ON PROMULGATION OF THE LIST OF STATE SECRETS IN INFORMATION TECHNOLOGY AND COMMUNICATIONS

THE PRIME MINISTER

Pursuant to the Law on Organization of Government dated June 19, 2015;

Pursuant to Law on amendments to the Law on Organization of Government and the Law on Organization of Local Governments dated November 22, 2019;

Pursuant to the Law on State Secrets Protection dated November 15, 2018;

At the request of the Minister of Information Technology and Communications.

HEREBY DECIDES:

1. Documents on radio frequency planning for national defense and security; documents exchanged between Ministry of Information Technology and Communications and the Ministry of National Defense, the Ministry of Public Security regarding frequency interference handling for national defense and security duties; schemes and documents exchanged related to determination of frequency zones at sea to initiate the security and safety protection at Vietnam’s seas.

2. Technical design, call signs, codes, and communication conventions of private information network system for agencies and organizations of the Party and State; frequencies, call signs, codes, and communication conventions of the special system of telegraph networks serving Party and State agencies.

3. Technical design of important telecommunications works related to national security.

4. Conventions, passwords, encryption keys on ensuring security and safety of computer systems and ensuring safety of emergency response activities of computer systems in cyberspace of Party and State agencies.

5. Coordinating documents, detailed plans and plans for handling cyber security incidents of level 3, level 4 with large influence or level 5; documents, reports on security vulnerability and risks of information insecurity for important national information systems.

6. Proposals and plans for initiation of measures to safeguard information security for national, international, and regional events held in Vietnam with the participation of the heads of state.

7. Plans for broadcasting in case the State declares a state of war or a state of emergency.

8. Documents that direct and administer press, publishing, broadcasting and electronic information, cyber information security, news, foreign affair information, and grassroots information in service of national security, social order and safety, and public health that have not been made public.

9. Reports, documents that seek direction, documents exchanged between the Ministry of Information and Communications and ministries, departments and agencies on information that is contrary to the views of the Party and State; distorted and forged information related to Party and State leaders.

11. Reports on assessment and proposal of propagation measures for foreign press that contain information contrary to the views of the Party and the State which has not yet been made public.

12. Documents on appraisal and direction in the process of handling documents and publications in violation of Clause 1, Article 10 of the Law on Publishing.

Article 2. Entry in force

This Decision comes into force as of the date of signing.

Article 3. Implementation

1. The Minister of Information and Communications shall take charge and cooperate with the Minister of Public Security in guiding and inspecting the implementation of this Decision.

2. Ministers, heads of ministerial-level agencies, heads of governmental agencies, Presidents of People's Committees of provinces and centrally affiliated cities, and relevant individuals and organizations shall implement this Decision./.
