ON AMENDMENTS TO SOME ARTICLES OF THE GOVERNMENT’S DECREE NO. 78/2016/ND-CP DATED JULY 01, 2016 ON CONDITIONS FOR PROVISION OF TRAINING FOR CREWMEMBERS AND OPERATORS OF INTERNAL WATERWAY VEHICLES AND GOVERNMENT’S DECREE NO. 08/2021/ND-CP DATED JANUARY 28, 2021 PRESCRIBING MANAGEMENT OF INLAND WATERWAY-RELATED ACTIVITIES

Pursuant to the Law on Government Organization dated June 19, 2015; Law dated November 22, 2019 on Amendments to some Articles of the Law on Government Organization and Law on Local Government Organization;

Pursuant to the Law on Inland Waterway Transport dated June 15, 2004; Law dated June 17, 2014 on Amendments to some Articles of the Law on Inland Waterway Transport;

At the request of the Minister of Transport;

The Government hereby promulgates a Decree on amendments to some Articles of the Government’s Decree No. 78/2016/ND-CP dated July 01, 2016 on conditions for provision of training for crewmembers and operators of internal waterway vehicles and Government’s Decree No. 08/2021/ND-CP dated January 28, 2021 prescribing management of inland waterway-related activities.

Article 1. Clause 2 Article 11 of the Government’s Decree No. 78/2016/ND-CP dated July 01, 2016 on conditions for provision of training for crewmembers and operators of internal waterway vehicles is abrogated.

Article 2. Amendments to some Articles of the Government’s Decree No. 08/2021/ND-CP dated January 28, 2021 prescribing management of inland waterway-related activities

“2. Port authorities affiliated to the Vietnam Inland Waterways Administration shall exercise their functions of state specialized management at ports, landing stages (except for river-crossing passenger landing stages) and anchorage areas announced and licensed for operation on national inland waterways and specialized inland waterways connected to national inland waterways; ports, landing stages, land and water anchorage areas both on national inland waterways and local inland waterways; ports, landing stages and anchorage areas within seaport waters assigned by the Ministry of Transport.”

2. Clause 3 of Article 65 is amended as follows:

“3. Port authorities affiliated to Departments of Transport or authorities and units assigned at localities that does not have inland waterways port authorities affiliated to Departments of Transport shall exercise their functions of state specialized management at ports, landing stages (except for river-crossing passenger landing stages) and anchorage areas announced and licensed for operation on national inland waterways and specialized inland waterways connected to national inland waterways; ports, landing stages and anchorage areas within seaport waters of localities’ administrative divisions assigned by the Ministry of Transport; ports, landing stages and anchorage areas specified in clause 2 of this Article as decentralized by the Minister of Transport in accordance with regulations.”

Article 3. Effect and implementation

1. This Decree comes into force from November 01, 2022.

2. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities shall provide guidance and implement this Decree.
