REGARDING THE FUNCTIONS, DUTIES, AUTHORITIES AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL FISHERIES QUALITY ASSURANCE AND VETERINARY DIRECTORATE (NAFIQAVED)

Pursuant to Decree 86/2002/ND-CP dated 5 November 2003 of Government regulating the functions, duties, authorities and organizational structure of Ministries and ministerial-level agencies,
Pursuant to Decree 43/2003/ND-CP dated 2 May 2003 of Government regulating the functions, duties, authorities and organizational structure of Ministry of Fisheries,
Considering the proposals of Director of Organization and Personnel

HAS DECIDES:

Article 1. Position and function

The National Fisheries Quality Assurance and Veterinary Directorate (NAFIQAVED) is an organization to assist the Minister in State management of fish quality, hygiene and safety and veterinary service from the material production to consumption stages in order to prevent fish disease, ensure fish quality, hygiene and safety and ensure the health of the consumers.

NAFIQAVED has its own stamp and account settled in State Treasure and Bank.

It is located in Ha Noi city.

Article 2. Duties and authorities

1. It shall formulate and submit the long-term and annual strategies, development masterplan, plans, programmes and projects on quality, hygiene and safety and veterinary of fish to the Minister.

2. It shall make proposals and submit to the Minister the draft legal normative documents on fish quality, hygiene, safety and veterinary as assigned by the Minister.

3. It shall carry out the legal normative documents according to its assigned functions and duties.

4. It shall monitor and examine the enforcement of legal normative documents, strategies, masterplans, plans, projects and proposals on revision, insertion or compilation of legal normative documents on fish quality, hygiene, safety and veterinary.

5. It shall control the fish quality,safety and hygiene by doing the followings:

a. Examining, recognizing or its cancellation of conditions of fish hygiene and safety of:

- fishing vessels, fishing ports, fish markets, fish collection units, preservation units, processing and trade units.

b. Examining and granting national certification of fish materials and products  as stated by legislation.

c. Controlling the affect of plant protection drugs (pesticides), industrial waste, and other waste impacting the aquaculture environment. It shall propose timely to functionary agencies for timely treatment.

6. It shall control the fish veterinary work  by doing the followings:

a. Guiding and implementing the fish disease prevention and elimination of fish disease origin. Proposing the proclamation and its cancellation of fish disease as set out by legislation. Coordinating with relevant agencies in applying measures to restore the environment after the elimination of fish disease.

b. Directing and implementing the plant and animal quarantine for import and export and movement inside the country as set out by legislation.

c. Monitoring and examining the experiment and tests of fish fry, feed, drugs, chemicals and bioproducts within its competence. Making regulations on the list of species subjected to quarantine and the list the fish fry, feed, drugs, chemicals and bioproducts used in aquaculture that are prohibited to import and export and restricted to import and export.

d. Examining and recognizing or canceling the recognition of disease -free status of aquaculture sites, production units for feed, veterinary drugs, chemicals and bio-products served to aquaculture purposes.

e. Examining and giving certification of disease-free feed, veterinary drugs, chemicals and bioproducts served to aquaculture purposes.

7. It shall grant, withdraw all kinds of licenses, certificate regarding the fish quality assurance and fish veterinary service; license on import and export of fish fry, feed, veterinary  drugs, chemicals and bioproducts used in aquaculture as regulated by legislation.

It shall recognize the labs testing fish quality, hygiene and safety and labs testing the fish disease as set out by legislation.

9. It shall study and apply technological and scientific advances in the control of fish quality, hygiene and safety and fish veterinary service.

10. It shall conduct international cooperation in fish quality, hygiene and safety and fish veterinary, shall sign or submit to competent authorities for signing of cooperation documents as stated by legislation.

11. It shall inspect, check and take action to the violation of fisheries sector within its jurisdiction as stated by legislation as assigned.

12. It shall direct and undertake the refresher courses on quality, hygiene, safety and veterinary of fish for the officers.

13. It shall conduct the services related to fish veterinary, quality, hygiene and safety as set out by legislation.

14. It shall manage and use of personnel, properties and finance of the Directorate and subordinate units as set out by legislation.

It shall, in unified manner, manage the expertise and operation results  of organizational system  under the jurisdiction of Directorate of locality.

15. It shall conduct other duties as assigned by the Minister.

Organizational structure of the Directorate of Fish quality assurance and veterinary shall include:

1. Office of the Directorate

2. Information and international cooperation division

3. Division on fish quality

4. Division on fish veterinary

5. Division on test control

6. Division on technical services on fish quality and veterinary.

7. Department of fish quality and veterinary located in focal fisheries places such as Hai Phong, Da Nang, Khanh Hoa, Ho Chi Minh city, Ca Mau and Can Tho.

This Decision shall be effective 15 days after being posted on the Gazette and it shall replace Decision 648TS/QD dated 26 August 1994 of the Minister of Fisheries regulating the duties, functions, authorities and organizational structure of NAFIQACEN (center for national fisheries inspection and assurance).

Article 5. Executive duties

Director of the Directorate of Fish quality and assurance and veterinary shall be in charge of coordination with other relevant units to set up the Project on the organization of fish quality and veterinary at the localities, shall set up the rules of organization and operation of the Directorate to present to Minister for decision.

Head of Cabinet, Director of the Directorate of Fish quality and assurance and veterinary, heads of departments and units under Ministry of Fisheries, directors of Fisheries Departments, Division of Fisheries under Departments of Agriculture and Rural Development shall be in charge of implementation of this Decision.
