REGULATION ON CIVIL AVIATION COMMUNICATIONS, NAVIGATION AND SURVEILLANCE
The Minister of Transport’s Decision No. 14/2007/QD-BGTVT dated March 26, 2007 promulgating the regulation on civil aviation communications, navigation and surveillance that takes effect since May 04, 2007 are supplemented and amended by:
The Minister of Transport’s Circular No. 22/2011/TT-BGTVT dated March 31, 2011 stipulating administrative procedures in the area of air navigation that takes effect since May 15, 2011.
Pursuant to the Law on Civil aviation dated June 29, 2006;
Pursuant to the Government’s Decree No. 34/2003/ND-CP dated April 04, 2003 stipulating functions, duties, powers and organizational structure of the Ministry of Transport;

Article 2. This Decision takes effect after 15 days since relevant official gazette is published.
The Minister of Transport’s Decision No. 39/2005/QD-BGTVT dated August 26, 2005 promulgating "the regulation on civil aviation communications, navigation and surveillance”.
Article 3. Chief officers, Chief Inspector of ministries, directors of the Civil Aviation Authority of Vietnam, heads of relevant organizations and individuals shall be responsible for executing this Decision./.

GENERAL PROVISIONS
Article 1. Scope and regulated entities
1. This Regulation stipulates provision of civil aviation communications, navigation and surveillance services; communications, navigation and surveillance systems, equipment and components thereof (herein 'CNS systems’); communications, navigation and surveillance service providers; communications, navigation and surveillance staff; use of aviation radio frequencies; ground and test flying and inspection of CNS systems; responsibility of organizations, individuals in connection with civil aviation communications, navigation and surveillance services.
2. This Regulation applies to airlines, aircraft operators, CNS service providers, CNS staff and other organizations and individuals in connection with civil aviation CNS services.

Article 3. Interpretation of terms

2. “Innovations” refer to the modification of CNS systems or components thereof to suit approved standards.
3. “Approach control center” refers to the unit that provides air traffic control services for controlled flights to and from one or several airports.
4. “Flight operations facilities” includes area control centers, approach control offices, airport traffic control towers (ATC towers) and ground-based controllers.
5. “Location indicator” refers to a four-letter code group formulated in accordance with rules prescribed by ICAO and assigned to the location of an aeronautical fixed station.
6. “Airport traffic control tower” refers to the unit that provides air traffic control services for air navigation at the airport.
7. “Permit for operation of technical system, and equipment” refers to the written confirmation of satisfaction of air navigation conditions of CNS systems when put into operation.
8. “CNS systems” refer to technical system, facilities currently in use, or ready for use for the purpose of providing CNS services.
10. “Air-to-ground communications” refer to two-way communications between aircraft and ground stations.
11. “Aeronautical Fixed Telecommunication Network” refers to a worldwide system of aeronautical fixed circuits provided, as part of the Aeronautical Fixed Service, for the exchange of messages and/or digital data between aeronautical fixed stations having the same or compatible communications characteristics.

13. “Harmful interference” refers to any interference that endangers the functioning or obstructs, interrupts a communications system.
14. “Radio spectrum” is a range of radio frequencies.
15. “Radio waves” refer to the electromagnetic waves with frequencies lower than 3,000 GHz spread in space without artificial waves.
16. “Repairs” refer to the restoration of CNS systems to normal conditions in accordance with the approved standards.
17. “Major overhaul” refers to the repair works if being improperly performed may have adverse effects on durability of structure, technical characteristics, features, performance or other qualities of CNS systems; or repair works that are inconsistent with normal practices or cannot be done through basic methods.
18. “Compulsory notices” are decisions or directions by state management agencies or notifications by manufacturers which are compulsory for CNS systems.
19. “Automatic Terminal Information Service” (ATIS) Is a continuous broadcast of recorded aeronautical information in busier airports.
20. “Data integrity” is the maintenance of, and the assurance of the accuracy and consistency of, data over its entire life-cycle.
21. “Area control center” is a facility responsible for providing air traffic control services to aircraft operating within controlled airspace .

