LAW

VIETNAMESE FATHERLAND FRONT

Pursuant to the Constitution of the Socialist Republic of Vietnam;

The National Assembly promulgates the Law on Vietnamese Fatherland Front

Chapter I

GENERAL PROVISIONS

Article 1. Vietnamese Fatherland Front

Vietnamese Fatherland Front is the political base of people’s power, representing and protecting lawful rights and interests of the people; gathering and bringing into play strength of national solidarity, exercising democracy and reinforcing social unanimity; participating in the construction of the Communist Party, State and people’s external relation activities making a contribution toward the construction and protection of the Fatherland.

Article 2. Governing scope

This Law regulates rights, responsibilities, organization and operation of the Vietnamese Fatherland Front; relationship between the Vietnamese Father Front and the State, the People and other organizations; conditions to ensure operation of the Vietnamese Fatherland Front.

Article 3. Rights and responsibilities of the Vietnamese Fatherland Front

1. Gather and construct great national unity, exercising democracy and reinforcing social unanimity.

2. Propagate and campaign the people to exercise their rights, guidelines and policies of the Communist Party and the State.

3. Represent and protect lawful rights and interests of the people;

4. Take part in the construction of the Communist Party and State;

5. Perform supervision and social criticism;

6. Gather and compile opinions and proposals from voters and the people to respond and make proposals to the Party and State.

7. Perform the people’s external relation activities;

Article 4. Principles of organization and operation of Vietnamese Fatherland Front

1. Organization and operation of the Vietnamese Fatherland Front are within the framework of the Constitution, the Law and Statute of the Vietnamese Fatherland Front.

2. Organization and operation of the Vietnamese Fatherland Front are based on principles of voluntariness, democratic consultation, coordination and unity of activities of its members.

3. When coordinating and unifying activities, member organizations of the Vietnamese Fatherland Front must comply with the Statute of the Vietnamese Fatherland Front, and at the same time maintain independence of their own organizations.

4. The Communist Party is both a member organization and leader of the Vietnamese Fatherland Front.

Article 5. Members of the Vietnamese Fatherland Front

1. Members of the Vietnamese Fatherland Front are organizations or individuals as prescribed in Article 1 hereof and the Statute of the Vietnamese Fatherland Front.

2. Joining or resignation as members, rights and responsibilities of members of the Vietnamese Fatherland Front as prescribed the Statute of the Vietnamese Fatherland Front.

Article 6. Organization of the Vietnamese Fatherland Front

1. The Vietnamese Fatherland Front is organized in the central and administrative divisions, is an executive agency between two congresses of the Vietnamese Fatherland Front, responsible for exercising duties of the Vietnamese Fatherland Front.

2. Agency of the Vietnamese Fatherland Front is organized as follows:

a) In central divisions: Central Committee of Vietnamese Fatherland Front, Presidium of the Central Committee of the Vietnamese Fatherland Front and Central Standing Committee of the Vietnamese Fatherland Front;

b) In administrative divisions: Committee of Vietnamese Fatherland Front of central-affiliated cities and provinces (hereinafter referred to as provincial level); Committee of Vietnamese Fatherland Front of provincial-affiliated districts, communes and cities, and equivalent adminstrative units; Committee of Vietnamese Fatherland Front of communes, wards and towns (hereinafter referred to as commune-level). Each level has Standing Committee of Vietnamese Fatherland Front of its own.

Organization, duties, authorities of agencies of the Vietnamese Fatherland Front is prescribed in the Statute of the Vietnamese Father Front.

3. Committee of Vietnamese Fatherland Front at commune-level establishes the commission of Fatherland Front in villages, hamlets, population groups, wards, and other residential communities (hereinafter referred to as residential area). Organization and operation of the Commission are prescribed in the Statute of the Vietnamese Fatherland Front.

Article 7. Relationship between the Vietnamese Fatherland Front and the State

1. The relationship between the Vietnam Fatherland Front and the State is the relationship to coordinate the exercise of duties and powers by each party according to provisions of the Constitution, the laws and Statute on coordination of tasks promulgated by the Committee of Vietnamese Fatherland Front and relevant regulatory agencies at each level.

