DECISION

ON THE ESTABLISHMENT OF THE STATE EVALUATION COUNCIL FOR INVESTMENT PROJECTS

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to the Resolution of the 8th Session of the IXth National Assembly on November 20, 1995;
At the proposal of the Minister-Chairman of the Government Commission on Organization and Personnel,

DECIDES:

Article 1.- To establish the State Evaluation Council for Investment Projects (State Evaluation Council for short) to provide consultancy for the Prime Minister on those investment projects which are to be decided by the Prime Minister.

The State Evaluation Council is composed of:

- President of the Council: Minister Dau Ngoc Xuan.

- Depending on each specific project, the President of the Council shall invite the authoritative representatives of other Ministries and the Presidents of the People's Committees of the concerned provinces or cities directly under the Central Government to take part in evaluating the project.

Article 2.- The State Evaluation Council has the following main tasks and powers:

- To organize the evaluation of investment projects and submit them to the Prime Minister for consideration and decision.

- If necessary, to request the project owners to supplement, amend and supply documents and dossiers concerning the project to help in the evaluation of the project.

- To invite local and foreign specialists to comment on the contents of the project.

Article 3.- The Council is assisted in its work by a group of specialists who are in the staff of the Office of the Government. The work place, funding and equipment of the Council shall be provided by the Office of the Government.

The President of the Council shall issue concrete regulations on its working procedure.

Article 4.- This Decision takes effect from the date when it is signed into effect.

The Minister-President of the State Evaluation Council, the other Ministers, the Heads of ministerial-level agencies, the Heads of the agencies attached to the Government, and the Presidents of the People's Committees of the provinces and cities directly under the Central Government shall have to implement this Decision.
