DECISION

ON APPROVAL OF INLAND CONTAINER DEPOT SYSTEM DEVELOPMENT PLANNING IN VIETNAM BY 2020 WITH AN ORIENTATION TO 2030

PRIME MINISTER

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Government's Decree No. 154/2005/ND-CP dated December 15, 2005 on customs procedures, inspection and supervision;

Pursuant to the Decree No. 92/2006/ND-CP dated September 07, 2006 on making, approval and management of overall socio-economic development planning; the Decree No. 04/2008/ND-CP dated January 11, 2008 on amendments to certain articles of the Decree No. 92/2006/ND-CP dated September 07, 2006 by the Government;

At the request of the Ministry of Transport (the Statement No. 9217/TTr-BGTVT dated December 31, 2009) on inland container depot system development planning in Vietnam by 2020 with an orientation to 2030,

1. Development viewpoints and objectives

a) Development viewpoints

- Inland container depot (ICD) is a part of the transport infrastructure associated with the seaport operations and other infrastructure systems; the development of ICD shall be in line with the seaport system development planning, transport network development planning and regional and local socio-economic development planning;

- ICD development shall satisfy the demands for goods import and export of each area and economic corridor, especially for those transported by container vehicles;

- ICD development shall ensure the close cooperation between relevant ministries and local authorities in ICD management and operation, especially in the course of selecting specific locations for ICD construction;

- During the period from now to 2016, ICDs shall be given priority to develop and assist Hai Phong seaport and Ba Ria - Vung Tau seaport.

b) Development objectives

- General objectives:

To gradually form and develop the ICD system in order to meet the needs of transporting imports and exports, facilitate capacity of clearance for seaports; organize transport of containers properly to cut freights and inventory period at seaports and ensure goods safety; contribute to reduce traffic congestion, especially in big cities.

+ By 2020, the ICD system is expected to reach the capacity of approximately 6 million TEU per year, in which: 1.2 million TEU per year for the northern region, 600,000 TEU per year for the central region and 4.2 million TEU per year for the southern region;

2. Contents of the planning

a) ICD functions

- Receiving and consigning goods transported by container vehicles;

- Packing and unloading of containers;

- Transportation of cargo containers from ICDs to seaports and vice versa;

- Checking and completing customs procedures for exports and imports;

- Consolidating and dividing cargoes for multiple consignors in the same container;

- Temporary warehouses for storing exports, imports and empty containers;

b) Criteria for formation of ICDs

- ICDs are formed on the basis of the demand for economic development of regions with a large volume of containerized exports and imports (over 50,000 TEU) or at international checkpoints or areas having traffic congestion caused by means of transport (over 30,000 TEU);

- ICDs shall be connected with seaports by at least 2 modes of transport in order to facilitate multimodal transportation (priority shall be given to ICDs located in areas associated with modes of high transport capacity);

- ICDs shall connect conveniently with the transport system, utilize properly modes of transport in a cost-effective manner and ensure safety in the transport process;

- ICDs shall ensure sufficient land fund to meet the needs of long-term development (at least 10ha);

- ICDs shall ensure sufficient area to arrange workplaces for concerned authorities and organizations;

- ICDs shall ensure the compliance with regulations of law on environmental protection, technology, national security, fire safety and construction investment in accordance with regulations of law in the course of construction and operation.

c) The ICD system planning in Vietnam shall be made by 2020 with an orientation to 2030 as follows:

- In the North: Five ICDs are expected to be established in the following economic zones and corridors:

+ Hanoi - Lao Cai economic corridor is expected to reach the capacity of approximately 20 - 30 ha by 2020 and over 70 ha after 2030; serving mainly Lao Cai, Yen Bai, Phu Tho, Vinh Phuc, Tuyen Quang and Ha Giang; capacity of goods clearance is expected to reach about 720,000 TEU per year, mainly passing through Hai Phong port and Hon Gai port;

+ Hanoi - Lang Son economic corridor is expected to reach the capacity of approximately 20 - 30 ha by 2020 and over 50 ha after 2030; serving mainly Lang Son, Cao Bang, Bac Giang and Bac Ninh; capacity of goods clearance is expected to reach about 550,000 TEU per year, mainly passing through Hon Gai port and Hai Phong port;

+ Northwest Hanoi economic zone is expected to reach the capacity of approximately 10-20 ha by 2020 and over 40 ha after 2030; serving mainly Hanoi, Phu Tho, Hoa Binh, Son La, Dien Bien and Lai Chau; capacity of goods clearance is expected to reach about 380,000 TEU per year, mainly passing through Hai Phong port and Hon Gai port;

+ Southeast Hanoi economic zone is expected to reach the capacity of approximately 40-50 ha by 2020 and over 100 ha after 2030; serving mainly Hanoi, Bac Ninh, Hai Duong, Hung Yen, Thai Nguyen and Bac Can; capacity of goods clearance is expected to reach about 1.3 million TEU per year, mainly passing through Hai Phong port and Hon Gai port.

