CIRCULAR
FEES FOR EXTRACTION AND USE OF INFORMATION AND DATA ON TOPOGRAPHY AND CARTOGRAPHY AND COLLECTION, PAYMENT, TRANSFER, EXEMPTION, MANAGEMENT, AND USE THEREOF
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016 on elaboration and guidance on enforcement of some articles of Law on Fees and Charges; the Government’s Decree No. 82/2023/ND-CP dated November 28, 2023 on amendments to some articles of the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016 on elaboration and guidance on enforcement of some articles of Law on Fees and Charges;
Pursuant to the Government’s Decree No. 27/2019/ND-CP dated March 13, 2019 on elaboration of some articles of Law on Topography and Cartography; the Government’s Decree No. 136/2021/ND-CP dated December 31, 2021 on amendments to some articles of the Government’s Decree No. 27/2019/ND-CP dated March 13, 2019 on elaboration of some articles of Law on Topography and Cartography;
Pursuant to the Government’s Decree No. 126/2020/ND-CP dated October 19, 2020 on elaboration of some articles of Law on Tax Administration; the Government’s Decree No. 91/2022/ND-CP dated October 30, 2022 on amendments to some articles of the Government’s Decree No. 126/2020/ND-CP dated October 19, 2020 on elaboration of some articles of Law on Tax Administration;

The Minister of Finance promulgates Circular on fees for extraction and use of information and data on topography and cartography and collection, payment, transfer, exemption, management, and use thereof.
Article 1. Scope and regulated entities
1. This Circular provides for fees for extraction and use of information and data on topography and cartography that are public assets managed by the State and collection, payment, transfer, exemption, management, and use thereof.
2. This Circular applies to payers, collectors and other agencies, organizations and individuals involved in collection, payment, management, and use of fees for extraction and use of information and data on topography and cartography that are public assets managed by the State.
Article 2. Collectors and payers
1. Collectors under this Circular are regulatory bodies and public service providers that are competent to provide information and data on topography and cartography that are public assets according to regulations of the law on topography and cartography.
2. Payers under this Circular are organizations and individuals that request information and data on topography and cartography that are public assets according to regulations of the law on topography and cartography.
Article 3. Fees and fee exemption
1. Fees for extraction and use of information and data on topography and cartography are specified in the Fee Schedule enclosed with this Circular.

3. The fees shall be exempted in case Ministers, Heads of ministerial agencies, Governmental agencies, or Chairpersons of People's Committees of provinces and central-affiliated cities apply for extraction and use of information and data on topography and cartography for:
a) national defense and security in emergency cases.
b) management of natural disasters in emergency cases.
Emergency cases specified in this clause shall be identified according to regulations of the Law on National Defense, the Law on Civil Defense and the law on management of natural disasters.
Article 4. Fee declaration and payment
1. When applying for information and data on topography and cartography, payers shall pay fees to collectors according to regulations in the Circular No. 74/2022/TT-BTC dated December 22, 2022 of the Minister of Finance.
2. Collectors shall transfer total amount of fees collected in the previous month to the dedicated account opened at the State Treasury by the 05th of each month. Collectors shall declare, collect, transfer and make statements of fees in accordance with regulations of the Circular No. 74/2022/TT-BTC (fees collected and managed by central collectors shall be transferred to central government budget and fees collected and managed by local collectors shall be transferred to local government budgets).
Article 5. Management and use of fees
1. Each collector shall be allowed to retain 60% of total amount of collected fees for covering its expenses incurred during provision of services and fee collection and transfer the remaining amount of collected fees (40%) to state budget, except for the case specified in clause 2 of this Article. The collector shall manage and use the retained amount of collected fees according to clause 4 Article 1 of the Government’s Decree No. 82/2023/ND-CP dated November 28, 2023.

Article 6. Implementation
1. This Circular comes into force from September 01, 2024.
2. This Circular:
a) replaces the Circular No. 196/2016/TT-BTC dated November 08, 2016 of the Minister of Finance.
b) annuls Article 4 of the Circular No. 55/2018/TT-BTC dated June 25, 2018 of the Minister of Finance.
c) annuls Article 2, clause 2 Article 3 and the Schedule of Fess for extraction and use of information and data on topography and cartography issued together with the Circular No. 33/2019/TT-BTC dated June 10, 2019 of the Minister of Finance.
3. Other contents concerning the collection, payment, transfer, management and use of fees, receipts, and disclosure of regulations on collection of fees for extraction and use of information and data on topography and cartography which are not mentioned in this Circular shall comply with regulations of the Law on Fees and Charges; the Decree No. 120/2016/ND-CP dated August 23, 2016 of the Government; the Decree No. 82/2023/ND-CP; the Law on Tax Administration; Decree No. 126/2020/ND-CP dated October 19, 2020 of the Government; the Decree No. 91/2022/ND-CP dated October 30, 2022 of the Government; the Decree No. 11/2020/ND-CP dated January 20, 2020 of the Government; the Decree No. 123/2020/ND-CP dated October 19, 2020 of the Government; the Circular No. 78/2021/TT-BTC dated September 17, 2021 of the Minister of Finance; the Decree No. 123/2020/ND- CP dated October 19, 2020 of the Government.
4. During the implementation of this Circular, if any legislative documents referred to in this Circular are amended or superseded, the new ones shall apply.
5. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Finance of Vietnam for consideration./.

1. If contents are selected according to component data, the fee shall be determined as follows:
a) Regarding group of data on terrain; population; traffic; hydrology: 1/6 of fee rate multiplied by 1.2.
b) Regarding group of data on national boundary and administrative boundary; surface cover: 1/6 of fee rate.
2. If the fee for use of national geographical background database has been yet collected, it is not required to collect fee for use of a digital national topographic map at the same scale (it is only applied to the case where the map is used by each piece and there are 07 groups of data).
3. Regarding the case where the data is accessed according to geographical scope, the fee shall equal (=) fee rate multiplied by (x) area divided by (:) (the minimum area to be exploited shall equal (=) the area of 01 map piece at the same scale).
