PROMULGATION OF NATIONAL TECHNICAL REGULATION ON ENVIRONMENTAL TREATING PRODUCTS IN AQUACULTURE

Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Technical Standards and Regulations dated June 29, 2006;

Pursuant to the Law on Fishery dated November 21, 2017;

At the request of the Director of the Department of Science, Technology and Environment and General Director of the Directorate of Fisheries;

The Minister of the Ministry of Agriculture and Rural Development hereby promulgates a National technical regulation on environmental treating products in aquaculture.

Article 1. The National technical regulation on environmental treating products in aquaculture is promulgated together with this Circular. Part 1: Chemical, biological products. Code: QCVN 02-32 - 1: 2019/BNNPTNT.

Article 3. Chief of the Ministry Office; Director of Department of Science, Technology and Environment; Director General of Directorate of Fisheries; heads of relevant units affiliated to the Ministry; Directors of Departments of Agriculture and Rural Development of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Circular.

Difficulties that arise during the implementation of this document should be reported to the Ministry of Agriculture and Rural Development for consideration./.

1. GENERAL

Scope: This document provides for permissible levels in chemicals and biological products intended for environmental treatment in aquaculture (HS codes are provided in the Appendix hereof).

1.2. Regulated entities: This document applies to organizations and individuals related to manufacturing and import of chemicals and biological products intended for environmental treatment in aquaculture.

1.4. Definitions

1.4.1. “enzyme preparation” means a biological product containing one or more enzymes with or without a carrier.

1.4.2. “microbiological preparation” means a biological product containing one or more microorganisms that are beneficial and harmless to aquatic animals, with or without a carrier.

1.4.3. “preparation extracted from organisms” means a biological product containing beneficial ingredients and active ingredients extracted from organisms (mainly oligosaccharides, chitosan, saponins, β-Glucan, organic acids, etc.) that are beneficial and harmless to aquatic animals, with or without carrier.

1.4.4. “premixed preparation” means a biological product that contains a mixture of different preparations (enzyme preparations, microbiological preparations, ingredients and active ingredients extracted from organisms) that are harmless to aquatic animals, with or without carrier.

2. TECHNICAL REQUIREMENTS

4. REGULATORY REQUIREMENTS

4.1. Declaration of conformity

Organizations and individuals shall submit declarations of conformity of chemicals and biological products intended for environmental treatment in aquaculture as follows:

4.1.1. Regarding domestically manufactured products, the certification result given by the certification body registered or accredited as prescribed by law shall be sent.

4.1.2. Regarding imported products, the certification or assessment result given by the certification body or the conformity assessment body registered or accredited as prescribed by law shall be sent.

4.2. Conformity assessment

Organizations and individuals shall assess conformity of chemicals and biological products intended for environmental treatment in aquaculture as follows:

4.2.2. Regarding imported products, Method 7 (Testing and evaluation of batches of goods) shall be adopted.

4.3. Procedures and documentation requirements for declaration of conformity are specified in Clauses 3 and 4 Article 1 of the Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Ministry of Science and Technology on amendments to the Circular No. 28/2012/TT-BKHCN dated December 12, 2012.

Departments of Agriculture and Rural Development of provinces and central-affiliated cities shall receive documents submitted for declaration of conformity by organizations and individuals registering their manufacturing and trading within provinces and cities.

4.4. Contents, sequence and principles of using conformity assessment methods are specified in the Appendix II of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Ministry of Science and Technology.

5. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

Organizations and individuals mentioned in Section 1.2 shall comply with regulations of this document.

6. IMPLEMENTATION

6.1. The Directorate of Fisheries and Departments of Agriculture and Rural Development of provinces and cities shall inspect the implementation of this document as assigned by the Ministry of Agriculture and Rural Development.

6.2. The Directorate of Fisheries shall disseminate, provide guidance and cooperate with relevant authorities in organizing the implementation of this document.