2. The Prime Minister, ministers, heads of ministerial-level agencies, presidents of People’s committees at all levels shall be responsible for timely provision of information to Vietnamese Fatherland Front on the implementation of reporting to the people on important issues within management according to provisions of the Constitution and the laws.

3. Regulatory agencies shall be responsible for considering, handling and replying to proposals submitted by Vietnamese Fatherland Front according to law provisions.

4. The State shall create favorable conditions for the Vietnamese Fatherland Front to operate effectively.

Article 8. Relationship between the Vietnamese Fatherland Front and the people

1. The Vietnamese Fatherland Front shall represent and protect lawful rights and interests of the people; expand and diversify ways of gathering and uniting the people; encourage and support the people in the exercise of democracy, human rights, basic rights and obligations of citizens, follow guidelines of the Communist Party, policies and laws of the State.

2. The people shall take part in organization and operation of the Vietnamese Fatherland Front through its member organizations, typical individuals as members of the Committee of Vietnamese Fatherland Front at all levels and takes part in activities initiated and organized by the Vietnamese Fatherland Front.

3. Through the Committee of Vietnamese Fatherland Front and member organizations of the Vietnamese Fatherland Front, the people shall raise opinions and submit proposals to Vietnamese Fatherland Front concerning issues of the people’s interests for reflections and proposals to the Communist Party and State.

4. The people shall monitor operation of the Vietnamese Fatherland Front to ensure it exercises rights and responsibilities adequately and fully according to law provisions.

5. The Vietnamese Fatherland Front shall regularly renew contents and manner of operation to fulfill its responsibilities to the people according to provisions of the Constitution and the laws.

Article 9. Relationship between the Vietnamese Fatherland Front and organizations

1. Relationship between the Committee of Vietnamese Fatherland Front and its member organizations is instructed in accordance with the Statute of the Vietnamese Fatherland Front.

2. Relationship between the Committee of Vietnamese Fatherland Front and economic organizations, public service organizations and non-member organizations of the Vietnamese Fatherland Front is the voluntary relationship instructed in accordance with law provisions aimed at furthering socio-economic development, protection of lawful rights and interests of the people, construction and defense of the Fatherland.

Article 10. People-to-people relations

The Vietnamese Fatherland Front shall execute and expand activities of people-to-people relations, make a contribution towards reinforcing friendship and solidarity with other countries, peoples for the purpose of peace, cooperation and development.

Article 11. Traditional Day

November 18 is the Traditional Day of the Vietnamese Fatherland Front and also the National Great Unity Day.

Chapter II

GATHERING AND BUILDING GREAT UNITY OF THE NATION

Article 12. Principles of gathering and building great unity of the nation

The Vietnamese Fatherland Front shall diversify ways of organization and operation to gather and unite all Vietnamese people at home and abroad regardless of backgrounds, social classes, races, beliefs, religions and pasts to involve all resources in the construction and defense of the Fatherland.

Article 13. Ways of gathering and building great unity of the nation

1. Propagandize and mobilize the people to promote tradition of patriotism and great unity of the nation; take part in campaigns and movements of patriotic emulation.

2. Unite and cooperate with the people’s lawful organizations;

3. Bring into play positives of typical individuals from social classes, races, religions to implement the program for coordination and unification of action by the Committee of Vietnamese Fatherland Front;

4. Admit and develop members to the Vietnamese Fatherland Front;

5. Propagandize and call upon overseas Vietnamese people to unite communities, help each other in life, respect the laws of  host countries; preserve and bring into play good cultural and tradition characters of the nation; maintain bonds with families and hometowns, make a contribution toward the construction and defense of the Fatherland;

6. Adopt other activities concerning rights and responsibilities of the Vietnamese Fatherland Front;

Article 14. Coordination in building great unity of the nation

1. The Vietnamese Fatherland Front shall cooperate with regulatory agencies in building great unity of the nation through the following activities:

a) Propose and take part in building and executing policies and laws concerning gathering and building great unit of the nation;

b) Preside over, coordinate and take part in organizing activities concerning rights and responsibilities of one’s own organizations;

c) Take part in dialogs, reconciliation and construction of autonomous communities in the area of residential areas

d) Take part in constructing and executing state policies on social security; propose and take part in executing programs, movements, campaigns to make a contribution toward taking care of material and spiritual life of the people;

