations; strengthen inspection, examination and implementation of actions, measures and solutions to deal with wastefulness, especially during the process of management and utilization of state budget funds, land and other natural resources; raise the responsibilities of persons holding leadership positions in ministries, central, local authorities and units, and strictly punish organizations and individuals that violate regulatory provisions of the Law on Thrift and Anti-extravagance Practices.

3.1. Decide to apply measures to restrict a number of vehicles, require people not to leave their residences for a certain period of time, in a number of necessary areas and regions; set up forces to ensure security, social order and safety in epidemic-hit areas; apply special communication measures, use means of communication and other measures that can be applied in a state of emergency to promptly prevent the spread of the disease. Decide and organize the implementation of measures not yet prescribed by laws or other than those specified in current laws and ordinances to meet the urgent COVID-19 management requirements concerning the application of the special, particular and exceptional regulatory mechanisms for licensing and registering for marketing authorization and circulation, production and procurement of drugs, medical equipment, chemicals and making investment in facilities; procure them in the quantity higher than the actual demand to provide for any new or complicated development of the disease; concurrently, adopt solutions to preventing any act of misconduct and minimizing waste during the procurement process.
3.2. Make the transfer of VND 1,237 billion in the remaining health care expenditure in 2020 of the Ministry of Health to buy COVID-19 vaccines and charge it into the state budget expenditures in 2021.
Prioritize COVID-19 management tasks when using the state budget funds and mobilize all other lawful resources for the prevention and control of the epidemic; decide to transfer recurrent expenditures in the approved estimate for the prevention and control of the COVID-19 epidemic; change or adjust state budget funding for unnecessary tasks in order to spend on carrying out the COVID-19 prevention and control task. In urgent cases, the central budget may give its grants to local budgets to carry out COVID-19 prevention and control task. For matters falling within the competence of the National Assembly or the National Assembly’s Standing Committee, the Government must report to the National Assembly’s Standing Committee for its consideration and decision before implementation.
3.3. In addition to the measures specified at 3.1 and 3.2 hereof, if it is necessary to issue regulations on COVID-19 prevention and control other than those prescribed in laws, during the interval between the National Assembly's meeting sessions, the Government shall report to the National Assembly’s Standing Committee for its consideration and decision according to the streamlined processes and procedures before implementation.
3.4. Guarantee social security, employment, health care and life of the People, especially people rendering meritorious services, policy families, the poor, women, children, the elderly, the disabled, other underprivileged people and anti-COVID-19 frontline forces; continue to take practical and effective measures to offer specific support to people, employees and employers; conduct researches on tax exemption and reduction for businesses affected by the COVID-19 epidemic. For matters falling within the competence of the National Assembly or the National Assembly’s Standing Committee, the Government shall report to the National Assembly’s Standing Committee for its consideration and decision before implementation.
3.5. Duly run the COVID-19 vaccination campaign; mobilize all resources; stimulate private-sector involvement; make the COVID-19 vaccine fund prosper; communicate vaccination, epidemic prevention and control in a full, continuous, accurate and transparent manner to shorten the time of achievement of the goal of herd immunity.
3.6. Ensure national defense and security, political stability; maintain social order and safety; avoid falling into the passive or surprised state in case of any emergency situation likely to occur; actively combat and refute misleading and hostile claims; strictly control bad and false information and strictly sanction violations in the COVID-19 prevention and control task in accordance with law.
3.7. Urgently check and review regulations related to epidemic prevention and control, medical examination and treatment and other relevant regulations in order to promptly amend and supplement them according to their competence, or request the National Assembly and the National Assembly’s Standing Committee to consider deciding on any amendment and supplement.
3.8. The Government and the Prime Minister shall vest local authorities with more powers to ensure the quick and timely implementation of urgent measures for COVID-I9 epidemic prevention and control; during the process of such strengthened decentralization of powers, may issue resolutions, directives, official telegrams, official dispatches and other types of documents under their competence to regulate and manage the implementation of urgent measures for fulfillment of the epidemic prevention and control task. These measures and those specified at 3.1, 3.2, 3.3 and 3.4 hereof will be implemented until the end of December 31, 2022 and the performance report on implementation thereof must be submitted to the National Assembly in the upcoming meeting. Based on the actual situation, if it is necessary to prolong the implementation of these measures, the Government shall report to the National Assembly for its consideration and decision in the fourth session of the XVth National Assembly (in October 2022).

5. The National Assembly’s Standing Committee, the Council of Ethnic Minorities, the National Assembly’s Committees, the National Assembly’s Delegations and the National Assembly’s delegates shall supervise the implementation of the Resolutions passed by the National Assembly. The Vietnam Fatherland Front and its member organizations shall supervise implementation of the National Assembly’s resolutions and encourage people from all social classes to implement these resolutions.
The National Assembly is calling on the whole political system and the people of the nation and our compatriots in foreign countries to unite with one heart and one mind to take action with full agreement and great determination to overcome all difficulties to achieve the dual goals of both promptly controlling and preventing the COVID-19 epidemic with the aim of giving people's lives, health and safety first and top priority on this side; and ensuring fast and sustainable economic recovery and growth, and successfully implementing the Resolution of the 13th National Congress of the Communist Party of Vietnam, on the other side.
This Resolution is passed in the first session of the XVth National Assembly of the Socialist Republic of Vietnam on July 28, 2021.
