RESOLUTION

THE GOVERNMENT’S REGULAR MEETING – AUGUST 2006

The Government’s regular meeting (August 2006) was hold on 30 and 31 August 2006, discussing and deciding on the following issues:

1. The Minister of Planning and Investment reported on the socio-economic situations in 2006 and the plan on socio-economic development in 2007; the Minister of Finance presented the Report on the State budget performance in 2006 and the State budget estimates in 2007.

Through considering the socio-economic situations in the first eight months of 2006 and forecasting the development tendency in the remaining months, the Government agreed that, in 2006, Vietnam has achieved some positive changes in socio-economic situation; it is expected to attain and over-fulfill most of major targets set in the National Assembly’s Resolution on Socio-economic Development Tasks and State Budget Estimates 2006. The growth rate of GDP would be about 8% for the whole year; the economic structure has been further shifted to industrialization and modernization; external activities, international economic integration, import-export and resource mobilization for development investment have been carried out fruitfully; the major economic balances have been maintained stable; the budget collection has exceeded the estimate; the expenditures for development investment and salary reform have rose. Some progresses have been made in social issues: the number of poor households reduced; the new enrollment of tertiary education and long-term vocational training increased; the percentage of under-5-year-old children’s malnutrition went down. Political and social situations have been stabilized, national defense and security solidified.

However, the growth quality still contains many unstable factors; the management and use of resources for socio-economic development have remained ineffective; the education quality at all levels is low; health services have not met people’s demands for health care yet; the administrative reform has been carried out quite slowly; though some achievements have been obtained in the prevention and eradication work, corruption and prodigality have not been pushed back yet.

The year 2007 will be very important to create the impetus for fulfilling many goals of the Five-year Plan on Socio-economic Development (2006–2010). By concretizing the Resolutions by the Party and the National Assembly on the orientations of socio-economic development during the period of 2006-2010, considering the implementation of the Plan 2006 and forecasting the situation in 2007, the Government’s Plan on Socio-economic Development and Budget Estimate 2007 should propose key solutions to strongly shift the economy to the socialist-oriented market mechanism; attract foreign investment and domestic resources; improve the quality of manpower education and training; and perform the administrative reform and the corruption and prodigality prevention and eradication.

The Ministry of Planning and Investment and the Ministry of Finance were assigned to receive all comments to complete their reports and submit to the Prime Minister for consideration and decision before submitting to the Party Central Committee, the Politburo and the National Assembly.

The Ministry of Labour, War Invalids and Social Affairs was commissioned to direct and coordinate with the Ministry of Internal Affairs, the Ministry of Finance, and the Governmental Office to accept all opinions in the meeting, complete all documents and submit them to the Prime Minister for approval and issuance before 15 September 2006.

3. The Government considered the draft Decree instructing the implementation of Article 153, Law on Labour, stipulating the provisional executive board of the trade union in enterprises submitted by the Vietnam Labour Confederation; the Minister-Head of the Governmental Office presented a report summing up all opinions of the Government members on the draft decree.

On the basis of the Law on Labour and realities, the Government agreed on the necessity to issue this Decree in order to create a legal corridor for the Vietnam Labour Confederation to direct the appointment of the provisional executive boards of trade unions in enterprises where no trade union was founded.

The Government requested the Vietnam Labour Confederation to direct and coordinate with the relevant Governmental agencies to receive all comments in the meeting and perfect the draft decree before submitting to the Prime Minister for approval and issuance.

4. The Minister of Justice presented the Gorvernment’s Draft Program on Setting up Laws and Ordinances in 2007; then the Minister-Head of the Governmental Office summed up all comments of the Government members on this Ddraft Program.

The Program on Setting up Laws and Ordinances in 2007 further concretizes the Constitution 1992 (amended and supplemented by the National Assembly in 2001); and fully and timely institutionalizes the Part’s guidelines set in the 10th Resolution and other resolutions made by the Party Central Committee and the Politburo. The Program pays great attention to the building of the laws and ordinances to meet the requirements of the State administrative reform and the country’s socio-economic development.

The laws and ordinances included in the Program should be proper in quantity, well-prepared in quality and ensure the schedule and feasibility in the context that the year 2007 will be the last year of the 11th National Assembly, when the 12th National Assembly will be elected.

The Ministry of Justice was assigned to direct and coordinate with the Governmental Office to take all opinions and comments in the meeting to perfect the Government’s Program on Setting up Laws and Ordinance in 2007 before submitting to the Prime Minister for considering and deciding on the submission to the National Assembly Standing Committee.

5. The Minister of Justice produced the abolishment of administrative surveillance and the abrogation of Decree 31/CP dated 14 April 1997 by the Government on administrative surveillance.

6. The Minister of Justice also presented the Bill on Judicial Assistance; which was commented by the Government members and summarized by the Ministesr-Head of the Governmental Office.

Judicial assistance between Vietnam and other countries have been done for years. However, Vietnam’s system of laws on judicial assistance is still insufficient and inconsistent. To protect legal rights and interests of the State, agencies, organizations and Vietnamese citizens at home and abroad, and to better serve the process of international integration, the issuance of the Law on Judicial Assistance is very necessary.

The Ministry of Justice was assigned to direct and coordinate with the Governmental Office and other relevant agencies anandoaghiepehieto collect all opinions in the meeting and complete the Bill on Judicial Assistance and submit it to the Prime Minister for considering and deciding on the submission to the National Assembly Standing Committee.

7. The Government considered the Report on the results of production, businees, services and investment in August and the socio-economic situation in the first eight months in 2006 presented by the Ministry of Planning and Investment; the Report on the State Budget Allocation in August and the first eight months of 2006 presented by the Ministry of Finance; and the Report on Trade Situation in August 2006 presented by the Ministry of Trade.

In August and the first eight months of 2006, the country’s socio-economic situation has continued to develop sustainably. A moderate growth rate has been obtained in industrial production. Agricultural production has been stabilized, the bird flu has been effectively controlled. Progresses have been made in services, import-export, development investment and budget collection. The poverty alleviation has been fruitfully carried out. However, there have remained many difficultires and shortcomings, such as the increase of petrol price and bank interest rate leading to the increase in production costs; epidemics spreading among human beings, crops, domestic poultry and cattle; consecutive natural disasters causing heavy losses of men and properties; traffic order and safety was not improved, the number of serious traffic accidents increasing; complaints which were slowly dealt with and some burning social issues reducing people’s confidence.

To fulfill the socio-economic development plan in 2006, the first year to implement the Five-year Plan on Socio-economic Development 2006-2010, the Government requested the Ministries, sectors and localities not to be over-satisfied with the achievements and to continue the realization of Resolutions 01/2006/NQ-CP and 13/2006/NQ-CP of the Government, Directions 27/2006/CT-TTg and 28/2006/CT-TTg by the Prime Minister; to make great efforts to cope with difficulties to promote production, business, and export; to speed up the disbursement of investment capital for basic construction; to take more measures to prevent and eradicate epidemics; to promptly issue documents instructing the implementation of the laws approved by the National Assembly; to maintain national defense and security; and to control traffic accidents and fight against deforestation./.
