GUIDING THE INVESTMENT PROCEDURE ON CONSTRUCTION OF WORKS

Ministry of Construction received the document No. 389/BNG-QTTV on June 22, 2010 of the Financial Administration Department - The Ministry of Foreign Affairs proposing the Ministry of Finance guiding the approvals on adjusting working drawings design. After studying, the Ministry of Construction has opinions as follows:

According to regulations at Article 18 of the Decree No. 12/2009/ND-CP dated February 12, 2009 of the Government on management of investment projects on the construction of works: Working drawing designs must be certified by investors or their authorized representatives In case of two-step or three-step designing.

To regulations at clause 4, Article 1 of the Decree No. 49/2008/ND-CP dated April 18, 2008 of the Government amending and supplementing a number of articles of the Government's Decree No. 209/2004/ND-CP dated December 16, 2004, on quality management of construction works “...Construction-supervising contractors may sign and adjust in construction drawing designs the contents already approved by investors and shall bear responsibility for their decisions." Therefore, in the case of changing working drawing design in the construction process, the investor will be responsible for approving to adjust working drawing designs or accept all contents need to be adjusted so that construction-supervising contractor can sign in the working drawing design. Investor can authorize the Project Management Board to adjust working drawing design.

Opinions of the Ministry of Construction as above, the Financial Administration Department - The Ministry of Foreign Affairs shall study and implement right to these regulations./.
