CIRCULAR

GUIDING PROVISION OF FIRE SAFETY, FIRE FIGHTING, AND RESCUE KNOWLEDGE, SKILLS FOR STUDENTS AND LEARNERS IN EDUCATION INSTITUTIONS

Pursuant to Education Law dated June 14, 2019;

Pursuant to Law on Fire Prevention and Firefighting dated June 29, 2001; Law on amendments to Law on Fire Prevention and Firefighting dated November 22, 2013;

Pursuant to Decree No.136/2020/ND-CP dated November 24, 2020 of the Government on elaborating to Law on Fire Prevention and Firefighting and Law on amendments to Law on Fire Prevention and Firefighting;

Pursuant to Decree No. 83/2017/ND-CP dated July 18, 2017 of the Government on rescue operations of fire prevention and firefighting brigade;

Pursuant to Decree 69/2017/ND-CP dated May 25, 2017 of the Government on functions, tasks, powers and organizational structure of the Ministry of Education and Training;

Pursuant to Decree 84/2020/ND-CP dated July 17, 2020 of the Government on elaborating to Law on Education;

The Minister of Education and Training promulgates Circular guiding provision of fire safety, fire fighting, and rescue knowledge for students and learners in education institutions.

Chapter I

GENERAL PROVISIONS

Article 1. Scope and regulated entities

1. Scope

This Circular guides contents, methods, and forms of equipping students and learners in education institutions of national education system with fire safety, fire fighting, and rescue knowledge.

2. Regulated entities

This Circular applies to preschools, formal education institutions, continuing education institutions, specialized education institutions, and other education institutions; universities, institutes, higher education institutions, pedagogy colleges, education institutions providing teacher training, excluding higher education institutions affiliated to the Military and Public security forces (hereinafter referred to as “education institutions”); relevant organizations and individuals.

2. Ensure consistency among education levels, training levels of national education systems without altering framework regulations on formal education programs of all education levels and training levels.

3. Integrate formal education with educational activities.

Chapter II

CONTENTS, METHODS, FORMS OF PROVIDING FIRE SAFETY, FIRE FIGHTING, AND RESCUE KNOWLEDGE, SKILLS FOR STUDENTS AND LEARNERS

Article 3. Contents of fire safety, firefighting, and rescue knowledge, skills

1. Contents of law education regarding fire safety, fire fighting, and rescue.

a) Legislative documents, guiding documents regarding fire safety, fire fighting, and rescue according to the Law on Fire Protection and Fire Fighting and regulations of Ministry of Education and Training.

b) Responsibilities of authorities, sectors, organizations, individuals, and families in fire safety, fire fighting, and rescue.

c) Danger, damage, and consequences of fire, explosion to individuals, families, community, and society.

2. Basic contents, knowledge, and skills regarding fire safety, fire fighting, and rescue integrated with formal subjects integrated in preschool education program and formal education program promulgated by Ministry of Education and Training or training programs of higher education institutions.

3. Additional knowledge and skills regarding fire safety, fire fighting, and rescue provided for learners by education institutions in order to satisfy requirements under Article 5 hereof while meeting conditions of the education institutions.

4. Details of fire safety, fire fighting, and rescue drills, including: fire fighting and rescue equipment training (using actual equipment or model equipment), movement drills in case of fire, explosion.

5. Duration of support activities and drills regarding fire safety and fire fighting: For preschool children, at least 1 session/school year. For students of formal education institutions and students of continuing education institutions, at least 2 sessions/school year. For university students, at least 3 sessions/school year.

Article 4. Methods and form of organizing education on fire safety, fire fighting, and rescue knowledge, skills

1. For preschool education

a) Integrate with child care, education activities.

b) Use visual and illustrative methods via physical activities.

2. For formal education and continuing education

b) Integrate with experiential activities, experiential - career counseling activities, soft skill training activities, club activities, and summer activities.

3. For higher education

a) Integrate with national defense and security subject and extracurricular activities.

b) Cooperate with competent entities in organizing training, practice, and drills suitable with training programs of education institutions.

