Quyết định số 2950/QĐ-BTNMT được Bộ Tài nguyên và Môi trường ban hành ngày 28 tháng 12 năm 2020 về việc phê duyệt Chương trình xây dựng và ban hành văn bản quy phạm pháp luật năm 2021 thuộc phạm vi quản lý nhà nước của Bộ Tài nguyên và Môi trường. Quyết định này đóng vai trò định hướng, xác định danh mục và tiến độ xây dựng các văn bản pháp luật trọng tâm trong lĩnh vực tài nguyên và môi trường cho năm 2021.
Phạm vi và đối tượng áp dụng
Quyết định áp dụng đối với các đơn vị trực thuộc Bộ Tài nguyên và Môi trường, các cơ quan, tổ chức và cá nhân có liên quan đến công tác xây dựng, ban hành và tổ chức thực hiện văn bản quy phạm pháp luật trong các lĩnh vực quản lý nhà nước của Bộ.
- Phê duyệt Chương trình xây dựng văn bản quy phạm pháp luật năm 2021
- Thông qua danh mục các dự án luật, nghị quyết của Quốc hội; nghị định của Chính phủ; quyết định của Thủ tướng Chính phủ và thông tư của Bộ trưởng Bộ Tài nguyên và Môi trường dự kiến ban hành hoặc trình cấp có thẩm quyền ban hành trong năm 2021.
- Các lĩnh vực trọng tâm bao gồm: đất đai, tài nguyên nước, địa chất và khoáng sản, bảo vệ môi trường, khí tượng thủy văn, biến đổi khí hậu, đo đạc và bản đồ, quản lý tổng hợp tài nguyên và bảo vệ môi trường biển và hải đảo.
- Trách nhiệm của các đơn vị chủ trì soạn thảo
- Các đơn vị được giao chủ trì soạn thảo có trách nhiệm trực tiếp chỉ đạo, phân công nhiệm vụ cụ thể cho các cán bộ, công chức tham gia xây dựng văn bản; bảo đảm tiến độ, chất lượng và tính khả thi của dự thảo.
- Tổ chức lấy ý kiến rộng rãi của các cơ quan, tổ chức, cá nhân chịu sự tác động trực tiếp của văn bản; nghiêm túc tiếp thu, giải trình các ý kiến góp ý để hoàn thiện dự thảo.
- Phối hợp chặt chẽ với Vụ Pháp chế và các cơ quan liên quan trong suốt quá trình soạn thảo, thẩm định và trình ban hành văn bản.
- Vai trò giám sát và phối hợp của Vụ Pháp chế
- Vụ Pháp chế có trách nhiệm theo dõi, đôn đốc, kiểm tra tình hình thực hiện Chương trình của các đơn vị; kịp thời phát hiện các vướng mắc, khó khăn để báo cáo Lãnh đạo Bộ xem xét, giải quyết.
- Chủ trì tổ chức thẩm định các dự thảo thông tư thuộc thẩm quyền ban hành của Bộ trưởng; tham gia ý kiến đối với các dự thảo văn bản quy phạm pháp luật do các đơn vị khác chủ trì soạn thảo trước khi trình cấp có thẩm quyền.
- Bảo đảm nguồn lực tài chính và điều kiện thực hiện
- Bố trí kinh phí từ nguồn ngân sách nhà nước dành cho công tác xây dựng văn bản quy phạm pháp luật năm 2021, bảo đảm sử dụng đúng mục đích, hiệu quả và đúng quy định tài chính hiện hành.
- Ưu tiên nguồn lực, nhân sự có trình độ chuyên môn cao tham gia vào các Ban soạn thảo, Tổ biên tập đối với các văn bản quy phạm pháp luật quan trọng, có tầm ảnh hưởng lớn đến phát triển kinh tế - xã hội.
- Hiệu lực thi hành
Quyết định số 2950/QĐ-BTNMT có hiệu lực thi hành kể từ ngày ký (ngày 28 tháng 12 năm 2020). Chánh Văn phòng Bộ, Vụ trưởng Vụ Pháp chế, Thủ trưởng các đơn vị trực thuộc Bộ và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này.