CNS SYSTEMS; CNS SERVICE PROVIDERS; USE OF CNS SERVICES
Article 4. Disclosure of information on CNS systems
General director of the Civil Aviation Authority of Vietnam shall unify management and public disclosure of information on features and parameters concerning operation of CNS systems.
Article 5. Standards of CNS systems
1. CNS systems shall meet regulator standards as adopted or be recognized as compliant with ICAO standards, by the Civil Aviation Authority of Vietnam.
2. To the extent of possible effect of the terrain where CNS systems are installed, the Civil Aviation Authority of Vietnam shall allow operation of the systems in limited conditions.
3. General director of the Civil Aviation Authority of Vietnam shall make announcement of the difference between standards of CNS systems adopted by Vietnam and ICAO .
Article 6. Protection of CNS systems
1. The regulatory agencies, organizations and individuals shall be responsible for protecting CNS systems and information security.

Article 7. Installation, renovation and upgrading of CNS systems
1. The installation, renovation and upgrading of CNS systems shall be compliant with the air navigation service system development plan, meet actual requirements of air navigation and be approved by the Civil Aviation Authority of Vietnam.
2. Imported CNS systems shall meet electromagnetic compatibility standards, radio spectrum planning according to laws on radio frequencies.
Article 8. Installation and operation of CNS systems on aircraft
1. Vietnam’s civil aircraft shall be equipped with CNS systems in accordance with the standards adopted, or recognized as compliant with ICAO standards, by the Civil Aviation Authority of Vietnam.
2. Foreign civil aircraft operating in Vietnam’s airspace and Vietnam-controlled flight information region (FIR) shall be equipped with CNS systems in accordance with ICAO standards.
3. The operation of CNS systems on aircraft should accord with regulations on operation of aircraft.
Article 9. Documents concerning operation, maintenance and care of CNS systems
1. CNS service providers shall be responsible for formulating and issuing documents concerning operation, maintenance and care of CNS systems as prescribed; in case of imported CNS systems, the documents issued by the manufacturer thereof can be used; the documents should be accompanied by a Vietnamese version.

Article 10. Code, technical address of CNS systems
1. Code and address of CNS systems shall be consistent throughout Vietnam's civil aviation industry in accordance with distribution and ICAO’s standards, including:
a) 24-bit address assigned to aircraft of Vietnamese nationality;
b) AFTN location indicators;
c) AFTN terminal address;
d) AMHS terminal address – ATN;
dd) CPDLC terminal address;
e) Radio Beacon identity code;
g) PSR, SSR, RPD and FDP identity codes;

3. The Civil Aviation Authority of Vietnam shall establish a register of codes and technical addresses of CNS systems and make notifications to ICAO.
Article 11. Establishment of aeronautical communications channels
The establishment of following communications channels and data link should be approved by the Civil Aviation Authority of Vietnam:
1. Communications channels: ATS/DS, AFTN, AMHS and AIDC;
2. Air-to-ground VHF stations, PSR, SSR, ADS and CPDLC data links.
Article 12. Connection to information and data on communications channels
1. Connection to information and data on communications channels, CNS systems among organizations in Vietnam’s civil aviation industry shall be carried out for flight operations management.
2. Connection to information and data on communications channels, CNS systems among organizations inside and outside Vietnam’s civil aviation industry shall be carried out for management and use of airspace, ensuring national defense and security, flight operations management.
3. The connection as prescribed in Clauses 1 and 2 of this Article should be approved by the Civil Aviation Authority of Vietnam except for connection among service providers of the same enterprise that provides air navigation services.

CNS service providers shall be allowed to lease telecommunications means and services from other suppliers. Such means and services should meet requirements of accuracy, integrity and availability of air navigation services.
Article 14. Use of CNS systems
1. Operation of CNS systems shall be based on UTC.
2. Time shall be set starting from 00.01 as follows:
a) For voice, message, data communications equipment: Six digits with the first two digits displaying date of month, the remaining four digits displaying UTC hours and minutes.
b) For other equipment: Four digits displaying UTC hours and minutes.
Article 15. Coordinates of CNS systems
1. Coordinates of CNS systems are based on WGS-84. Measurement of the coordinates shall be carried out by specialized organizations.
2. Requirements concerning accuracy of announced coordinate data of each CNS system should be compliant with standards in Annex 15 of the Convention on international civil aviation – Aeronautical Information Service (AIS).