- In the central and central highlands: Five ICDs shall be established in the following economic zones and corridors:

+ Nghi Son economic zone is expected to reach the capacity of approximately 10-20 ha by 2020 and over 30 ha after 2030; serving mainly Thanh Hoa, Nghe An, Ninh Binh, Hoa Binh and Son La; capacity of goods clearance is expected to reach about 260,000 TEU per year, mainly passing through Nghi Son port and Cua Lo port;

+ Economic corridors on road No. 8 and road No. 12A are expected to reach the capacity of 10-20 ha by 2020 and over 30 ha after 2030; serving mainly Nghe An, Thanh Hoa, Ha Tinh and Quang Binh; capacity of goods clearance is expected to reach about 330,000 TEU per year, mainly passing through Vung Ang - Son Duong port, Cua Lo port and Hon La port;

+ Economic corridor on road No. 9 is expected to reach the capacity of 10 - 20 ha by 2020 and over 30 ha after 2030; serving mainly Quang Tri, Quang Binh and Thua Thien Hue; capacity of goods clearance is expected to reach about 280,000 TEU per year, mainly passing through Hon La port and Chan May port;

+ Da Nang - Hue economic zone and road No. 14B corridor are expected to reach the capacity of approximately 20-30 ha by 2020 and over 60 ha after 2030; serving mainly Da Nang, Thua Thien Hue, Quang Nam and Quang Ngai; capacity of goods clearance is expected to reach about 550,000 TEU per year, mainly passing through Da Nang port, Ky Ha port and Chan May port;

- In the South: Three ICDs shall be established in the following economic zones and corridors:

+ Northeast Ho Chi Minh City economic zone is expected to reach the capacity of over 150 ha by 2020 and over 400 ha after 2030; serving mainly Ho Chi Minh City, Dong Nai, Ba Ria-Vung Tau, Binh Thuan, Binh Duong, Binh Phuoc, Tay Ninh, Dak Nong and Lam Dong; capacity of goods clearance is expected to reach about 6 million TEU per year, mainly passing through Ba Ria-Vung Tau port cluster and Ho Chi Minh City port cluster;

+ Southwest Ho Chi Minh City economic zone is expected to reach the capacity of over 70 ha by 2020 and over 150 ha after 2030; serving mainly Ho Chi Minh City, Long An, Tien Giang, Vinh Long, Dong Thap and Ben Tre; capacity of goods clearance is expected to reach about 1.7 million TEU per year, mainly passing through Ho Chi Minh City port cluster, Ba Ria-Vung Tau port cluster and My Tho port cluster;

+ Mekong delta economic zone is expected to reach the capacity of approximately 40-50 ha by 2020 and over 100 ha after 2030; serving mainly Can Tho, Tra Vinh, Hau Giang, Vinh Long, Kien Giang, Ca Mau, Bac Lieu, Soc Trang, An Giang; capacity of goods clearance is expected to reach about 1.1 million TEU per year, mainly passing through Can Tho port and My Thoi port.

3. Major solutions and policies

- Mobilize all domestic and foreign resources for the development of the ICD system an interconnected transport system; facilitate enterprises of all economic sectors to invest in ICD construction and operation in the forms prescribed by regulations of law;

- Improve regulations on operation lease of ICDs invested by the state capital;

- Continue enhancing the reform of administrative procedures, creating a favorable environment for investment in ICD construction and operation in accordance with integration process and normal international practice;

- Enhance state management in the process of executing the ICD system development planning in line with construction planning, general planning for socio-economic development and other planning of local authorities.

1. The Ministry of Transport shall:

- Develop regulations on management of ICD operation and submit them to the Prime Minister for consideration;

- Take charge and cooperate with relevant ministries, authorities, People’s Committees of provinces/central-affiliated cities and organizations in carrying out the ICD system development planning by 2020 with an orientation to 2030; provide guidelines for organizations and individuals to comply with regulations of law on ICD construction investment and operation; conduct periodic inspections to evaluate the planning implementation; request the Prime Minister to consider making a decision on adjustment of the planning to match with actual requirements in case of any changes in the society, economy and goods flow.

2. The Ministry of Finance shall have to guide the procedures and decide the establishment of customs clearance sites at ICDs.

3. Ministries, authorities and People’s Committees of provinces, within their functions, tasks and power, shall cooperate with the Ministry of Transport in carrying out objectives of the ICD system development planning in order to ensure the consistency of development planning and plans made in provinces.

4. People’s Committees of provinces/central-affiliated cities shall allocate the land fund to construct ICDs in line with the approved planning; cooperate with the Ministry of Transport in providing guidelines for organizations and individuals to comply with regulations of law on ICD construction investment and operation.

Article 3. This Decision comes into force from the signing date.

Article 4. Relevant ministers, heads of ministerial authorities, heads of governmental authorities and Chairpersons of People’s Committees of provinces/central-affiliated cities shall implement this Decision.