2. The Committee of the Vietnamese Fatherland Front shall cooperate and unify action among members of the Front in the construction of great unity of the nation through following activities:

a) The Central Committee of the Vietnamese Fatherland Front shall organize or cooperate with regulatory agencies in organizing campaigns and movements of patriotic emulation across the nation.

b) The Committee of Vietnamese Fatherland Front in localities shall organize or cooperate with regulatory agencies in organizing campaigns and movements of patriotic emulation at local level.

c) Member organization of the Committee of Vietnamese Fatherland Front shall organize or cooperate with regulatory agencies in organizing campaigns and movements of patriotic emulation in connection with rights and responsibilities of their own organizations; gather and encourage members, union members and the people to take part in implementing campaigns and movements of patriotic emulation of the Committee of Vietnamese Fatherland Front;

d) The Committee of Vietnamese Fatherland Front shall organize appropriate ways to mobilize and bring into play central role of members as typical individuals in the operation of Vietnamese Fatherland Front.

Chapter III

REPRESENTING AND PROTECTING LAWFUL RIGHTS AND INTERESTS OF THE PEOPLE

Article 15. Reflecting opinions and proposals from constituency and the people

1. Presidium of the Central Committee of Vietnamese Fatherland Front shall preside over and cooperate with the Standing committee of the National Assembly of the Socialist Republic of Vietnam in compiling opinions and proposals from constituency and the people across the country to make the report in sessions of the National Assembly.

2. Standing committee of the provincial Committee of Vietnamese Fatherland Front shall cooperate with the Delegation of the National Assembly in compiling opinions and proposals from constituency and the people in locality to make the submission to the Standing committee of the National Assembly of the Socialist Republic of Vietnam and the Presidium of the Central Committee of Vietnamese Fatherland Front.

3. Standing committee of the local Committee of Vietnamese Fatherland Front shall cooperate with the standing committee of People’s Council, People’s committees in compiling opinions and proposals from constituency and the people to make the report in meeting sessions of People’s Council of the same level concerning local issues.

4. Members of the Vietnamese Fatherland Front within their own rights and responsibilities shall compile opinions and proposals from members, union members and strata of the people to make the submission to the standing committee of the Committee of Vietnamese Fatherland Front of the same level. Standing committee of the Committee of Vietnamese Fatherland Front at all levels shall be responsible for compiling opinions and proposals from members and the standing committee of the Committee of Vietnamese Fatherland Front of lower levels for reflections and proposals to agencies of the Communist Party and State at the same level.

Article 16. Coordination in organizing dialogs with constituency of the Delegation of National Assembly and People’s Councils at all levels

1. Standing committee of the provincial Committee of Vietnamese Fatherland Front shall cooperate with the Delegation of the National Assembly, the standing committee of People’s Council, People’s committees at the same level and relevant agencies, organizations in organizing dialogs with constituency of the Delegation of the National Assembly and provincial People’s Councils;

2. The standing committee of the district Committee of Vietnamese Fatherland Front shall cooperate with the standing committee of People’s Council, People’s committees at the same level in organizing dialogs with constituency of the Delegation of the National Assembly and People’s Councils at district, commune levels;

3. The Standing committee of the National Assembly of the Socialist Republic of Vietnam, the Government shall cooperate with Presidium of the Central Committee of Vietnamese Fatherland Front in promulgating the Joint Resolution detailing organization of dialogs with constituency of the Delegation of the National Assembly and People’s Council.

Article 17. Propagandizing and calling upon the people to exercise autonomous rights, policies and laws

The Vietnamese Fatherland Front shall carry out propaganda and calling upon the people to exercise autonomous rights, policies and laws as follows:

1. Propagandize and call upon the people to exercise guidelines of the Communist Party and policies and laws of the State;

2. Cooperate with commune-level authorities in calling upon the people to exercise democracy at grass-roots level, village regulation and convention in residential areas;

3. Direct operation of the People’s Inspectorate at commune level and Public Investment Supervisory Board;

4. Take part in reconciliation at grass-root level;

Article 18. Receive citizens, take part in handling complaints, denunciations, grant special reprieve, and delegate the people’s advocates

1. The Vietnamese Fatherland Front shall carry out reception of citizens; take part in handling complaints, denunciation; grant special reprieve according to law provisions.

