CIRCULAR

AMENDMENTS TO CIRCULAR NO. 08/2016/TT-BTTTT DATED MARCH 30, 2016 OF MINISTER OF INFORMATION AND COMMUNICATIONS PROVIDING GUIDELINES FOR PUBLIC UTILITY TELECOMMUNICATION SERVICE PROVISION PROGRAM UNTIL 2020

Pursuant to Law on Telecommunication dated November 23, 2009;

Pursuant to Decree No. 25/2011/ND-CP dated April 6, 2011 of Government on elaborating to Law on Telecommunication and Decree No. 81/2016/ND-CP dated July 1, 2016 of Government on amendments to Decree No. 25/2011/ND-CP dated April 6, 2011 of Government on elaborating to Law on Telecommunication;

Pursuant to Decree No. 17/2017/ND-CP dated February 17, 2017 of Government on functions, tasks, powers, and organizational structure of Ministry of Information and Communications;

Pursuant to Decision No. 11/2014/QD-TTg dated January 27, 2014 of Prime Minister on organization and operation of Vietnam Public-utility Telecommunication Service Fund;

In implementation of Decision No. 1168/QD-TTg dated July 24, 2015 of Prime Minister on approval of Public-utility communication service provision program until 2020 and Decision No. 868/QD-TTg dated July 16, 2018 of Prime Minister on amendment to Decision No. 1168/QD-TTg dated July 24, 2015 of Prime Minister on approval of Public-utility communication service provision program until 2020;

In implementation of Decision No. 2451/QD-TTg dated December 27, 2011 of Prime Minister approving Scheme for digitalizing terrestrial television transmission and broadcast until 2020 and Decision No. 310/QD-TTg dated March 14, 2018 of Prime Minister on amendments to Decision No. 2451/QD-TTg dated December 27, 2011 of Prime Minister approving Scheme for digitalizing terrestrial television transmission and broadcast until 2020;

At request of Director General of Enterprise Management Department;

Minister of Information and Communications promulgates Circular on amendments to Circular No. 08/2016/TT-BTTTT dated March 30, 2016 of Minister of Information and Communications providing guidelines for public utility telecommunication service provision program until 2020.

Article 1. Amendments to Circular No. 08/2016/TT-BTTTT dated March 30, 2016 of Minister of Information and Communications providing guidelines for public utility telecommunication service provision program until 2020 are as follows:

1. Amendments to Article 1 are as follows:

“Article 1. Scope

This Circular provides guidelines for implementing public utility telecommunication service provision program (hereinafter referred to as “Program”) approved by the Prime Minister under Decision No. 1168/QD-TTg dated July 24, 2015 and Decision No. 868/QD-TTg dated July 16, 2018 of Prime Minister on amendments to Decision No. 1168/QD-TTg dated July 24, 2015 of the Prime Minister on approval of public utility telecommunication service provision program until 2020.”

2. Addition of Point i and Point k Clause 2 Article 8:

“i) Public-utility telecommunication services of renting digital microwave transmission for provision of broadband services for islands and archipelagoes.

k) Public-utility telecommunication services of renting satellite transmission channel for provision of broadband services for islands and archipelagoes.”

3. Amendments to Article 9 are as follows:

a) Addition of following phrase at the end of Point a Clause 1 is as follows:

“and users of mobile terrestrial communication services dialing emergency numbers”

b) Annulment of following phrase in Point h Clause 1:

“2 Mbps with backup”

c) Annulment of following phrase in Point c Clause 2:

“Cát Hải, Cô Tô, Lý Sơn, Phú Quốc, Vân Dồn” (Cat Hai, Co To, Ly Son, Phu Quoc, Van Don)

d) Addition of Point d and Point dd to Clause 2:

“d) Telecommunication enterprises that rent satellite transmission channel for provision of broadband services for islands and archipelagoes;

dd) Telecommunication enterprises that rent digital microwave transmission channel for provision of broadband services for islands and archipelagoes.”

4. Amendments to Clause 3 Article 10 as follows:

“3. Beneficiaries specified under Points dd, e, g, h and i Clause 1 Article 9; public internet access points specified under Point b Clause 2 Article 9 and islands, archipelagoes provided with bandwidth services by telecommunication enterprises that rent satellite transmission channel and digital microwave transmission specified under Point d and Point dd Clause 2 Article 9 of this Circular shall be listed as beneficiaries and confirmed by Departments of Information and Communications (in case Bac Lieu Province, Department of Culture, Information, Sports and Tourism).

a) In case of beneficiaries that arise within the quarter and are not mentioned under list of confirmed beneficiaries, enterprises shall consolidate and report to Departments of Information and Communications for verification to support the beneficiaries from the following quarter;

b) In case of beneficiaries that are mentioned under the list of confirmed beneficiaries applying for cancelling support, enterprises shall consolidate, report to Departments of Information and Technology and cease to support the beneficiaries.”