APPROVING THE PROGRAM FOR FORMULATION AND PROMULGATION OF LEGISLATIVE DOCUMENTS IN 2021 UNDER THE MANAGEMENT OF THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT
THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Pursuant to the Law on Promulgation of legislative documents dated June 22, 2015;
Pursuant to the Government's Decree No. 34/2016/NĐ-CP dated July 01, 2016 on elaboration and implementation of the Law on Promulgation of Legislative Documents;
Pursuant to the Government's Decree No. 36/2017/NĐ-CP dated April 04, 2017 defining the functions, tasks, entitlements and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to the Prime Minister’s Directive No. 43/CT-TTg dated December 11, 2020 on improvement of quality of the legal system and effectiveness law enforcement;
Pursuant to the Prime Minister’s Decision No. 2197/QĐ-TTg dated December 22, 2020 on promulgation of the List of documents elaborating the Laws and Resolutions ratified by the 14th National Assembly during its 10th session and drafting authorities thereof;

At the request of the Director of the Legal Department.
DECIDES:
Article 1. Approving the program for formulation and promulgation of legislative documents in 2021 under the management of the Ministry of Natural Resources and Environment (hereinafter referred to as “the Program”), including:
1. Legislative documents to be submitted to the Government and the Prime Minister (List No. 1 enclosed herewith).
2. Legislative documents to be promulgated by the Minister of Natural Resources and Environment (List No. 2 enclosed herewith).
3. Regarding legislative documents other than those mentioned in Clause 1 and Clause 2 of this Article, the heads of the proposing units shall cooperate with the Director of the Legal Department in proposing their inclusion in the Program to the Minister, provided the drafts are qualified and can be completed on schedule.
Article 2. Responsibilities of the Minister, Deputy Ministers and heads of units for implementation of the Program
1. The Minister and Deputy Ministers shall directly preside the process of formulation and submission or promulgation of legislative documents in their fields.
The Deputy Ministers shall act as chiefs of drafting boards of the Government’s Decrees and Prime Minister’s Decisions in their fields, except in special cases that are decided by the Minister.

a) Follow the procedures for formulation of legislative documents as prescribed by law; adhere to the schedule for formulation and submission; ensure quality of the legislative documents they formulate;
b) Act as deputy chiefs of drafting boards of the Government’s Decrees and Prime Minister’s Decisions, and chiefs of drafting boards of the Minister’s Circulars;
c) Take accountability to the Minister for the punctuality and quality of the legislative documents they are in charge of; inform the Minister or Deputy Minister in charge of any difficulties that arise during the drafting process for consideration and assistance in order to ensure punctuality and quality as per regulations.
3. The outcomes of the Program are one of the criteria for performance evaluation, award of honorary titles and commendations to relevant organizations, units and individuals, especially the heads.
4. Director of the Planning – Finance Department shall take charge and cooperate with the Director of the Legal Department in proposing the order of priority in provision of funding for formulation and promulgation of legislative documents to the Minister in order to ensure implementation and completion of the Program; carry out specialized appraisal of the draft legislative documents on economic-technical and financial norms;
5. The Director of the Legal Department shall comment on and examine the legal aspects of draft legislative documents; monitor, inspect the implementation of the Program; submit monthly reports on implementation of the Program to the Minister by the 20th every month.
6. The Director of the Science and Technology Department shall carry out technical appraisal of the draft legislative documents on technical regulations.
7. Directors of Personnel Department, Commendation and Propagation Department shall submit reports on their performance, award of honorary titles and commendations to the heads according to the criteria mentioned in Clause 3 of this Article.
8. Directors of Provincial Departments of Natural Resources and Environment shall assume responsibility and participate in the formulation process and comment on the draft legislative documents mentioned in Article 1 of this Decision; seek opinions form relevant organizations and individuals and offer comments when requested.