2. The Committee of Vietnamese Fatherland Front from commune level and above shall delegate the people’s advocates to defend convicted people as members of its own organizations.

Chapter IV

TAKING PART IN STATE-BUILDING

Article 19. Take part in elections

The Vietnamese Fatherland Front shall organize selection and introduction of candidates for the Delegation of the National Assembly and People’s Council; take part in organizations in charge of elections; cooperate with concerned regulatory agencies in organizing voters’ conferences at commune level, dialogs between voters and candidates; take part in propaganda and calling upon voters to exercise the laws on elections.

Article 20. Taking part in selection of judges, procurators and introduction of jurors to the People’s Courts

1. The Central Committee of Vietnamese Fatherland Front shall appoint representatives to take part in the Council of selecting and supervising national judges, the Council of selecting procurators for the Supreme People’s Procuracy, the Council of selecting primary, intermediate and advanced procurators according to law provisions.

2. The Committee of Vietnamese Fatherland Front at provincial and district levels shall preside over selection and introduction of qualified people to People’s Council for being elected as jurors to the People's Courts according to law provisions.

Article 21. Taking part in law-building

1. The Central Committee of Vietnamese Fatherland Front has the right to make proposals to the Standing committee of the National Assembly of the Socialist Republic of Vietnam, National Assembly for the construction of laws and or ordinances; make the submission of bills and ordinances to National Assembly, the Standing committee of the National Assembly of the Socialist Republic of Vietnam.

2. The Vietnamese Fatherland Front shall take part in the contribution of ideas to the draft constitution, bills, ordinance and other draft legislative documents; make proposals to competent state agencies for supplements, amendments or abrogation of legislative documents in opposition to the constitution and laws.

3. During the construction of legislative documents, agencies and organization shall preside over the drafting and concerned organizations shall be responsible for creating conditions for the Vietnamese Fatherland Front shall participate in the contribution of ideas; receive and reply to proposals made by the Vietnamese Fatherland Front according to law provisions.

Article 22. Attending sessions of National Assembly, sessions of the Standing committee of the National Assembly of the Socialist Republic of Vietnam, the Government, sessions of People’s Council, People’s committees

1. President of the Central Committee of Vietnamese Fatherland Front shall attend sessions of National Assembly; invited to attend sessions of the Standing committee of the National Assembly of the Socialist Republic of Vietnam, the Government on issues concerning rights and responsibilities of the Vietnamese Fatherland Front.

President of the local Committee of Vietnamese Fatherland Front shall attend sessions of People’s Council; invited to attend sessions of People’s committees at the same level on issues concerning rights and responsibilities of the Vietnamese Fatherland Front.

2. At sessions of People’s Council, the Committee of Vietnamese Fatherland Front at the same level shall announce activities of government-building by the Vietnamese Fatherland Front, opinions and proposals from local people; make proposals to People’s Council, People’s committees on necessary issues.

Article 23. Taking part in prevention and fighting against corruption and extravagance

1. The Vietnamese Fatherland Front shall take part in prevention and fighting against corruption and extravagance as follows:

a) Propagandize and call upon the people to exercise the laws on prevention and fighting against corruption and extravagance;

b) Request competent agencies, organizations, and individuals to take measures to prevent corruption and extravagance; verify cases of corruption, extravagance; handle persons who commit acts of corruptions and extravagance;

c) Make proposals to competent state agencies for protection and commendation for persons who deserve for detecting and denounce acts of corruption and extravagance;

2. Competent agencies, organizations, and individuals must give considerations and reply to requests, proposals by the Vietnamese Fatherland Front according to law provisions.

Article 24. Taking part in contribution of ideas, making proposals to the State

1. The Vietnamese Fatherland Front shall contribute ideas or make proposals to competent agencies, organizations, and individuals on the exercise of duties and powers by such agencies, organizations, and individuals.

