ORDINANCE

OF THE NATIONAL ASSEMBLY STANDING COMMITTEE ON AMENDING A NUMBER OF ARTICLES OF THE ORDINANCE ON HANDLING OF ADMINISTRATIVE VIOLATIONS

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001 of the Xth National Assembly, the 10th session;
This Ordinance amends a number of Articles of the Ordinance on Handling of Administrative Violations which was passed by the Standing Committee of National Assembly on July 02, 2002

Article 1

To amend a number of Articles of the Ordinance on Handling of Administrative Violations stipulating on administrative probation as follows:

1. To annul clause 5 of Article 22, Article 27, clause 7of Article 30 and Section 5 of Chapter VII (including Articles from 102 to 109).

2. To remove the phrase "and 27" in clause 3 of Article 1, in clause 2 of the Articles 3, 6 and 11.

To remove the phrase ", administrative probation" in Article112, clause 2 of Article 118 and Article 119.

Article 2

1. The application of measures of administrative probation shall be terminated from the effective date of this Ordinance; In cases of being considered for application of administrative probation measures, the consideration shall be terminated; in case a decision has been issued but not yet implemented, this decision shall be annulled; in case the decision is being executed, the execution shall be terminated.

2. The previous provisions on administrative probation of the Ordinance on Handling of Administrative Violations are all annulled.

3. The Government responsible for the implementation of this Ordinance.