5. Amendments to Article 15 are as follows:

a) Amendments to Clause 2 as follows:

“2. Eligibility for support

a) Terrestrial digital television receivers: Poor and near-poor households located in areas receiving terrestrial digital television receivers via support, having television receivers with similar technology which have not been integrated with DVB-T2 digital television receipt function, not having DVB-T2 digital television receivers, not using any of paid television formats namely cable television, satellite television, internet protocol television (IPTV) during support period in the areas.

b) Satellite digital television receivers: Poor and near-poor households located in areas receiving satellite digital television receivers via support, having television receivers without being able to watch terrestrial DVB-T2 digital television and not using any of paid television formats namely cable television, satellite television, internet protocol television (IPTV) during support period in the areas.

c) Application for digital television receivers with confirmation of poor and near-poor households of communes, wards, and townlets using Form 01/THS under Annex attached to this Circular.”

b) Amendments to Clause 5 as follows:

“5. Period of support

Support period shall conform to roadmap of Scheme for digitalizing terrestrial television transmission and broadcast until 2020 under Decision No. 2451/QD-TTg dated December 27, 2011 of Prime Minister and Decision No. 310/QD-TTg dated March 14, 2018 of Prime Minister on amendments to Decision No. 2451/QD-TTg dated December 27, 2011 of Prime Minister approving Scheme for digitalizing terrestrial television transmission and broadcast until 2020 and implementation plans of Steering Committee of Scheme for digitalizing Vietnam television in each phase.”

6. Chapter III is renamed as follows:

“Chapter III: EXAMINATION, SUPERVISION, REPORT, ADVANCE PAYMENT, PAYMENT, STATEMENT AND IMPLEMENTATION ORGANIZATION”

7. Insertion of Article 20a in Chapter II:

“Article 20a. Advance payment and payment for projects and contracts executing tasks of the Program

1. Advance payment and payment for contracts under projects on implementing tasks of the Program shall conform to Circular No. 08/2016/TT-BTC dated October 18, 2016 of Minister of Finance on management and payment of investment capital utilizing state capital and relevant law provisions.

2. Statements for completed projects shall conform to Circular No. 10/2020/TT-BTC dated February 20, 2020 of Minister of Finance on statements of completed projects utilizing state capital and relevant law provisions.”

8. Amendments to Forms under Annexes attached to Circular No. 08/2016/TT-BTTTT dated March 30, 2016 of Minister of Information and Communications providing guidelines for public utility telecommunication service provision program until 2020 are as follows:

a) Form 01/DV: Amendments to Sub-Schedule 2, Sub-Schedule 4. Details are under Annex 1 attached to this Circular.

b) Form 02/DV: Amendments to Sub-Schedule 7, Sub-Schedule 8. Details are under Annex 1 attached to this Circular.

c) Form 03/DV: Amendments to Sub-Schedule 2, Sub-Schedule 8, Sub-Schedule 10, Sub-Schedule 11; addition of Sub-Schedule 12, Sub-Schedule 13. Details are under Annex 1 attached to this Circular.

d) Form 05/DV: Amendments to Sub-Schedule 2, Sub-Schedule 3, Sub-Schedule 8, Sub-Schedule 9, Sub-Schedule 10, Sub-Schedule 18, Sub-Schedule 21, Sub-Schedule 22; addition of Sub-Schedule 24, Sub-Schedule 25. Details are under Annex 1 attached to this Circular.

dd) Form 06/DV: Amendments to Sub-Schedule 2, Sub-Schedule 4. Details are under Annex 1 attached to this Circular.

e) Amendments to Form 01/THS, Form 02/THS, Form 03/THS, Form 04/THS, Form 05/THS and Form 06/THS. Details are under Annex 1 attached to this Circular.

Article 2. Transition clauses

1. Investment projects and purchase order agreements approved by competent agencies prior to the effective date hereof shall continue to conform to Circular No. 08/2016/TT-BTTTT dated March 30, 2016 of Minister of Information and Communications providing guidelines for public-utility telecommunication service provision program until 2020.

2. Digital television receiver support in 2020 shall conform to Point a Clause 1 Article 1 of this Circular.

3. If the legislative documents extracted in this Circular are approved for amendments or superseded by other legislative document, the respective provisions of the new documents will be applied.

Article 3. Entry into force and implementation

1. This Circular comes into force from August 25, 2020.

2. Chairpersons of People’s Committees of provinces and central-affiliated cities, Chief of the Ministry Office, heads of relevant agencies, and relevant agencies, organizations, and enterprises are responsible for the implementation of this Circular.

3. Difficulties that arise during the implementation of this Circular should be promptly reported to Ministry of Information and Communications for consideration./.

Amendments are as follows:

BẢNG KÊ CHI TIẾT DỐI TƯỢNG DÃ NHẬN HỖ TRỢ DẦU THU TRUYỀN HÌNH Số MẶT DẤT (DVB-T2)” Detailed list of beneficiaries who have received terrestrial digital television receivers (DVB-T2)).

- The phrase “Ghi chú: + Cột 5 - Dịa chỉ: ghi rõ số nhà, thôn/bản/khối phố” (Note: + Column 5 – Address: Specify house address, hamlet/neighboorhood) is changed into “Ghi chú: Trường hợp trường thông tin tại Cột (2) hoặc Cột (3) không có thông tin, đề nghị Nhà thầu ghi rõ lý do và có xác nhận của chính quyền địa phương” (Note: In case information in Column (2) and Column (3) is left empty, the contractor must provide reason and confirmation of local governments”

- Add the phrase “Mẫu 06B/THS” (Form 06B/THS) and revise Form 06B/THS as follows:
