AMENDMENTS TO CIRCULAR NO. 08/2013/TT-BTTTT DATED MARCH 26, 2013 OF MINISTER OF INFORMATION AND COMMUNICATIONS ON QUALITY CONTROL OF TELECOMMUNICATION SERVICES

Pursuant to Law on Telecommunication dated November 23, 2009;

Pursuant to Law on Products and Goods Quality dated November 21, 2007;

Pursuant to Law on Standards and Technical regulations dated June 29, 2006;

Pursuant to Decree No. 25/2011/ND-CP dated April 6, 2011 of Government on elaborating to Law on Telecommunications;

Pursuant to Decree No. 132/2008/ND-CP dated December 31, 2008 by the Government elaborating a number of Articles of the Law on Products and Goods Quality;

Pursuant to Decree No. 127/2007/ND-CP dated August 1, 2007 by the Government on elaboration of implementation of a number of Articles of the Law on Standards and Technical Regulations

At request of Director General of Vietnam Telecommunications Authority,

Minister of Information and Telecommunications promulgates Circular on amendments to Circular No. 08/2013/TT-BTTTT dated March 26, 2013 of Minister of Information and Communications on quality control of telecommunication services.

Article 1. Amendments to Circular No. 08/2013/TT-BTTTT dated March 26, 2013 of Minister of Information and Communications on quality control of telecommunication services:

1. Amend Clause 1 Article 5 as follows:

“1. Telecommunication enterprises (granted telecommunication service provision license by Ministry of Information and Communications) shall submit declarations of telecommunication service quality in person, via postal service in Vietnam Telecommunications Authority at No. 68 Duong Dinh Nghe Road, Yen Hoa Ward, Cau Giay District, Ha Noi City or online via national public service portal (http://dichvucong.vn) or online public service portal of Ministry of Information and Communications (http://dichvucong.mic.gov.vn).”

2. Amend Clause 4 Article 5 as follows:

“4. Within 3 working days from the date on which declarations are received:

a) In case declarations are received, Vietnam Telecommunications Authority shall provide enterprises with “Notice on receipt of declarations on telecommunication service quality” using form under Annex III of this Circular.

b) In case declarations are rejected, Vietnam Telecommunications Authority shall respond to telecommunication enterprises in writing and specify reasons.”

“2. For each service, submit reports to Vietnam Telecommunications Authority in form of electronic files employing digital signatures or physical copies using form of annual reports on telecommunication service quality under Annex IV of this Circular and form of criteria records of telecommunication service quality under Annexes VI, VII and XIII of this Circular for each form of service in provinces and central-affiliated cities where telecommunication enterprises provide services.”

4. Amend Point c) Clause 1 Article 18 as follows:

“b) Physically inspect and assess telecommunication services under “List of telecommunication services subject to mandatory quality control” which telecommunication enterprises are providing in at least 3 provinces and central-affiliated cities for each service or in all provinces and central-affiliated cities (for enterprises that provide services in less than 3 provinces and central-affiliated cities).”

5. Amend Clause 2 Article 18 as follows:

“2. Self-examination results must be kept records using form for Self-examination results of telecommunication services specified under Annex VIII of this Circular and forms for Self-inspection results for telecommunication service criteria under Annexes X, XI, and XIII of this Circular for each service.”

6. Add and replace following Annexes:

a) Add Annexes XII and XIII of this Circular to Circular No. 08/2013/TT-BTTTT.

b) Replace Annexes I, VI, VII, X, and XI of Circular No. 08/2013/TT-BTTTT with Annexes I, VI, VII, X, and XI of this Circular respectively.

Article 2. Annulment and replacement of provisions of Circular No. 08/2013/TT-BTTTT dated March 26, 2013 of Minister of Information and Communications on quality control of telecommunication services:

2. Annul Annexes V and IX.

3. Replace the phrase “thông qua môi trường mạng hoặc bằng văn bản theo quy định” (via the internet or in writing as per the law) with “qua môi trường mạng theo quy định” (via the internet as per the law) under Clause 3 Article 7.

4. Replace the phrase “Hỗ trợ kỹ thuật” (Technical assistance) with “Đảm bảo điều kiện kỹ thuật, nhân sự” (Ensuring technical and personnel conditions) under Point b) Clause 1 Article 9.

Article 3. Implementation:

1. This Circular comes into force from December 15, 2020.

2. Circular No. 11/2017/TT-BTTTT dated June 23, 2017 on amendments to Circular No. 08/2013/TT-BTTTT dated March 26, 2013 of Minister of Information and Communications on quality control of telecommunication services is annulled from the effective date hereof.

3. Director General of Vietnam Telecommunications Authority; Heads of agencies and entities affiliated to Ministry of Information and Communications; Directors of Department of Information and Telecommunications of provinces and central-affiliated cities; General Directors, Directors of telecommunication enterprises and relevant organizations and individuals are responsible for implementation of this Circular.

4. Difficulties that arise during implementation of this Circular should be promptly reported to Ministry of Information and Communications ( for Vietnam Telecommunications Authority) for consideration./.
