CIRCULAR

PRESCRIBING FEES AND CHARGES PAYABLE IN SECURITIES SECTOR

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Finance;

At the request of the Director General of the Department of Tax Policy;

The Minister of Finance promulgates a Circular prescribing fees and charges payable in securities sector.

Article 1. Fees and charges payable in securities sector

Payers defined in Article 2 of the Circular No. 272/2016/TT-BTC dated November 14, 2016 of the Minister of Finance prescribing fees and charges payable in securities sector, collection, management and use thereof (hereinafter referred to as “Circular No. 272/2016/TT-BTC”) shall pay fees and charges as follows:

1. Fees and charges payable within the period from May 07, 2020 to December 31, 2020 shall be equal to 50% of those provided for in the Schedule of fees and charges payable in securities sector enclosed with Circular No. 272/2016/TT-BTC (except 02 types of fees and charges mentioned in Clause 2 of this Article).

During the application of fees and charges prescribed in Clause 1 of this Article, no collection of fees and charges in full (100%) as prescribed in the Schedule of fees and charges enclosed with Circular No. 272/2016/TT-BTC shall be made.

2. Fees for processing of applications for issuance, modification or re-issuance of practicing certificates to individuals working at securities companies, securities investment fund management companies, and securities investment companies, and fees for supervision of securities activities shall be paid according to the Schedule of fees and charges enclosed with Circular No. 272/2016/TT-BTC.

3. From January 01, 2021 onwards, fees and charges in securities sector shall be paid according to the Schedule of fees and charges enclosed with Circular No. 272/2016/TT-BTC.

Article 2. Implementation

1. This Circular comes into force from May 07, 2020 to December 31, 2020 inclusively.

2. Scope of application, regulated entities, payers, collectors, collection, management and use of fees and charges, required documents, statement of fees and charges, and other relevant contents, which are not provided for in this Circular, shall comply with the provisions in Circular No. 272/2016/TT-BTC.

3. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Finance for consideration./.
