1. Responsibilities

Being specialized and professional officials in forest ranger sector, assisting heads of central or local forest ranger agencies in organizing implementation of one or many activities in specialities and professions of forest management, forest protection and development, and management of forestry products on a nationwide and provincial scale.

b) Taking charge or participating in development of measures, programs and plans within the assigned field of operation and cooperate with relevant agencies in implementation;

d) Taking charge or cooperating in conducting examination, inspection and dealing with large-scale and complicated cases as per the law;

dd) Taking charge or participating in organizing and providing guidance on professional examination in forest ranger sectors and propose corrective measures to be adopted in forest ranger sectors to ensure close, effective and efficient organization;

e) Ensuring professional cooperation with relevant agencies (law enforcement, research, management, etc.) in performing tasks and managing, protecting and developing forest on provincial, regional and nationwide scale;

g) Taking charge or participating in organizing research, application and adoption of scientific and technical achievements and latest technologies in forest management, forest protection and forestry product management;

h) Drafting or participating in drafting professional textbooks and documents on forest ranger sector, participate in teaching at classes that provide professional development for ranger public officials;

i) Conducting research and analyzing activities of forest ranger sector on a nationwide scale and in provinces with large forest areas, proposing measures to organize and direct to improve efficiency in management and operation within forest ranger sector.

g) Having experience in administration and public affairs regarding forest ranger or in management activities. Public officials must hold title of forest ranger official or similar for at least 5 years (60 months) with at least 3 years (36 months) of holding forest ranger title in order to attend exams for senior forest ranger title.

Being specialized and professional officials in forest ranger sector, assisting heads of central or local forest ranger agencies in performing forest management, forest protection and development, and forestry product management on assigned administrative divisions.

2. Tasks

a) Examining and controlling compliance with regulations and law on forest management, forest protection and development, and forestry product management;

b) Monitoring and promptly reporting on forest management, forest protection and development, and forestry product management within assigned administrative divisions;

c) Developing plans, schemes and organizing implementation, examination, inspection, fire prevention and counter of violations relating forest management, forest protection and development, and forestry product sale;

dd) Providing guidance on development and supervising implementation of agreements and conventions on protection and development of forest within assigned administrative divisions;

e) Joining locals and other law enforcers in preventing and fighting deforestation within assigned administrative divisions;

Being specialized and professional officials in forest ranger sector, assisting heads of local forest ranger agencies in performing certain tasks regarding forest management, forest protection and development, and forestry product management as per the law.

dd) Promptly deterring violations to forest resources, keeping records and initial documents on violations, and protecting the scenes, exhibits and vehicles used for illegal transportation of forestry products.

Acting specialized officials in fisheries surveillance agencies and assisting heads of fisheries surveillance agencies in patrolling, examining, controlling, taking actions against violations and performing inspection in fishery sector over Vietnamese waters under their management.

2. Tasks

a) Taking charge implementing specialized affairs regarding fisheries surveillance and inspections in fishery sector;

b) Participating in development or revision of legislative documents on specialities and professions within the assigned field of operation;

a) Developing ship operation and repair plans; proposing safe and effective ship use and mariner management measures;

b) Patrolling, examining, inspecting, detecting, controlling, detecting, preventing and taking actions against violations to regulations and law on fisheries on Vietnamese waters;  

c) Operating fisheries surveillance ships safely and effectively; managing weapons and combat gears equipped for ships;

d) Applying technological and scientific advances in ship operation;

TRANSITION CLAUSES AND IMPLEMENTATION

Article 28. Transition clauses for officials specialized in animal-plant sanitation

Officials specialized in animal-plant sanitation holding previous titles of: senior animal-plant sanitary officials (code 09.067), animal-plant sanitary officials (code 09.068), and animal-plant technician (code 09.069) shall hold new titles of:

- Senior animal-plant sanitary officials (code 09.067) shall now hold titles of senior animal sanitary officials (code 09.315) or senior phytosanitary official (code 09.318);

- Animal-plant sanitary officials (code 09.068) shall now hold titles of animal sanitary officials (code 09.316) or phytosanitary officials (code 09.319);

- Animal-plant technicians (code 09.069) shall now hold titles of animal sanitation technicians (code 09.317) or phytosanitary technicians (code 09.320).