Article 16. Record and storage of CNS service information
1. CNS service providers should equip technical systems, facilities to fully and adequately record and store all information about voice, message and data communications and images of services provided. Time limits for storage shall be stipulated as follows:
a) At least 30 days for CPDLC, ATS/DS; data communications among flight operation facilities and between flight operation facilities and other agencies involved in air navigation as defined in the instruction manual provided by the flight operation facilities; AFTN and AMHS;
b) At least 15 days for data, images received from PSR, SSR, ADS and air navigation systems.
2. In case the stored communications, data and images are related to accident and emergency investigations, the time limits for storage shall be extended and defined by the investigation agency before expiration as prescribed in Clause 1 of this Article.
3. Apart from provisions as set out in Clauses 1 and 2 of this Article, the storage of data shall be compliant with the law on archives.
Article 17. Backup equipment
1. CNS systems should be installed with at least dual configuration or standalone equipment for replacement in case of need.
2. Backup equipment shall meet functional and technical requirements which are the same as applied to main equipment and be ready for operation.

1. CNS service providers shall arrange main and backup power sources for CNS systems. Main and backup power sources should meet the CNS system manufacturer’s standards and air navigation service requirements.
2. For technical systems, facilities and equipment at the flight operation facilities, power supply should be kept continuous and uninterrupted.
3. For CNS systems not subject to Clause 2 of this Article, the switch from main power sources to backup ones shall be automatically performed. Maximum time for the switch in individual technical systems, facilities and equipment should accord with the standards stipulated in Annex 14 of the Convention on international civil aviation and requirements of air navigation services.
Article 19. Availability of documents at CNS service providers
CNS service providers shall ensure availability of following documents:
1. The Law on Vietnam Civil Aviation, Ordinance on post and telecommunications, Decree on management of air navigation, Regulation on air traffic of Vietnam civil aviation, Regulation on civil aviation communications, navigation and surveillance, Regulation on aeronautical information publication, Regulation on search and rescue in civil aviation.
2. CNS systems operation permits;
3. Permits for use of radio frequencies and transmitters granted by the Authority of Radio Frequency Management – Ministry of Post And Telecommunications;
4. Documents providing instructions on operation, maintenance and care of CNS systems; records of operation, maintenance and care; technical inspection reports, technical statistics;

Article 20. Maintenance and care of CNS systems
1. CNS systems shall be maintained and repaired in accordance with instruction documents as prescribed in Article 9 hereof.
2. CNS service providers shall organize a maintenance and care division or contract for the services; conduct supervision of maintenance and care as prescribed in the instruction documents and maintain technical specifications as specified in operation permits.
3. Major repairs to CNS systems shall be carried out only in the facilities approved by the Civil Aviation Authority of Vietnam.
4. Measurement and calibration equipment for examination, maintenance and care of CNS systems should be tested, calibrated according to laws on measurement.

Article 22. Facilities providing installation, maintenance and care services for CNS systems
Facilities providing installation, maintenance and care services for CNS systems (herein ‘maintenance and care facilities’) should meet following requirements:
1. Employ a team of personnel who have been trained and certified in the areas of installation, quality inspection, maintenance and care of CNS systems;

3. Provide adequate measurement equipment, tools, means, raw materials, replacement spare parts as stipulated by the manufacturer;
4. Prepare instruction documents for installation, maintenance and care of the systems;
5. Maintain a system that records and stores technical inspection reports;
6. Have on-site fire and explosion prevention and combat vehicles and measures;
Article 23. Recordation of maintenance and care, innovation of CNS systems
1. Maintenance and care, innovation of CNS systems should be adequately and clearly recorded in logbooks or other means of storage.
2. Records of maintenance and care, innovation of CNS systems shall include following information:
a) Date of maintenance and care, innovation;
b) Current conditions of the systems;

d) Implementation of compulsory notices.
3. When transferring the CNS systems from one operation division to the other, the documents, records of information about such systems should be accompanied.
4. Data and information about maintenance and care of CNS systems should be deposited for a long time.
Article 24. Notification of operation conditions of CNS systems
1. CNS service providers shall:
a) Make notification of current conditions of CNS systems to relevant aeronautical information service providers, flight operation facilities according to the Regulation on aeronautical information publication;
b) In case technical systems of non-visual navigation aids, aviation lighting system work improperly, make an immediate report to airport traffic control towers and approach control offices.
2. CNS service users shall:
a) Make immediate report to relevant flight operation facilities on unusual conditions of CNS services; in this case, immediately after landing, the pilot in command shall report to the air traffic services reporting office according to the Regulation on aeronautical information publication;

