REGULATING NON-APPLICATION OF TARIFF QUOTAS FOR IMPORTATION OF SUGAR OF ASEAN MEMBER STATES' ORIGIN

Pursuant to the Government's Decree No. 98/2017/ND-CP dated August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

In fulfilling the commitments to eliminating tariff quotas under the ASEAN Trade In Goods Agreement;

In implementing the Government’s Resolution No. 130/NQ-CP dated October 17, 2018 regarding the temporary suspension of the implementation of Article 20 in the ASEAN Trade In Goods Agreement (ATIGA);

At the request of the Director of the Import and Export Department,

The Minister of Industry and Trade promulgates the Circular regulating the non-application of tariff quotas for importation of sugar of the ASEAN member states' origin.

Article 1. General provisions

2. The quantities of sugar imported from ASEAN states shall not be counted as the annual in-quota quantities announced by the Ministry of Industry and Trade according to the WTO schedule of commitments applicable to its member states.

Article 2. Provisions for import duty rates

Import duty rates applied to sugar commodities of the ASEAN member states' origin shall be subject to the Government’s regulations.

Article 3. Entry into force

This Circular shall enter into force as of January 1, 2020./.