Article 29. Transition clauses for officials specialized in forest ranger 

1. Forest ranger officials previously holding titles of college-level forest rangers (code 10.227) shall now hold the title of medium-level forest rangers (code 10.228).

2. Forest ranger officials previously holding titles of preliminary forest rangers (code 10.229) shall now hold the title of:

b) Officials currently holding intermediate forest ranger title (code 10.229) and having no specialized degrees may comply with current policies for 5 years from the effective date of this Circular. Within 5 years from the effective date of this Circular, employers of the officials are responsible for enforcing training of officials to meet requirements of forest ranger titles specified under this Circular, to be specific:

- Employers of male officials under 55 years of age and female officials under 50 years of age must enforce training of said officials to meet requirements for medium-level forest rangers or higher.  In case officials assigned for training fail to adequately participate in training or attain eligible score, employers of said officials shall request supervisory agencies of officials to downsize.  In case officials graduate medium-level education or higher after attending the training, assign the officials with new titles as specified under Point b of this Clause.

- Male officials of at least 55 years of age and female officials of at least 50 years of age who do not wish or are not assigned for training may retain policies applied to preliminary forest ranger until retirement age.

3. Employers and supervisory agencies of officials shall not employ preliminary forest ranger officials from the effective date of this Circular.

Article 30. Salary arrangement

1. Public official titles in agriculture and rural development sectors, including: animal sanitary, phytosanitary, dike control, forest ranger, fisheries surveillance, and fisheries surveillance mariners specified under this Circular may adopt professional salary schedule for officials and public officials in regulatory authorities (Schedule 2) attached to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary for officials, public officials, employees and armed forces and amendments thereto under Decree No. 17/2013/ND-CP dated February 19, 2013 of the Government as follows:   

a) Senior forest rangers, senior fisheries surveillance officials and senior fisheries surveillance mariners shall adopt class A2, sub-class A2.1 official salary multiplier, from a 4.40 multiplier to a 6.78 multiplier;

b) Senior animal sanitary officials, senior phytosanitary officials and senior dike control officials shall adopt class A2, sub-class A2.2 official salary multiplier, from a 4.00 multiplier to a 6.38 multiplier;

c) Animal sanitary officials, phytosanitary officials, dike control officials, forest rangers, fisheries surveillance officials and fisheries surveillance mariners may adopt class A1 official salary multiplier, from a 2.34 multiplier to a 4.98 multiplier;

2. Salary arrangement at the end of probation period and upon assignment

At the end of probation period as per the law, competent supervisory authorities of officials that decide on assignment of officials shall arrange the new salary as follow:

a) Officials that have doctor degrees specialized in majors suitable for title requirements shall be arranged in level 3 and 3.00 multiplier of official titles specified under Point c Clause 1 of this Article;

b) Officials that have master degrees specialized in majors suitable for title requirements shall be arranged in level 2 and 2.67 multiplier of official titles specified under Point c Clause 1 of this Article;

c) Officials that have college-level education in majors suitable for title requirements shall be arranged in level 2 and 2.06 multiplier of official titles specified under Point c Clause 1 of this Article;

3. Salary arrangement for officials in agricultural sectors, including: animal sanitary officials, phytosanitary officials, dike control officials, forest rangers, fisheries surveillance officials and fisheries surveillance mariners who have been classified according to Decision No. 413/TCCP-VC dated May 29, 1993 of Board of Governmental Organizations – Officials on professional standards for irrigation officials; Decision No. 417/TCCP-VC dated May 29, 1993 of Board of Governmental Organizations – Officials on professional standards for agricultural – food industry officials; Decision No. 09/2006/QD-BNV dated October 5, 2006 of Ministry of Home Affairs on titles, codes and professional standards of forest ranger officials; Circular No. 02/2014/TT-BNV of Ministry of Home Affairs on titles, codes and standards of fisheries surveillance officials, fisheries surveillance mariners and Decree No. 204/2004/ND- CP shall be implemented as follows:  

a) In case assign officials to titles with the same salary multiplier as the previous titles, adopt salary rate and exceeding seniority pay % (if any) of the previous titles (including pay rise or excess seniority pay consideration period of the previous titles) to the newly assigned titles.  

Example 1: Mr. Nguyen Van A was previously ranked as forest ranger (code 10.226), class 5, and salary multiplier of 3.66 from January 1, 2013, is now eligible and assigned as a forest ranger (code 10.226) and shall be ranked as class 5 with salary multiplier of 3.66 of forest ranger (code 10.226) from the date on which assignment decision is signed; consideration period for the next pay rise shall begin from January 1, 2013.

b) In case officials having college education specialized in suitable disciplines for title requirements and ranked A0 for official salary according to Decree No. 204/2004/ND-CP are assigned as class B officials, salary arrangement for said officials shall rely on the duration of work in which the officials participate in mandatory social insurance depending on pay scale and pay schedule prescribed by the Government (excluding probation period) is as follows:

If new salary multiplier of agricultural officials plus excess seniority pay (if any) is lower than the previous salary multiplier, adopt the difference amount to match the original multiplier (including excess seniority pay, if any). Officials shall benefit from the difference amount while holding assigned titles. If salary multiplier of officials is later raised, add the difference amount to salary multiplier (including excess seniority pay, if any) which the officials are benefiting from to determine new salary multiplier and officials shall cease to benefit from the difference amount from the date on which they benefit from salary of the new multiplier.

Example 2: Mr. Nguyen Van B has college-level education in forestry, is employed as officials, pays for mandatory social insurance from January 1, 2008, is ranked 3 with salary multiplier of 2.72 for A0 officials from July 1, 2014, always accomplishes assigned tasks and is not disciplined.  He is assigned as medium-level forest rangers and subject to following salary arrangement:

Mr. Nguyen Van B who has been working from January 1, 2008, minus 6 months of probation period, starting from level 2 of medium-level forest rangers and increasing 1 level for every 2 accumulated years shall have level 5 with salary multiplier of 2.66 of medium-level forest rangers (code 10.228) by July 1, 2014; Mr. Nguyen Van B shall benefit from the new salary for medium-level forest rangers (code 10.228) from the date of signing decisions in addition to the difference amount of 0.06 (2.72 – 2.66); consideration period for the next pay rise shall start from July 1, 2017.

Until July 1, 2016 (after 2 years), Mr. Nguyen Van B is eligible for receiving a raise to level  6 with a multiplier of 2.86 for medium-level forest rangers (code 10.228) and shall continue to benefit from the difference of 0.06 (for a total of 2.92).

4. Increase salary levels of agricultural and rural development officials as soon as the officials are assigned as titles specified under this Circular by competent authorities and arrange salary according to guidelines under Circular No. 02/2007/TT-BNV dated May 25, 2007 of Ministry of Home Affairs providing guidelines on arranging salary in case of increase or change of official ranks or types.

Article 31. Organization for implementation

Ministries, ministerial agencies, Governmental agencies, People’s Committees of provinces and central-affiliated cities and relevant agencies, organizations shall rely on this Circular to employ, use and manage officials specialized in agriculture and rural development.

Article 32. Entry into force

1. This Circular comes into force from January 24, 2016.

Article 33. Responsibilities for implementation

1. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities, relevant organizations and individuals are responsible for the implementation of this Circular./.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Home Affairs for consideration and solutions./.
