CIRCULAR

Amendments to certain Articles of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport of Vietnam on ORGANIZATION AND MANAGEMENT OF AUTO TRANSPORT OPERATIONS AND SUPPORTING SERVICES FOR ROAD TRANSPORT.

Pursuant to the Law on Road Traffic dated November 13, 2008;

Pursuant to the Government’s Decree No. 10/2020/ND-CP dated January 17, 2020 auto transport business and conditions for auto transport business;

Pursuant to Decree No. 12/2017/ND-CP dated February 10, 2017 of the Government of Vietnam on function, tasks, powers and organizational structures of the Ministry of Transport of Vietnam;

At the request of the Director General of the Department of Transport and Director General of Directorate for Roads of Vietnam,

The Minister of Transport of Vietnam on hereby promulgates a Circular on amendments to certain articles of Circular No. 12/2020/TT-BGTVT dated May 29, 2020 of the Minister of Transport on organization and management of auto transport operations and supporting services for road transport.

Article 1. Amendments to certain articles of Circular No. 12/2020/TT-BGTVT dated may 29, 2020 of the Minister of Transport of Vietnam on organization and management of auto transport operations and supporting services for road transport

“d) Allow the vehicle to exit the station according to its running time published by the rout management authority.".

2. Amendments to Clause 4 Article 20:

“4. Vehicles shall be equipped with emergency tools and safety conditions on fire prevention and fighting must be ensured as prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020 elaborating some articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending some articles of the Law on Fire Prevention and Fighting.”

3. Amendments to Clause 1 Article 25:

“1. Transport orders shall be issued under physical or electronic form by enterprises and cooperatives themselves using the form given in the Appendix 6 hereto. Apart from the contents specified in the Appendix 6, enterprises and cooperatives shall add other contents to serve their management work.

When drivers operate their routes, they shall bring physical transport orders or have devices that are able to access the electronic transport orders; present these documents at the request of regulatory authorities.

The information on the transport orders shall be provided as prescribed in clause 4 Article 52 hereof.". 

4. Amendments to Clause 2 Article 29:

“2. Vehicles shall be equipped with emergency tools and safety conditions on fire prevention and fighting must be ensured as prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020 elaborating some articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending some articles of the Law on Fire Prevention and Fighting.”

6. Amendments to Clause 3 Article 38:

“3. Vehicles shall be equipped with emergency tools and safety conditions on fire prevention and fighting must be ensured as prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020 elaborating some articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending some articles of the Law on Fire Prevention and Fighting.”

7. Amendments to Clause 7 Article 43:

“7. Vehicles shall be equipped with emergency tools and safety conditions on fire prevention and fighting must be ensured as prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020 elaborating some articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending some articles of the Law on Fire Prevention and Fighting.”

8. Amendments to Clause 5 Article 46:

“5. Vehicles shall be equipped with emergency tools and safety conditions on fire prevention and fighting must be ensured as prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020 elaborating some articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending some articles of the Law on Fire Prevention and Fighting.”

“5. Announce information structures, devices and procedures for checking information on the QR code on badges.”.

10. Amendments to Clause 10 Article 63:

“10. Manage and organize the printing of auto transport business licenses according to the form issued herewith; issue and reissue auto transport business licenses to passenger transport businesses and goods transport businesses in its province.”.

11. Amendments to Clause 11 Article 63:

“11. Manage and organize the printing of badges as prescribed in forms issued herewith or forms of separate badges of taxi vehicle in its province.”.

Article 2. Implementation Clauses

1. This Circular comes into force from September 15, 2022.

2. Chief of the Ministry Office, Chief Inspector of the Ministry, Director Generals, Directors of Departments of Transport of provinces or central-affiliated cities, heads of relevant agencies, units and individuals are responsible for the implementation of this Circular./.