Article 25. Notification of technical conditions of CNS systems
1. CNS service providers shall be responsible for making report to the Civil Aviation Authority of Vietnam on technical conditions of CNS systems in following cases:
a) Aircraft accidents in connection with CNS service providers;
b) As requested by the Civil Aviation Authority of Vietnam.
2. Reports as referred to in Clause 1 of this Article shall be made according to forms issued by the Civil Aviation Authority of Vietnam.
Article 26. Certification of CNS systems
1. CNS systems as prescribed in Article 27 hereof that are manufactured or innovated in Vietnam shall be reviewed and certified by the Civil Aviation Authority of Vietnam.
2. Conditions for certification of the CNS systems as prescribed in Clause 1 of this Article include:
a) Manufacture of the CNS systems shall meet prescribed standards;

c) The CNS systems shall be compliant with the law on post and telecommunications for technical systems of radio receivers and transmitters.
3. CNS systems in trial operation shall meet requirements of features, technical standards and others.
4. The Civil Aviation Authority of Vietnam shall provide instructions on trial operation, supervision and approval for results of trial operation of CNS systems.
Article 27. CNS systems subject to permission for operation
Following CNS systems must get permission from the Civil Aviation Authority of Vietnam before being put into operation:
1. VHF air/ground communication stations (voice or data, or voice and data).
2. HF air/ground communication stations (voice or data).
3. AFTN message switching system.
4. ATN/AMHS

Article 29. Use of CNS services
1. CNS services are set up to ensure safety for civil air navigation.
2. Use of CNS services for general aviation or for activities of official-duty aircraft shall be based on a contract between the CNS service provider and its user.
Article 30. AUTHORIZATION FOR PROVISION OF CNS SERVICES TO FOREIGN ORGANIZATIONS
1. Foreign organizations shall obtain permission from the Civil Aviation Authority of Vietnam before providing CNS services within Vietnam’s airspace, Vietnam-controlled flight information region.
2. The Civil Aviation Authority of Vietnam shall define responsibility for provision of CNS services as prescribed in Clause 1 of this Article.
Article 31. Joint liability for provision and use of CNS

2. The flight operation facility and relevant CNS service provider in the same area shall be responsible for signing the agreement of joint liability for providing and using CNS services, enroute navigation aids and surveillance radar.
3. Approach control offices (or ATC towers) and CNS service providers in the same airport area shall be responsible for signing the agreement of joint liability for providing and using CNS services, enroute navigation aids, aviation lighting system, guidance signs, instrument landing system; Cases of changing runways, modes of using runways and operating aviation lighting systems in specific weather conditions shall be taken into account in the agreement of shared responsibility.
4. The telecommunications services hired by CNS service providers from organizations which are not air navigation service providers should meet the standards as prescribed herein and in the signed contract. In case the services are hired from foreign organizations, the contract shall be submitted to the Civil Aviation Authority of Vietnam for approval.
Article 32. Termination of operation of CNS systems
CNS service providers that need to stop operating CNS systems as prescribed in Article 27 hereof shall make a written request to the Civil Aviation Authority of Vietnam for approval.
Chapter III
CNS STAFF
Article 33. CNS staff
1. CNS staff include:

b) CNS technical officer;
c) Officer in charge of test flying and inspection of navigation aids, aeronautical surveillance.
2. CNS service providers shall be responsible for arranging staff in an adequate and appropriate way.
3. AFTN staff, CNS staff in charge of VHF air/ground communications, staff in charge of test flying and inspection of navigation aids, aeronautical surveillance should be certified by the Civil Aviation Authority of Vietnam.
4. CNS staff shall meet following requirements:
a) Attain appropriate professional qualifications;
b) Complete professional training;
Article 34. Positions and duties of AFTN staff
1. Ensure AFTN messages are received, processed, stored and forwarded in a timely, free and accurate manner.