2. Competent agencies, organizations, and individuals shall be responsible for creating conditions for the Vietnamese Fatherland Front to participate in the contribution of ideas and making proposals; receiving and giving feedback on ideas, proposals from the Vietnamese Fatherland Front according to law provisions.

Chapter V

ACTIVITIES OF MONITORING

Article 25. Nature, purpose and principles of monitoring

1. Monitoring by Vietnamese Fatherland Front means the committees of Vietnamese Fatherland Front at all levels engages themselves or requests their member organizations to monitor, examine, assess and make proposals for activities of agencies, organizations, elective delegation, officials and civil servants in the exercise of policies and laws.

2. Monitoring by the Vietnamese Fatherland Front is of social nature, representing and protecting lawful rights and interests of the people, detecting and making proposals for the handling of violations, defects, making proposals for amendments, supplements to policies and laws; detecting and disseminating new elements, advanced models and positive aspects; bringing into play autonomous rights of the people, making a contribution toward the construction of an untarnished and strong state.

3. Activities of monitoring are carried out under principles of ensuring promotion of democracy and participation of the people, members of the Vietnamese Fatherland Front.

Article 26. Entities, contents and scope of monitoring

1. Entities subject to monitoring by the Vietnamese Fatherland Front are regulatory agencies, organizations, elective delegation, officials and civil servants.

2. Scope of monitoring includes the exercise of policies and laws concerning lawful rights and interests of the people, rights and responsibilities of the Vietnamese Fatherland Front.

3. The Committee of Vietnamese Fatherland Front shall preside over monitoring entities and contents as prescribed in Clauses 1 and 2 hereof.

At the request of the Committee of Vietnamese Fatherland Front or as prescribed, socio-political organizations shall preside over monitoring entities and contents as prescribed in Clauses 1, 2, of this Article in direct connection with lawful rights and interests of members, associates, rights and responsibilities of their own organizations.

Other member organizations of the Vietnamese Fatherland Front shall cooperate with the Committee of Vietnamese at the same level shall exercise policies for entities, contents as prescribed in Clauses 1, 2 of this Article in direct connection with lawful rights and interests of the members, associates, rights and responsibilities of their own.

Article 27. Manner of monitoring

1. Study and review documents issued by competent agencies relating to lawful rights and interests of the people;

2. Organize team of monitoring;

3. Pass activities of the People’s Inspectorate at commune level and Public Investment Supervisory Board;

4. Participate in monitoring with competent agencies, organizations;

5. The standing committee of the National Assembly of the Socialist Republic of Vietnam, the Government shall cooperate with Presidium of the Central Committee of Vietnamese Fatherland Front in promulgating the Joint Resolution detailing this Article.

Article 28. Rights and responsibilities of the Vietnamese Fatherland Front for monitoring

1. Cooperate with relevant agencies, organizations in constructing the program, contents, and plans for monitoring; make decisions on the establishment of the monitoring team and organize monitoring activities as planned or required.

2. Request agencies, organizations, and individuals monitored to make reports and supply information and documents in connection with the contents of monitoring;

3. Give an objective and scientific consideration to issues in connection with contents of monitoring;

4. Organize dialogs to clarify proposals after monitoring if necessary or at the request of agencies, organizations, and individuals monitored;

5. Make proposals to competent agencies, organizations, and individuals for considerations over measures to protect interests of the State, lawful rights and interests of the people; considerations over responsibilities of agencies, organizations, and individuals for committing acts of violations according to law provisions;

6. Promulgate or cooperate with relevant agencies, organization in promulgating document on result of monitoring; take responsibilities for proposals after monitoring;

7. Follow up, speed up the handling of proposals after monitoring; request competent agencies, organizations, and individuals to examine responsibilities of agencies, organizations, and individuals for not handling or handling in opposition to law provisions;

8. Commend or request competent agencies, organizations to organize praise and commendations for extraordinary achievements in monitoring;

Article 29. Rights and responsibilities of agencies, organizations, and individuals monitored

1. Receive prior notice about contents and plans for monitoring;

2. Make written reports on contents of monitoring; provide information and documents in connection with contents of monitoring; make additional reports and clarifications of related information;