Article 5. Goals for preschool children and students, learners

1. For preschool children

a) Be able to recognize sources of fire, sources of heat, and flammable, combustible objects.

b) Know how to prevent sources of fire, sources of heat, and flammable, combustible incidents.

c) Recognize fire alarm signals and devices and take appropriate actions upon receiving fire alarm signals.

a) Recognize signs of fire and risks of accidents. Recognize fire alarm signals and be able to raise alarm in case of fire.

b) Know how to evacuate in a fire, select exits, and use equipment that protects reparatory organs and body in case of fire.

c) Use model fire extinguishers and practice extinguishing fire with model fire extinguishers, practice evacuating in environment with smoke and noxious gases.

d) Know how to avoid common incidents and provide emergency medical care in those cases.

3. For lower-secondary school students

a) Know the common causes of fire and common fire safety, fire fighting measures.

b) Know how to evacuate in case of fire.

c) Practice and effectively use fire safety, fire fighting, and rescue skills with model equipment.

4. For upper-secondary school students and learners of formal education programs in continuing and vocational education centers, continuing education and general technique centers

b) Know basic skills in searching for survivors, victims, providing emergency medical aid in case of fire and other incidents.

c) Effectively use portable extinguishers and common firefighting equipment for different sources of fire (with model or realistic equipment).

5. For university students

a) Know the solutions and principles for controlling safety while extinguishing fire; master how to effectively evacuate from traffic vehicles, elevators, and escalators in case of fire.

b) Master basic skills in searching for survivors, victims, providing emergency medical aid in case of fire and other incidents.

c) Be able to operate basic fire fighting and rescue devices and equipment available at families, education institutions, and public areas.

d) Obtain certificate of fire safety, fire fighting, and rescue training completion as per applicable laws (if needed) after passing examination and assessment by competent police authorities.

Chapter III

CONDITIONS FOR PROVISION OF FIRE SAFETY, FIRE FIGHTING, AND RESCUE KNOWLEDGE, SKILLS IN EDUCATION INSTITUTIONS

1. Establish Steering Committee for fire safety, firefighting and rescue of education institution where heads of education institutions shall act as directors and managerial officials, teachers, lecturers, and employees shall act as members.

2. Members of the Steering Committee for fire safety, fire fighting and rescue in education institutions must obtain certificate of fire safety, fire training, and rescue training completion as per the law; be able to teach, popularize knowledge, and practice skills regarding fire safety, firefighting and rescue.

3. The Steering Committee for fire safety, fire fighting, and rescue in education institutions have the tasks to:

a) Develop annual plans for implementing regulations on improving and practicing knowledge, skills relating to fire safety, fire fighting, and rescue for learners in accordance with this Circular.

 b) Cooperate with local fire safety, fire fighting, and rescue authorities in organizing activities under this Circular.

c) Publicize and provide knowledge, skills, and practice regarding fire safety, fire fighting, and rescue for learners.

d) Carry out fire safety, fire fighting, and rescue at education institutions in case of fire; review safety conditions of learners while studying at education institutions.

dd) Review, list, and propose addition of learning and practice materials, equipment for learners.

e) Ensure absolute safety for learners during studying and practicing fire safety, fire fighting, and rescue knowledge, skills.

Article 7. Facilities, expenditure, and conditions for implementation in education institutions

1. Education institutions shall prepare adequate materials providing fire safety, fire fighting, and rescue knowledge, skills; teaching and practice equipment for fire safety, fire fighting, and rescue regulated by competent authorities.

2. Education institutions shall inspect electrical systems and gas sources in kitchens; ensure origin of chemicals used in laboratories and preserve, collect chemicals after practice in accordance with regulations and law on occupational safety, hygiene, fire prevention, and accident avoidance.

3. Equip teaching and practicing equipment appropriate for learners in each education level.

a) For preschool: Prepare adequate equipment, toys, teaching aids (video clips, photos, paintings, pictures, signs, etc.) illustrating sources of fire, sources of heat, common incidents in order to educate on fire safety, fire fighting, and rescue knowledge and skills.

b) For formal education institutions and continuing education institutions: Prepare training areas in gymnasium or outdoor areas. Prepare fire fighting models and equipment (Portable fire extinguishers, nozzles, hoses, fire blanket, sand, and equivalent equipment, devices, gasoline tray, gas tank, oil, protective headwear and gloves). Prepare model equipment and facilities to allow practice basic rescue and evacuation (Gas masks, soaked towel, cloth, gauze pads, splints, stretchers, and equivalent equipment).