Article 35. Authority and duties of CNS technical staff
1. CNS technical staff shall be responsible to:
a) Maintain operation of CNS systems as assigned.
b) Carry out maintenance and care of CNS systems as assigned;
c) Monitor technical specifications, performance of CNS systems in operation; immediately deal with problems arising out of operation of CNS systems as assigned; provide technical plans to ensure safety for air navigation and air traffic control;
d) Maintain daily records of operation, maintenance and are of CNS systems as assigned; technical inspection reports;
dd) Be fully on duty and perform other tasks as assigned by superiors.

Article 36. Authority and duties of staff in charge of test flying of navigation aids, aeronautical surveillance system
1. Ensure measurements of parameters of navigation aids, aeronautical surveillance are accurate during test flying process.
2. Notify parameters of navigation aids, aeronautical surveillance system to ground-based technical staff for calibration as prescribed.
3. Certify navigation aids, aeronautical surveillance system inspected and tested.

Article 38. Training
1. CNS service providers shall organize training to update and enhance knowledge for CNS staff.
2. Programs, manners and contents of training provided by the service providers should be compliant with CNS systems’ instruction documents and other relevant legislative documents.
3. Results of training for CNS staff shall be stored for at least five years.

USE OF CIVIL AVIATION RADIO FREQUENCIES
Article 39. Management and use of civil aviation radio frequencies
1. The Civil Aviation Authority of Vietnam:
a) Cooperate with the Authority of Radio Frequency Management – Ministry of Post And Telecommunications in developing Vietnam’s radio spectrum planning;
b) Cooperate with ICAO in developing demands for international civil aviation radio spectrum;
c) Cooperate with agencies at home and abroad, international organizations in establishing plans for use and share of bands, registering international frequencies and handling harmful interferences of civil aviation radio frequencies;
d) Decide use of frequencies in civil aviation airband.
2. Use of radio frequencies for CNS systems, meteorological instruments, search and rescue operations and electrical equipment on aircraft should be compliance with Vietnam’s radio spectrum planning.
3. Except in case of emergency, trial broadcasting of civil aviation radio frequencies shall be carried out after approval is obtained from the Authority of Radio Frequency Management – Ministry of Post And Telecommunications. Official use of radio frequencies shall be accepted after the permit for use of radio frequencies and radio broadcasting equipment is granted by the Authority of Radio Frequency Management – Ministry of Post And Telecommunications.

a) Apply for permission for use of radio frequencies and radio broadcasting equipment from the Authority of Radio Frequency Management – Ministry of Post And Telecommunications according to laws;
b) Cooperate with the Authority of Radio Frequency Management and relevant agencies in detecting and handling harmful interferences;
c) Make reports on harmful interference of radio frequencies at the request of the Civil Aviation Authority of Vietnam.
Article 40. Procedures for registration, coordination and use of civil aviation radio frequencies
1. CNS service providers, Vietnam airlines, foreign airlines that need to use radio frequencies for CNS systems, meteorological equipment and search and rescue operations in civil aviation bands should register with the Civil Aviation Authority of Vietnam.
2. Contents of registration as prescribed in Clause 1 of this Article include use purposes; number of frequencies and expected frequencies; equipment types; bands of equipment; broadcasting capacity; positions of equipment (WGS 84 if any); type, direction and height of antenna over sea level; expected time for putting into operation.
3. Organizations as prescribed in Clause 1 of this Article shall submit applications for permission for use of radio frequencies and radio broadcasting equipment from the Authority of Radio Frequency Management – Ministry of Post And Telecommunications after approval from the Civil Aviation Authority of Vietnam is obtained.
Chapter V
GROUND-BASED AND TEST FLYING AND INSPECTION OF NAVIGATION AND AERONAUTICAL SURVEILLANCE SYSTEMS

Navigation and aeronautical surveillance systems should be inspected and calibrated according to instructions of the manufacturer, ICAO, CNS service providers and the Civil Aviation Authority of Vietnam.
Article 42. Navigation and aeronautical surveillance systems to be inspected and tested airborne

