DECISION

AUTHORIZING THE MANAGEMENT BOARD OF MOC BAI BORDER-GATE ECONOMIC ZONE, TAY NINH PROVINCE, TO PERFORM THE COSMETICS MANAGEMENT FUNCTION IN THE TRADE-INDUSTRY ZONE OF MOC BAI BORDER-GATE ECONOMIC ZONE,TAY NINH PROVINCE

THE MINISTER OF HEALTH

Pursuant to the Governments Decree No. 188/2007/ND-CP of December 27, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Health;
Pursuant to the Governments Decree No. 179/2004/ND-CP of October 21, 2007, providing for state management of goods quality;
Pursuant to the Prime Minister s Decision No. 140/2007/QD-TTg of August 24, 2007, promulgating the Operation Regulation of Moc Bai border-gate economic zone, Tay Ninh province;
Pursuant to the Prime Ministers Decision No. 236/QD-TTg of February 26, 2008, establishing, and defining the position and Junctions of, the Management Board of Moc Bai border-gate economic zone, Tay Ninh province;
At the proposal of the Peoples Committee of Tay Ninh province in Official Letter No. 1956/UBND-KHTH of May 19, 2008, on authorization of cosmetics examination in the trade-industry zone of Moc Bai border-gate economic zone, Tay Ninh province;

At the proposal of the director of the Drug Administration of Vietnam,

DECIDES:

Article 1. The Ministry of Health authorizes the Management Board of Moc Bai border-gate economic zone, Tay Ninh province, to perform the cosmetics management function in the trade-jndustry zone of Moc Bai border-gate economic zone, Tay Ninh province.

Article 2. The Management Board of Moc Bai border-gate economic zone, Tay Ninh province, shall coordinate with the Health Service of Tay Ninh province in guiding, examining and inspecting cosmetics trading activities in the trade-industry zone of Moc Bai border-gate economic zone, Tay Ninh province.

Article 3. Organizations and individuals trading cosmetics in the trade-industry zone of Moc Bai border-gate economic zone, Tay Ninh province, shall declare cosmetics quality standards to the Management Board of Moc Bai border-gate economic zone, Tay Ninh province, and shall commit to taking full responsibility for the quality of their traded cosmetics.

Article 4. The introduction of cosmetics from the trade-industry zone of Moc Bai border economic zone, Tay Ninh province, into other functional zones of Moc Bai border-gate economic zone, Tay Ninh province, and the domestic market for sale must comply with the Regulation on cosmetics management, promulgated together with the Health Ministers Decision No. 48/2007/QD-B YT of December 31, 2007, and other concerned relevant documents.

Article 5.This Decision takes effect 15 days after its publication in CONG BAO.

Article 6. The director of the Office and the Chief Inspector of the Ministry of Health, the director of the Drug Administration of Vietnam, the director of the Health Service of Tay Ninh province and the head of the Management Board of Moc Bai border-gate economic zone, Tay Ninh province, shall implement this Decision.
