DECISION

ON FINANCIAL SUPPORT FOR UNIONISTS AND EMPLOYEES IMPACTED BY COVID-19

PRESIDIUM OF VIETNAM GENERAL CONFEDERATION OF LABOUR

- Pursuant to the Trade Union Law 2012;

- Pursuant to the Law on State Budget 2015;

- Pursuant to the Regulation of Vietnam Trade Union 2018;

- Pursuant to the Government’s Decree No. 191/ND-CP dated November 21, 2013 on elaboration of trade union finance;

- Pursuant to Resolution No. 128/NQ-CP dated October 11, 2021 of the Government on promulgation of Interim regulations on “Safe and flexible adaption to and effective control of COVID-19”;

- At the request of the Board of Labour Relations, the Finance Department of the Vietnam General Confederation of Labour,

HEREBY DECIDES

Article 1. To offer financial support to unionists and employees impacted by Covid-19

Federations of provinces and cities, trade unions of ministries and central branches and equivalence, trade unions of general corporations affiliated to the General Confederation; superior trade unions of grassroots trade unions are entitled to provide financial support for unionists and employees impacted by Covid-19 as follows:

1. Unionists and employees who are F0 patients and do not commit any violations against anti-Covid-19 regulations may receive:

a) Up to VND 3,000,000 per person if they have severe symptoms that require at least 21 days of treatment at designated hospitals or health facilities according to written certification by the competent health authorities.

b) Up to VND 1,500,000 per person if they have to be outpatients for at least 21 days or inpatients for less than 21 days at designated hospitals or health facilities according to written certification by the competent health authorities.

2. If a unionist or employee who has paid the trade union fee to his company or agency dies from Covid-19, his/her relative may receive a financial support of VND 5,000,000.

3. Regarding other cases impacted by Covid-19 that also need financial support, Standing board of Federations of provinces and cities, trade unions of ministries and central branches and equivalence, trade unions of general corporations affiliated to the General Confederation; superior trade unions of grassroots trade unions may, on their own initiative, make decisions on financial support in consideration of regulations on for financial delegation of the General Federation depending upon the Covid-19 circumstances and the sources of trade union finance that have been approved in the year.

1. Union representatives of superior trade unions, or unionists and employees who are mobilized by the superior trade unions to join the fight against Covid-19 may receive a financial support of VND 100,000 to 150,000/person/day, including days off and holidays, depending on the nature, work and days of participation but not exceeding VND 2,000,000/person/year. The standing boards of trade unions shall make and take responsibility for their own decisions.

2. Representatives of trade unions of companies and agencies may receive: a financial support of VND 80,000 to 120,000/person/day, including days off and holidays, depending on the nature, work and days of participation but not exceeding VND 1,500,000/person/year. The executive board of grassroots-level trade union shall, based on the approved budget, make and take responsibility for their own decision.

3. If a union representative joining the fight against Covid-19 has Covid-19, he/she may receive the financial support as prescribed in Article 1 of this Decision.

Article 3. Rules for support

Each F0 patient may only receive one financial support regardless how many time they have tested positive for Sars-CoV-2. Any person who is eligible for multiple support amounts as specified in Article 1 of this Decision may only receive the highest one. If a person who received a financial support as a F0 patient dies from Covid-19, his/her relative may receive the support as prescribed in Article 2 of this Decision.

Article 4. Sources of funds

Funding sources for support according to this Decision (excluding clause 2 Article 2) are allocated in the confederation expenditure and revenue estimates, accumulated finance and resources from private sectors in federations of provinces and cities, trade unions of ministries and central branches and equivalence, trade unions of general corporations affiliated to the General Federation; superior trade unions of grassroots trade unions. In case entities fail to balance revenues and expenditures and need finance from General Confederation, report to General Confederation for consideration.

Article 5. Implementation

1. This Decision comes into force as of the date of signing.

3. If unionist and employees who meet the support eligibility requirements under Decision No. 2606/QD-TLD or Decision No. 3022/QD-TLD have their support claims received by the trade unions before the date of entry of this Decision, then proceed the support process.

4. If a unionist or employee has tested positive for Sars-CoV-2 before the effective date of this Decision but his/her treatment duration goes beyond the mentioned effective date, and besides he/she has not received the support while meeting the support eligibility requirements as prescribed in clause 1 Article 1 of this Decision, then proceed the support process for him/her.

5. Pursuant to this Decision, standing boards of federations of provinces and cities, trade unions of ministries and central branches and equivalence, trade unions of general corporations affiliated to the General Confederation shall promulgate guidelines to trade unions at all levels in a public and transparent manner with eligible persons as prescribed applicable state regulations and regulations of the General Federation and not higher than the statutory support amounts in this Decision. Send monthly or ad-hoc reports to the General Federation for consolidation.

6. Departments, the Office of the Inspection Committee, the Office of the Vietnam General Confederation of Labour; entities affiliated to the Vietnam General Confederation of Labor; Confederations of provinces and cities, trade unions of ministries and central branches and equivalence, trade unions of general corporations affiliated to the General Confederation and shall implement this Decision./.