Article 44. Activities of test flying
1. Flight inspection of positions shall be carried out to inspect positions expected for the installation of navigation, aeronautical surveillance systems with the aim of determining impact of the environment on quality of navigation services and surveillance radars expected to be installed.
2. Commission test flying shall be carried out for navigation, aeronautical surveillance systems that have been just installed or considerably repaired, inspected on the ground for testing, inspection and determination of authenticity of signals of the systems in the air.
3. Routine test flying shall be carried out regularly or after maintenance and care under the plan for testing, inspection and determination of authenticity of signals of the systems in the air.
4. Special test flying shall be carried out upon suspicion of a malfunction of the systems, aircraft accidents or other special events and only factors possibly affecting quality of performance of such systems shall be tested. Special test flying may be combined with routine test flying.
5. The Civil Aviation Authority of Vietnam shall make decisions on flight inspection of positions, special test flying, number of routine test flying in a year; stipulate standards, conditions and methods of test flying; grant approval for results of test flying.
Article 45. Aircraft performing test flying
1. The aircraft performing test flying should attain certificates of eligibility for test flying from the Civil Aviation Authority of Vietnam.
2. To obtain the certificates, the aircraft performing test flying should:

b) Attain instrument flying certificates;
c) Be equipped with a type of measurement instruments certified by metrology organizations, and accepted by the Civil Aviation Authority of Vietnam;
d) Be able to transport full pilot crew, main and backup electronic instruments, other ground staff;
dd) Ensure range of operation and endurance to perform test flying as requested;
e) Ensure dynamic stability in the speed range of the aircraft, especially at a practical speed for test flying;
g) Ensure vibration and noise do not exceed permissible limits;
h) Ensure such a low level of electromagnetic noise as to minimize interference of received signal;
i) Be equipped with an electricity system that is capable of feeding necessary electronic instruments in addition to aircraft equipment;
3. Procedures for the issue of certificates of eligibility for test flying shall be the same as airworthiness certificates.

1. The test flying crew shall be composed of at least two pilots and two technical staff. Members of the test flying crew should achieve appropriate level of professional competence; have knowledge and experience in test flying;
2. Members of the test flying crew should obtain permits from the Civil Aviation Authority of Vietnam or from foreign organizations recognized by the Civil Aviation Authority of Vietnam.
Chapter VI
RESPONSIBILITY OF RELEVANT ORGANIZATIONS AND INDIVIDUALS
Article 47. Responsibility of the Civil Aviation Authority of Vietnam
1. Draft and submit legislative documents on CNS services to the Ministry of Transport;
2. Formulate and submit the plan for CNS development to the Ministry of Transport for approval.
3. Organize management of activities of provision of CNS services; formulate planning, plans for investment, construction and installation of CNS systems and implementation.
4. Study and apply ICAO’s regulations, methods and standards on provision of CNS services in accordance with Vietnam’s laws and actual conditions.

6. Issue permits for operation of CNS systems, permits to CNS staff, permits to CNS service providers; grant codes and technical address of CNS systems, electronic instruments on aircraft of Vietnamese nationality.
7. Grant approval for instruction documents from CNS service providers;
8. Announce the list of CNS equipment required for civil aircraft.
9. Direct, inspect and supervise test flying of navigation, aeronautical surveillance systems;
10. Inspect and supervise compliance with regulations on provision of CNS services, electronic instruments on aircraft of Vietnamese nationality; handle violations as prescribed.

4. Design and install CNS works; procure materials and technical systems, facilities, test quality and perform maintenance and care of CNS systems.
5. Propose use, suspension or replacement of CNS systems.
6. Formulate plans for CNS staff training.
7. Draft and instruct use of specialist documents of CNS;
8. Participate in drafting standards, procedures and technical regulations of CNS;
9. Perform other duties as prescribed hereof and in other relevant documents.
Article 49. Airlines
1. Airlines at home and abroad shall be responsible for complying with this Regulation and other law provisions on CNS.
2. Vietnamese airlines that install a CNS system from abroad to serve for its own management and supervision tasks should comply with regulations of the home country.

IMPLEMENTARY PROVISIONS
Article 50. Implementation
The Civil Aviation Authority of Vietnam shall be responsible for inspecting and supervising the implementation of this Regulation.
Article 51. Amendments
The Civil Aviation Authority of Vietnam shall be responsible for making submission to the Minister of Transport for amendments in case of need./.