3. Give a presentation over related information within duties and powers;

4. Make requests for review of proposals after monitoring, dialogs to clarify such proposals if necessary;

5. Create favorable conditions for the Vietnamese Fatherland Front to perform monitoring;

6. Examine, handle and reply to proposals after monitoring;

7. Conclusion and decision over handling issued by competent agencies, organizations in connection with proposals after monitoring;

Article 30. Responsibilities of National Assembly, the Government, People’s Council, People’s committees and relevant agencies, organizations, and individuals

1. On a six-month basis, the National Assembly, the Government, People’s Council, People’s committees shall be addressed to over result of monitoring by the Committee of Vietnamese Fatherland Front; relevant agencies, organizations, and individuals are requested to review proposals and speed up the handling of proposals after monitoring.

2. Agencies, organizations, and individuals within duties and powers shall be responsible for creating favorable conditions and providing necessary information and documents for monitoring activities on request; delegating people to monitor related issues; creating conditions for the Vietnamese Fatherland Front to carry out monitoring; reviewing and handling proposals after monitoring by the Vietnamese Fatherland Front according to law provisions.

Article 31. Rights and responsibilities of the Committee of Vietnamese Fatherland Front for dismissal of Delegation of National Assembly, People’s Council; votes of confidence for key positions elected or endorsed by National Assembly, People’s Council

1. The Presidium of the Central Committee of Vietnamese Fatherland Front, the provincial Committee of Vietnamese Fatherland Front are entitled to dismiss delegates of the National Assembly who no longer deserve for the trust of the people; the local Committee of Vietnamese Fatherland Front is entitled to propose dismissal of delegates of People’s Council who are no longer deserve for the trust of the people according to law provisions.

2. The local Committee of Vietnamese Fatherland Front is entitled to make proposals to the standing committee of People’s Council for submission to People’s Council at the same level for votes of confidence for those holding key positions elected by People’s Council according to law provisions;

3. The Committee of Vietnamese Fatherland Front at all levels shall be responsible for gathering and compiling all suggestions, proposals from voters and the people in connection with persons granted votes of confidence and making such submission to National Assembly, People’s Council before meeting sessions.

Chapter VI

SOCIAL CRITICISM

Article 32. Nature, purpose and principles of social criticism

1. Social criticism by the Vietnamese Fatherland Front means the committees of Vietnamese Fatherland Front at all levels engages themselves or requests their member organizations to give comments, assessment and raise political opinions, proposals over draft legislation, planning, plans, programs and projects (hereinafter referred to as draft documents) by the State.

2. Social criticism by the Vietnamese Fatherland Front is of social nature, objective, scientific, constructive and makes a contribution toward ensuring rightness and suitability for social life and efficiency of draft documents; ensuring lawful rights and interests of the people; bringing into play democracy and enhancing unanimity of the society;

3. Activities of social criticism are executed according to principles of democracy, public disclosure, transparency, ensuring participation of members, associates, union members and the people; respecting different views not in opposition to lawful rights and interests of the people, interests of the nation.

Article 33. Subjects, contents and scope of social criticism

1. Subjects of social criticism by the Vietnamese Fatherland Front are draft documents by regulatory agencies at the same level in direct connection with lawful rights and interests of the people, rights and responsibilities of the Vietnamese Fatherland Front.

2. Scope of social criticism by Vietnamese Fatherland Front includes necessities, conformity with guidelines of the Communist Party, policies and laws of the State; rightness, scientificity and feasibility; assessment of impacts and efficiency of politics, economics, culture, society, National defense and security, and external relation activities of draft documents; ensuring harmony between interests of the State, people and organizations.

3. The Committee of Vietnamese Fatherland Front shall preside over social criticism for subjects and contents as prescribed in Clauses 1, 2 of this Article.

At the request of the Committee of Vietnamese Fatherland Front or as prescribed, socio-political organizations shall preside over social criticism for subjects and contents as prescribed in Clauses 1, 2, of this Article in direct connection with lawful rights and interests of members, associates, rights and responsibilities of their own organizations.

Other member organizations shall cooperate with the Committee of Vietnamese Fatherland Front to conduct social criticism for subjects and contents as prescribed in Clauses 1, 2 of this Article in direct connection with lawful rights and interests of the members, associates, rights and responsibilities of their own organizations.