c) For universities, institutes, higher education institutions, pedagogy colleges: Prepare training areas in gymnasiums or outdoor areas. Prepare model equipment or images regarding various fire-related systems (Automatic fire alarm; automatic or semi-automatic fire extinguishing system; indoor and outdoor fire hydrant system; water supply for indoor fire fighting, outdoor fire hydrants). Prepare firefighting equipment (Portable fire extinguishers, nozzles, hoses, fire blanket, sand, and equivalent equipment, devices, gasoline tray, gas tank, oil, protective headwear and gloves). Prepare equipment and facilities to allow practice basic rescue and evacuation (Gas masks, soaked towel, cloth, gauze pads, splints, stretchers, and equivalent equipment).

d) Prioritize the use of virtual reality technology in training and improvement to responses to fire, explosion, accidents; the use of new experimental technology in practice and tests involving flammable, combustible chemicals.

4. Expenditure on integrating fire safety, fire fighting, and rescue knowledge, skills into education program and activities in education institutions includes:

b) Financing and fundings of Vietnamese and foreign organizations and individuals as per the law; other legitimate funding sources.

c) Legitimate financial sources of non-public education institutions and other relevant agencies, organizations, and individuals.

Chapter IV

ORGANIZATION FOR IMPLEMENTATION

Article 8. Responsibilities of Ministry of Education and Training

Ministry of Education and Training is responsible for:

1. Taking charge and cooperating with relevant agencies, entities in guiding and inspecting implementation of this Circular.

2. Directing and guiding relevant agencies, entities, and organizations to develop and implement documents providing fire safety, fire fighting, and rescue knowledge and skills for learners.

3. Periodically consolidating reports of relevant agencies on implementation of fire safety, fire fighting, and rescue education in education sector.

People’s Committees of provinces and central-affiliated cities are responsible for:

1. Directing Departments of Education and Training and local departments to organize implementation of this Circular.

2. Ensuring funding sources for education institutions in provinces and central-affiliated cities to integrate fire safety, fire fighting, and rescue knowledge, skills into education program and activities in accordance with this Circular.

3. Organizing inspection, examination, commendation, and disciplinary actions as per the law.

Article 10. Responsibilities of Departments of Education and Training and Education and Training Authorities

Departments of Education and Training and Education and Training Authorities are responsible for:

1. Advising Chairpersons of People’s Committees of provinces/districts to develop local implementation plans; developing specific plans for coordinating implementation of this Circular of local preschools, formal education institutions, and continuing education institutions.

2. Directing local preschools, formal education institutions, and continuing education institutions to guide children, students, and learners to participate in programs for disseminating, publicizing, and educating on fire safety, fire fighting, and rescue regulations, knowledge, and skills.

3. Commending organizations and individuals with accomplishments in disseminating, publicizing, and educating on fire safety, fire fighting, and rescue regulations, knowledge, and skills in education institutions and taking disciplinary actions against offenders as per the law.

Higher education institutions are responsible for:

1. Assigning contact points to take charge developing plans for fire safety, fire fighting, and rescue education for students in accordance with this Circular.

2. Organizing implementation, coordination, inspection, and supervision of adherence to this Circular Staying under inspection, examination, and producing reports at request of education authorities.

3. Organizing preliminary conclusion, final conclusion, and submitting reports to direct superiors on a periodic basis in each school year.

Article 12. Reports

1. Report contents

a) Article 3 hereof.

b) Management of equipment and instruments serving fire safety, fire fighting, and rescue practice; number of flammable, combustible toxic chemicals to be disposed; cases of fire, explosion, incidents (if any).

Article 13. Entry into force and responsibility for implementation

1. This Circular comes into force from June 26, 2022.

2. Chief of Office, Director of Student Affairs Department, heads of relevant entities affiliated to Ministry of Education and Training; Chairpersons of People’s Committees of provinces and central-affiliated cities; Directors of Departments of Education and training, Director of Department of Education, Science and Technology of Bac Lieu Province, heads of higher education institutions, and relevant entities are responsible for the implementation of this Circular.
