DECISION

PROMULGATING THE LIST OF GOODS ITEMS BANNED FROM IMPORT AND EXPORT IN ACCORDANCE WITH THE GOVERNMENT’S DECREE No. 12/2006/ND-CP OF JANUARY 23, 2006

THE MINISTER OF DEFENSE

Pursuant to the November 12, 1996 Law on Promulgation of Legal Documents which was amended and supplemented on December 16, 2002;
Pursuant to the Government’s Decree No. 30/2004/ND-CP of January 6, 2004, defining the functions, tasks, powers and organizational structure of the Ministry of Defense;
Pursuant to the Government’s Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law concerning international trading activities and activities in franchise, purchase, sale, export-processing and transit of goods with foreign partners;
On the basis of the list of weapons, ammunition, explosives, military technical equipment in the current Import and Export Tariffs issued by the Ministry of Finance; 
At the proposal of the director of the Planning and Investment Department, the Ministry of Defense,

DECIDES:

Article 1.-

1. To promulgate the list of weapons, ammunition, explosives, and military technical equipment banned from import and export in accordance with the Government’s Decree No. 12/2006/ND-CP of January 23, 2006 (the list is enclosed herewith).

2. The import and export of weapons, ammunition, explosives, and military technical equipment on the list of ban from import and export shall be carried out according to the Prime Minister’s decision.

3. On the basis of the Prime Minister’s decision, the Defense Minister shall grant permits to enterprises, units and individuals to export or import goods on the above list to serve defense and security tasks. 

Article 2.- This Decision takes effect 15 days after its publication in “CONG BAO.”

Article 3.- Ministries, ministerial-level agencies, Government-attached agencies, People’s Committees of provinces and centrally-run cities, and relevant organizations and individuals shall have to implement this Decision.