Article 34. Manner of social criticism

1. Organize conferences of social criticism;

2. Send draft documents of social criticism to relevant agencies, organizations, and individuals for collection of suggestions on social criticism.

3. Organize dialogs between the Vietnamese Fatherland Front and agencies, organizations that have draft documents of social criticism;

4. The Standing committee of the National Assembly of the Socialist Republic of Vietnam, the Government shall cooperate with Presidium of the Central Committee of Vietnamese Fatherland Front in promulgating the Joint Resolution detailing this Article.

Article 35. Rights and responsibilities of the Vietnamese Fatherland Front of social criticism

1. Construct contents and plans for social criticism;

2. Request agencies and organizations in charge to prepare and send draft documents along with other necessary information and documents;

3. Execute manners of social criticism;

4. Formulate documents of criticism and make their submission to agencies, organizations that have draft documents of social criticism;

5. Request agencies in charge to prepare and issue a written reply to proposals from by the Vietnamese Fatherland Front;

Article 36. Rights and responsibilities of agencies, organizations in charge of drafting documents of social criticism

1. Send draft documents of social criticism to the Vietnamese Fatherland Front at least 15 days before submission to competent agencies for promulgation of documents; make provision of necessary information and documents;

2. Delegate concerned persons to take part in conferences of social criticism or take part in dialogs at the request of the Vietnamese Fatherland Front;

3. Make a written reply to proposals from the Vietnamese Fatherland Front, provide explanation if failing to receive proposals; report criticism made by the Vietnamese Fatherland Front to agencies, organizations having authority to issue documents;

Chapter VII

CONDITIONS TO ENSURE OPERATION OF THE VIETNAMESE FATHERLAND FRONT

Article 37. Assisting apparatus; training in professional competence of the Front’s tasks

1. The Committee of Vietnamese Fatherland Front has an assisting apparatus. Organization and payroll of the assisting apparatus of the committees of Vietnamese Fatherland Front at all levels are prescribed by competent agencies.

2. Officials and civil servants from agencies of the Committee of Vietnamese Fatherland Front and part-time staff for the Front's tasks shall be trained to improve professional competence of the Front’s tasks meeting requirements and tasks assigned.

3. Relevant state agencies shall create favorable conditions for the Vietnamese Fatherland Front to carry out plans, programs for training, and bring into play teams of experts, consultants and collaborators.

Article 38. Budget for operation, properties and facilities of the Vietnamese Fatherland Front

1. Budget for operation of the Committee of Vietnamese Fatherland Front at all levels shall be provided by the State budget according to law provisions.

2. Formulation of estimation, allocation and final settlement of budget for operation of the Vietnamese Fatherland Front shall be instructed in accordance with the Law on State Budget.

3. The Vietnamese Fatherland Front is entitled to manage and use properties assigned by the State, properties and sources sponsored, donated by organizations and individuals at home and abroad according to law provisions.

Article 39. Responsibilities of agencies, organizations

1. Create favorable conditions for officials and civil servants, employees to perform their duties when nominated to the Committee of Vietnamese Fatherland Front or assigned to take part in activities of the Vietnamese Fatherland Front;

2. Cooperate with the Vietnamese Fatherland Front in carrying out campaigns and movements of patriotic emulation presided over or performing programs and projects assigned to the Vietnamese Fatherland Front; providing information and documents at the request of the Vietnamese Fatherland Front;

3. Propagandize and call upon officials and civil servants, employees to exercise policies on great unity of the nation; respond to campaigns and movements of patriotic emulation initiated and organized by the Vietnamese Fatherland Front;

Chapter VIII

IMPLEMENTARY PROVISIONS

Article 40. Effect

1. This Law takes effect since January 01, 2016.

2. The Law on Vietnamese Fatherland Front No. 14/1999/QH10 expires since the effective date of this Law.

Article 41. Detailed provisions

The Standing committee of the National Assembly of the Socialist Republic of Vietnam, the Government shall cooperate with Presidium of the Central Committee of Vietnamese Fatherland Front in detailing articles and clauses prescribed hereof.

This Law has been ratified in June 09, 2015 in the 9th Session of the 13th National Assembly of the Socialist Republic of Vietnam.
